This week Craig continues our conversation on presidential powers by looking at those NOT found in the Constitution - implied or inherent powers. We’ll talk about how the president uses his or her power to negotiate executive agreements, recommend legislative initiatives, instate executive orders, impound funds, and claim executive privilege in order to get things done. Implied powers are kind of tough to tack down, as they aren’t really powers until they’re asserted, but once the they are, most subsequent presidents chose not to give them up. So we’ll try to cover those we’ve seen so far and talk a little bit about reactions to these sometimes controversial actions from the other branches of Congress.

Dennis: But all the decisions of that officer have to be ratified at a special biweekly meeting--

Dennis: By a simple majority, in the case of purely internal affairs--

Dennis: But by a two thirds majority, in the case of more major--
Arthur: Be quiet! I order you to be quiet!
Dennis' Mother: Order, eh? Who does he think he is?
Arthur: I am your king!
Dennis' Mother: Well I didn't vote for you.
Arthur: You don't vote for kings!
Dennis' Mother: Well how'd you become king, then?

Dennis: Listen. Strange women lying in ponds distributing swords is no basis for a system of government. Supreme executive power derives from a mandate from the masses, not from some farcical aquatic ceremony.
Arthur: Be quiet!
Dennis: You can't expect to wield supreme power just 'cause some watery tart threw a sword at you!
Arthur: Shut up!
Dennis: I mean, if I went 'round saying I was an emperor just because some moistened bint had lobbed a scimitar at me, they'd put me away!
Arthur: Shut up; will you SHUT UP?! [Grabs Dennis and shakes him]
Dennis: Ah, now we see the violence inherent in the system!
Arthur: SHUT UP!
Dennis: Oh! Come and see the violence inherent in the system! Help! Help! I'm being repressed!!
Arthur: BLOODY PEASANT! releases Dennis and walks away as other peasents come to see what's going on]
Dennis: Oh, what a giveaway. Did you hear that? Did you hear that, eh? That's what I'm all about! Did you see him repressing me? You saw it, didn't you?

The executive branch is the part of government that has sole authority and responsibility for the daily administration of the state. The executive branch executes the law. The division of power into separate branches of government is central to the idea of the separation of powers.
In many countries, the term "government" connotes only the executive branch. However, this usage fails to differentiate between despotic and democratic forms of government. In authoritarian systems, such as a dictatorship or absolute monarchy, where the different powers of government are assumed by one person or small oligarchy, the executive branch ceases to exist since there is no other branch with which to share separate but equal governmental powers.
The separation of powers system is designed to distribute authority away from the executive branch—an attempt to preserve individual liberty in response to tyrannical leadership throughout history. The executive officer is not supposed to make laws (the role of the legislature) or interpret them (the role of the judiciary). The role of the executive is to enforce the law as written by the legislature and interpreted by the judicial system.

Bruce Fein is a lawyer in the United States who specializes in constitutional and international law. Fein has written numerous articles on constitutional issues for The Washington Times, Slate.com, The New York Times, Legal Times, and is active on the issues of civil liberties. He has also worked for the American Enterprise Institute and the Heritage Foundation, both conservative think tanks, as an analyst and commentator.
Fein is a principal in a government affairs and public relations firm, The Lichfield Group, in Washington, D.C.. He is also a resident scholar at the Turkish Coalition of America.
Bruce Fein was born in 1943 and raised in San Francisco to observant Jewish parents. He received his degree in law from Harvard Law School in 1972.
Fein was a top Justice Department official under the Reagan administration. He has heavily criticized every subsequent U.S. President.
Under President Ronald Reagan, Fein served as an associate deputy attorney general from 1981 to 1982 and as general counsel to the Federal Communications Commission. During that period, he wrote an extensive 30-page critique of Times v. Sullivan, the Supreme Court ruling that freed American media from much of its liability under libel law in the United States. That memorandum was briefly misattributed to Judge John Roberts while his nomination to be Chief Justice of the United States was pending. In 1987, he served as the minority (minority party) research director of the committee in the United States House of Representatives that investigated the Iran-Contra Affair.

Executive Power (1997)
PlotWhile protecting the U.S. President, Secret Service agent Nick Sager helps him to dispose of the body of a young girl, who accidentally died during an adulterous encounter. Some time later, a few weeks before the elections, the disillusioned ex-agent is approached by his former partner. Mansfield is the author and co-translator of studies of and/or by major political philosophers such as Aristotle, Edmund Burke, Niccolò Machiavelli, Alexis de Tocqueville, and Thomas Hobbes, of Constitutional government, and of Manliness (2006). In interviews Mansfield has acknowledged the work of Leo Strauss as the key modern influence on his own political philosophy.[1]

After the establishment of police forces in America beginning in the 1830s, this idea eventually fell by the wayside and citizens began to expect and demand protection by the state. “Among the natural rights of the Colonists are these: First, a right to life; Secondly, to liberty; Thirdly, to property; together with the right to support and defend them in the best manner they can. These are evident branches of, rather than deductions from, the duty of self-preservation, commonly called the first law of nature,” Samuel Adams wrote in 1772. In other words, Americans exercising the natural right of self-protection—what our forefathers considered a duty—must submit to a state that has no legal obligation to protect them.

Inga Beale, the Lloyd's of London chief executive, has topped an annual power list of the top 100 LGBT executives.
It is the first time a woman, and a bisexual, has been placed at the top of the list, compiled by networking group OUTstanding and the Financial Times.
Alan Joyce, chief executive of Qantas, is in second, with HSBC's UK and European chief, Antonio Simoes, third.
The list aims to highlight positive lesbian, gay, bisexual and transgender role models in business.
Suki Sandhu, chief executive of OUTstanding, said everyone on the list was helping to challenge the assumption that you cannot be both openly LGBT in business and be successful.
"Those featured are an inspiration to anyone who fears that they may have to be closeted at work, and waste valuable effort muting their authentic selves," he said.
Ms Beale, who became the Lloyd's chief in January 2014, said she was delighted and honoured to appear on the Top 100 list.
"I am proud of the commitment of Lloyd's and the London insurance market to celebrate diversity and ensure we are an attractive, globally relevant and inclusive sector," she said.
'Attitudes changing'
Mr Simoes, who topped the inaugural ist, said companies needed workforces that reflected modern society.
"We still have some way to go before everyone feels confident enough to express themselves in an authentic way at work. Initiatives like this are a powerful statement that attitudes are changing and we are making genuine progress," he said. Martine Rothblatt, the transgender chief executive of United Therapeutics, is in fourth place, with Burberry boss Christopher Bailey in eighth place.
Those appearing on the Top 100 list were nominated by peers and colleagues. Nominations were reviewed by OUTstanding's judging panel, which included former BP chief executive Lord Browne and Dawn Airey, the former Channel 5 boss who is now chief executive of Getty Images.
Nominees were scored on the seniority and influence of their role, their impact on LGBT inclusion inside and outside the workplace and their business achievements.
All nominees agreed to be included on the list. Tim Cook, the chief executive of Apple, was nominated by many people, but OUTstanding said it was unable to secure his permission to be included and had therefore omitted him.
Mr Cook wrote in a Bloomberg article last year: "If hearing that the CEO of Apple is gay can help someone struggling to come to terms with who he or she is ... then it's worth the trade-off with my own privacy." The organisation has also compiled an Allies list, with Facebook chief executive Mark Zuckerberg in first place for his work championing LGBT diversity both within his company and globally.
Last year's winner, Virgin boss Sir Richard Branson, is in second place on the 2015 list.
