Hundreds in Central Valley may lose property to make way for flawed train.

"It's like a field of dreams—if you build it they will come," says Mary Jane Fagundes, a Hanford, California resident in danger of losing her home to California's high speed rail. "But it's just a dream that's never going to become a reality."
Fagundes is one of many Central Valley property owners whose land will be affected by the construction of the high speed rail. Fagundes and her husband, Jerry, first learned that the rail was coming down their street from a cousin. Though the train will run 80 feet from their front door and cause severe vibration and noise damage, the California High Speed Rail Authority will not deal with the Fagundes family because the tracks do not technically touch their property line.
The Fagundes family will have to initiate an inverse condemnation suit against the state to recoup the losses from the damage that will be caused to their property due to the construction of the high speed rail.
Since the rail was first approved by California voters in 2008, the project has been met with scrutiny from those on both the left and right for being a waste of time and money. Construction for the 800 mile train which will eventually connect San Francisco to San Diego is already way over budget—the proposed $68 billion dollar plan is now expected to cost over $100 billion—and is almost a decade behind schedule.
Despite these significant hurdles, Jerry Brown and high speed rail are moving forward and are ramping up efforts to secure the land needed for the train through the use of eminent domain.
The Fresno Bee reports that over 200 properties in the Central Valley alone have been targeted for condemnation by the state Public Works board to make way for the train and the first round of eminent domain cases are expected in courts this fall. Property owners in the first and second segments of track that span from Madera, California to Bakersfield, California are beginning to receive appraisals for their land and their have been numerous complaints about the manner in which the appraisals are being done.
Alisa Gomez, a high school teacher in Corcoran, California, is one of the property owners that has experienced problems with the appraisal process. "We got a letter stating that they wanted to appraise our property and they told us to call them when we were ready to setup an appointment. About a week later there were appraisers walking up and down the road and caught my husband at lunch time wanted to do the appraisal right then and there."
Gomez and her husband rushed home from work to do a last minute appraisal. Gomez then states rail representatives started contacting her ex-husband to get in touch with her about the property. "I don't understand why they were contacting him," says Gomez. "It's a little bit of an invasion of privacy."
After multiple attempts to remedy the situation with the rail authority, Gomez then says she came home one day to find a FedEx package thrown over her fence which contained her appraisal offer. "So I open the appraisals up and there's multiple mistakes. My name is misspelled—spelled right here—misspelled in another area. When I look through it it's kind of sad. They take properties that were foreclosed, properties that were in town instead of in the country, looked at properties that were less bedrooms, less square footage, run down and it was just it was a smack in the face offer what they had appraised us at."
"I think the rail representatives in certain instances are definitely sort of applying pressure tactics to the land owners," says Ray Carlson, a property lawyer who is representing several clients in the Hanford area. "Some of these appraisals they didn't even know were being made, they just ended up on their doorstep one day."
Gomez and Fagundes have teamed up with the Citizens for California High Speed Rail Accountability, a citizen watchdog group who's mission is to bring accountability to the high speed rail construction process.
"I think they probably started here because this is somewhere that is very simple and maybe they thought we wouldn't fight," says Gomez. "But that's definitely not the case. There's some people that really care about their property and the people around them. They do the research and they're going to make sure that they [California High Speed Rail Authority] is held accountable."

KQED's JOHN MYERS: One of the discussions we've been having in the last few weeks too is on the issue of action. The Supreme Court ruled on the Michigan case just a few days ago. You've spoken about affirmative action. California's had a very long discussion about it. On the case of the high court, did they get it wrong?
MYERS: One of the discussions we've been having in the last few weeks too, is on the issue of affirmative action. The U.S. Supreme Court ruled in the Michigan case just a few days ago. You've spoken about affirmative action. California's had a very long discussion about it. On the case of the high court, and when the issue, did they get it wrong, I mean where does this go from here?
BROWN: Well, it's definitely different than I think the court many years ago when for example the voters voted to make it possible to discriminate in housing. Which, the concern was that discrimination against African Americans or other minorities. The people voted for that. And the proposition. And yet the state supreme court and the US supreme court invalidated the people's decision. Same thing on Proposition 8. And gay marriage. So the court has a duty to uphold constitutional rights, even against popular sentiment. And this case, I do think that because of where we are in the gaps between the races, I think we need some degree of affirmative action. I think the court shut the door there against what Michigan was consciously trying to do.
MYERS: So that's been a big discussion in Sacramento. The constitutional amendment that kind of got sidelined, there was some disagreement. Asian American legislators. But you would like to see us go back to some version of it, you think... (JB talks over)
BROWN: I think it was helpful, I think it was chancy, you can see now it's dividing even different ethnic groups. It's not at all clear that if you put it on the ballot that it could be passed. So I think we have to strive in whatever way we can under existing law to have a fair system of admissions and a fair system of government contracting. It's never gonna be perfect.

