Report on the Hearing of San Jose Ethics Commission throwing out four complaints against Manh Nguyen On Wednesday June 10, 2015, San Jose’s Ethic Commission unanimously dismissed four complaints against Mr. Manh Nguyen, the City Council Candidate of District 4, who was accused of lying about his marital status. The decision to throw out these complaints was made after a three-hour meeting with the presence of about 50 Vietnamese Americans who support the complaints. The four complaints were filed by different people but with the same content that accused Mr Manh Nguyen of committing perjury on a City form, Family Gift Reporting Form. On this form Mr. Nguyen marked the box indicating he has no spouse. Meanwhile, in the court records of his property declaration form, he clearly marked he is “married” or “separated”. These complaints were evaluated by the law firm Hanson Bridgett. Steve Miller, an attorney of this law firm, said that since all four complaints had the same content, they would all be considered in a single session. According to Mr. Miller, all four complaints not only had no merit, but even if they were correct, they would still not constitute a violation of City ordinance. This was because Mr. Manh Nguyen has no legal obligation to submit the gift form at this time. In light of these facts, Mr. Miller recommended that the commission dismiss all four complaints. Mr Miller, in his conclusion, said all complaints would be considered according to the law, without any prejudice. In this case, the Family Gift Reporting Form only required submission from public officials each year. Candidates for public office, however, are not required to fill out this form. This is likely due to the fact that candidates do not hold public office, making it less likely that they would receive gifts or bribes. However, as a matter of convenience, this form has been provided to candidates for public office. All 5 members of the commission unanimously voted not to investigate the four complaints, and close the case. The Ethics Commission voted not to refer the complaints to the District Attorney by 4- 1. Before ending this report, I, My Loi, have something to say to who have made false accusations against me regarding my testimony before the Ethic Commission. Mr. Steven Dovan said that when you say something untrue, make false accusations, or commit perjury, you will be liable to the law. The evidence is very clear that some are using a false picture to make false accusations. I have all of the evidence to prove this, proving that I am the designer of the picture presented to the Ethics Commission by Mr. Dovan. I published the correction on my VietVungVinh.com website, took the photo down right away, and replaced it with another photo of Mr. Manh Nguyen looking younger and more handsome. This can be verified through my website and server, through digital evidence which cannot be manipulated. In conclusion, at the end of 2014, I published the picture of Manh Nguyen with the honorific “esq”, and within a couple of days took it down, replacing it with my correction and an apology to my viewership. Those who are misrepresenting the facts of this situation to defame Mr. Nguyen will have to respond. My Loi reports from San Jose.
