On the 17th June 2015 Hong Kong's 70 member Legislative Council spent a day discussing a political reform proposal. As expected the day ended without a vote which has been pushed back to Thursday or Friday. Outside the building protestors from both sides of the debate had heated discussions across barriers erected to separate them.

Hong Kong Governor Chris Patten says his biggest regret is not convincing Beijing that it could trust Hong Kong's people.
Patten spoke Thursday at his last Question Time in the Territory's Legislative Council before the handover to China.
Arriving for the last time at the LegCo building with his wife Lavender, Patten was greeted by a small group of well-wishers anxious to witness a little bit of history.
After the handover, this elected legislature will no longer sit.
It was established under electoral reforms introduced by Patten despite ardent protests from Beijing.
From July 1, a provisional legislature appointed by China will occupy these benches.
Democratic Party leader Martin Lee - who will lose his seat after the handover - asked the first question.

"What is the single most important thing you would have liked to have done for Hong Kong which you could not do."

With his wife watching from the balcony, Patten was questioned about accusations that the P-L-A are enjoying special privileges ahead of the handover - accusations the governor categorically denied.

भारत के विधान मंडलों में चौथा सबसे पुराना सदन उत्तर प्रदेश विधान परिषद का गौरवशाली इतिहास रहा है। उत्तर प्रदेश से उत्तराखंड के अलग होने के बाद भी यह देश की सबसे बड़ी विधान परिषद बनी हुई है। सर सैय्यद अहमद खां,पंडित मोतीलाल नेहरू, मदन मोहन मालवीय, गोविंद बल्लभ पंत, गणेश शंकर विद्यार्थी और सीवाई चिंतामणि से लेकर तमाम दिग्गज हस्तियां इसकी सदस्य रहीं।
उत्तर प्रदेश का विधायी इतिहास 8 जनवरी 1887 को इलाहाबाद के परिषद की स्थापना से आरंभ हुआ। समय के साथ परिषद लगातार ताकतवर होती रही। 1919 में इसे बजट पारित करने जैसी शक्ति भी मिली। 1887 से 1936 तक विधान मंडल के इकलौते सदन के रुप में परिषद ने शानदार काम किया। बाद में 1937 से दो सदनीय व्यवस्था लागू हो गयी। हमारे विधान मंडल नामक नए कार्यक्रम के तहत राज्य सभा टीवी ने उत्तर प्रदेश विधान परिषद के लंबे कालखंड में आए उतार-चढ़ाव और उसके योगदान को केंद्र में रख कर खास पोशनी डाली है।

Hong Kong is getting ready for Sunday's Legislative Council elections - the colony's last and most democratic elections under British rule.
Beijing has said it will abolish the existing system of government when it takes over in 1997.
Nonetheless is it trying to ensure a China-friendly Council by backing certain candidates.
But with such a short time to go and so many uncertainties ahead, many Hong Kong people feel it is futile to vote at all.
About four (m) million people in Hong Kong are eligible to vote - but only about half of them are expected to do so.
Democracy is a relatively new concept to the population of Hong Kong, so candidates are having to work hard to persuade voters it's a worthwhile exercise.
Beijing's support of pro-China candidates in the election has made some voters even more sceptical about the legitimacy of the process.
SOUNDBITE:
"China has certainly been, through its agents in Hong Kong, the New China News Agency has actually set up a unit monitoring the election and for example when there are a number of pro-China candidates contesting the same seat it will be resolved
by the NCNA people so there will only be one candidate and our opponents have no problem with funding because Beijing is very much behind it."

The people of Hong Kong have never had full democracy before and are taking time to catch on to the idea of voting.
Christine Loh, an independent candidate for a Legislative Council seat, feels that it is Britain's fault but she says it's not too late to put that right - even if China is about to take over.

"The problem with colonialism is that it disempowers people. People are not sure therefore what the vote is worth. They see people that they elect to the legislature also as relatively disempowered because we can't form the government, so for the future
years to come, together we've got to create a form of representative government where the people's representatives will have a real role in running the government."

Loh says it is not a foregone conclusion that China will rule Hong Kong from Beijing.

"China has proposed that they want to liquidate the three tiers of government as the first act of the sovereign power in 1997. Well, I think they better think very carefully about this
because to get rid of the people's representative is going to be a very big deal."

Researchers at Hong Kong University have been monitoring opinion in Hong Kong as well as China's attitude to this election.

preparatory committee next year. So I think if the Legislative Council election turn out to be a landslide victory for the Democratic Party I think they will not be on friendly terms with China, so China will take a different strategy against Legislative Council in future."

But do people think voting now will make any impact on their future?

Legislative Council of Brunei (Malay: Majlis Mesyuarat Negara Brunei (مجليس مشوارت نڬارا بروني)) is the parliament in Brunei.
Brunei, officially the Nation of Brunei, the Abode of Peace (Malay: Negara Brunei Darussalam, Jawi: نڬارا بروني دارالسلام), is a sovereign state located on the north coast of the island of Borneo in Southeast Asia. Apart from its coastline with the South China Sea, the country is completely surrounded by the state of Sarawak, Malaysia. It is separated into two parts by the Sarawak district of Limbang. Brunei is the only sovereign state completely on the island of Borneo; the remainder of the island's territory is divided between the nations of Malaysia and Indonesia. Brunei's population was 408,786 in July 2012.
At the peak of the Bruneian Empire, Sultan Bolkiah (reigned 1485–1528) is alleged to have had control over most regions of Borneo, including modern-day Sarawak and Sabah, as well as the Sulu archipelago off the northeast tip of Borneo, Seludong (modern-day Manila), and the islands off the northwest tip of Borneo. The maritime state was visited by Spain's Magellan Expedition in 1521 and fought against Spain in 1578's Castille War.
During the 19th century, the Bruneian Empire began to decline. The Sultanate ceded Sarawak (Kuching) to James Brooke and installed him as the White Rajah, and it ceded Sabah to the British North Borneo Chartered Company. In 1888, Brunei became a British protectorate and was assigned a British resident as colonial manager in 1906. After the Japanese occupation during World War II, in 1959 a new constitution was written. In 1962, a small armed rebellion against the monarchy was ended with the help of the British.
Brunei gained its independence from the United Kingdom on 1 January 1984. Economic growth during the 1990s and 2000s, with the GDP increasing 56% from 1999 to 2008, transformed Brunei into an industrialised country. It has developed wealth from extensive petroleum and natural gas fields. Brunei has the second-highest Human Development Index among the Southeast Asia nations, after Singapore, and is classified as a "developed country". According to the International Monetary Fund (IMF), Brunei is ranked fifth in the world by gross domestic product per capita at purchasing power parity. The IMF estimated, in 2011, that Brunei was one of two countries (the other being Libya) with a public debt at 0% of the national GDP. Forbes also ranks Brunei as the fifth-richest nation out of 182, based on its petroleum and natural gas fields.

The Government is asking for public views on amending the legislation on child custody and access based on recommendations from the Law Reform Commission.
During the four-month consultation, citizens’ opinions will be collected to help refine the draft bill before it is introduced to the Legislative Council.
Announcing the details today, Secretary for Labour & Welfare Matthew Cheung noted the community has become increasingly concerned about protecting the interests and rights of children affected by divorce.
The proposal aims to put in place a 'parental responsibility model' that stresses both parents’ continuing responsibilities, rather than their individual parental rights, toward their children. It also emphasises both parents would retain responsibilities in major decisions about their children after divorce.
This is unlike the existing child custody and access law which defines the parent-child relationship in terms of guardianship, or parents’ rights and authority over children.
“The best interests of children should be the guiding principle for all court proceedings concerning children," he said.
Having also examined recent developments in other common law jurisdictions, the Government feels Hong Kong should pursue this model, and implement the commission’s recommendations through legislative or administrative means.
In consultation with the Department of Justice, the Home Affairs Bureau, the Social Welfare Department, the Judiciary and relevant bureaus and departments, the bureau has prepared a draft Children Proceedings (Parental Responsibility) Bill.
The labour and welfare chief said, in view of certain implications the draft bill will have for divorced families and their children, he sees merit in collecting the community’s views to refine it before it is introduced into the Legislative Council.
The consultation paper is available at the bureau's webpage or District Offices.
Views should be sent by post to Team 1, Labour & Welfare Bureau, 11/F, West Wing, Central Government Offices, 2 Tim Mei Avenue, Tamar, by fax to 2524 7635, or by e-mail to parentalresponsibility_consult@lwb.gov.hk, on or before March 25. (http://j.mp/1NOOe1a)

2nd Reading Speech - Independent Commission Against Corruption Amendment Bill 2015
The Hon. ADAM SEARLE (Leader of the Opposition) [11.37 a.m.]: The Labor Opposition supports the Independent Commission Against Corruption Amendment Bill 2015. On the same day in April that the High Court of Australia delivered its judgement in the Cunneen matter, the Leader of the Opposition stated:
I believe the Parliament needs to consider legislating to strengthen the ICAC's powers to fight corruption. Labor wants to see a powerful statutory corruption fighter.
Since that time, the Labor Opposition has worked with the Premier to ensure that the Independent Commission Against Corruption is given the legislative powers it needs to effectively combat corruption. To that end, Labor gave full support to the establishment of an independent panel to review the jurisdiction of the ICAC. That panel consisted of the former Chief Justice of the Supreme Court of this State and of the High Court of Australia, the Hon. Murray Gleeson, AC, and Mr Bruce McClintock, SC, an outstanding counsel who also conducted the statutory review of the ICAC legislation of this Parliament in 2005. The bill now before this Chamber draws on the recommendations of this panel, and the amendments to the substantive Act strengthen the powers of the Independent Commission Against Corruption [ICAC]. On 26 May 1988 in the Legislative Assembly, former Premier Nick Greiner spoke to the bill that established the institution. He said:
Nothing is more destructive of democracy than a situation where the people lack confidence in those administrators and institutions that stand in a position of public trust. If a liberal and democratic society is to flourish we need to ensure that the credibility of public institutions is restored and safeguarded, and that community confidence in the integrity of public administration is preserved and justified.
He went on to say:
… the definition in the legislation has been framed to include everyone who is conceivably in a position of public trust. There are no exceptions and there are no exemptions.
Under the leadership of Bob Carr, the establishment of this important institution was supported by the Labor Party in 1988. In our view, the ICAC has served the people of New South Wales well since that time. This bill will hopefully ensure that the ICAC continues to serve the people of this State well. The overview of the bill records the history that led to it. The legislation seeks to implement the recommendations of the panel, consisting of Murray Gleeson and Bruce McClintock. The panel resulted from a challenge to the jurisdiction of the ICAC in the now well-known case of Independent Commission Against Corruption v Cunneen.
The decision focused on the meaning of section 8 (2) of the Act and on the meaning of the expression "adversely affect the exercise of the official function of any public official". The question was: Did it mean adversely affect the probity of the exercise of the function or adversely affect the efficacy of the exercise of the function? A lot depends on the approach one takes to that question. The High Court took the narrower definition rather than the more expansive definition, despite the fact that the Independent Commission Against Corruption and those who had dealings with it and the 2005 statutory review conducted by Mr McClintock all assumed that it was the wider view of the jurisdiction of the ICAC that was the correct one. It informed the way in which the ICAC conducted its business and issued its reports which have been tabled in the Parliament.
In my view, there was a broad understanding of the jurisdiction of the ICAC. However, the High Court took a different view. As a matter of law, of course, the High Court is always correct. However, I prefer the view and the judgements of Chief Justice Bathurst of the Supreme Court of New South Wales in his Court of Appeal judgement and the judgement of Justice Gageler in the High Court to that of the majority of the High Court. As a matter of black letter statutory interpretation, I think the majority of the High Court engaged in what lawyers like to deride as judicial activism. They did the very thing in interpreting section 8 (2) of the Act that the balance of section 8 says you cannot do. There is a big red light saying it cannot be looked at in this way, but they did...