The Man Up comment was aimed at legislative Democrats who have been reluctant to endorse Brown's proposed state budget cuts for FY 2012-13. This video contains:

2) Brown indicating that his experience with GOP legislators regarding the 2011-12 budget means he can't work with them for 2012-13.
3) Brown indicating that unions should endorse his public pension plan or they will get more stringent treatment through the initiative process.
4) Brown indicating that (like former Governor Schwarzenegger), he did not favor a state run single-payer health insurance plan.
5) Brown making a case for the proposed high speed rail project citing his father's big infrastructure projects of the 1960s and harking back to his pioneer ancestry (that he also cited in his inaugural address). This element of Brown's remarks was in sharp contrast to his "small is beautiful"/anti-big-project term as governor in the late 1970s.

MYERS: You know there's some people in the state who are very closely watching it. They're worried about the Obama administration...
BROWN: And I'm concerned about it too. And I've got so many things on my plate that , look, here's the main point on keystone, on fracking, on driving cars. We have to curb greenhouse gases. California is the leader in that, we have to move even faster but we gotta get the rest of the world going with us cuz we're only one percent -- California. So it isn't just one project. The real question is do we have a framework of policy and commitment to reduce petroleum consumption and the generation of greenhouse gases at the rate needed to keep the change in temperature to 2 degrees centigrade. And the answer is no we don't. It's not even close! In the rest of the world, California is the leader. So whatever Obama ends up doing on keystone, I'm committed to having California lead the rest of the nation and the world in reducing the use of gasoline, oil, and all the other petroleum products, methane and the rest of it. So we don't destroy the fabric of life that we all depend on.

Okay, so since November 30 I have been calling for those that carry guns, legally, to take action when involved in a mass violence/terrorist situation. A situation occurred in San Bernardino, CA, and a few days after that the Governor of California Jerry Brown, made statements in the media that Arizona and another state have gun laws that are too liberal that it creates a "gigantic back door through which any terrorist can walk." I am offended and every Arizonan should be as well, its an insult.
We do have gun laws that allow out citizens to legally carry AND PROTECT THEMSELVES if needed. I again am reiterating my call, if you legally carry a concealed weapons, or if you open carry, please, be ready to use it to protect yourself and those around you during a mass violence/terrorist incident UNTIL law enforcement can arrive. Let me give you some more advice, at the time law enforcement arrives to the scene, follow orders, do not continue to engage unless the law enforcement official requests.

A member of the Democratic Party, Brown previously served as the 34th Governor from 1975 to 1983, and is the longest-serving governor in California history.[2] Prior to and following his first governorship, Brown served in numerous state, local and party positions, including three times a candidate for the Democratic nomination for President of the United States.
A bachelor as governor and mayor, Brown attracted attention for dating high-profile women, the most notable of whom was singer Linda Ronstadt.[102] In March 2005, Brown announced his engagement to his girlfriend since 1990, Anne Gust, former chief administrative officer for The Gap.[103] They were married on June 18 in a ceremony officiated by Senator Dianne Feinstein in the Rotunda Building in downtown Oakland. They had a second, religious ceremony later in the day in the Roman Catholic church in San Francisco where Brown's parents had been married. Brown and Gust live in the Oakland Hills in a home purchased for $1.8 million, as reported by The Huffington Post.[104]
Beginning in 1995, Brown hosted a daily call-in talk show on the local Pacifica Radio station, KPFA-FM, in Berkeley broadcast to major US markets.[46] Both the radio program and Brown's political action organization, based in Oakland, were called We the People.[46] His programs, usually featuring invited guests, generally explored alternative views on a wide range of social and political issues, from education and health care to spirituality and the death penalty.[46]
The official gubernatorial portrait of Jerry Brown, commemorating his first period as Governor of California was painted by Don Bachardy and unveiled in 1984. The painting has long been controversial due to its departure from the traditional norms of portraiture.[105]
Brown has a long-term friendship with Jacques Barzaghi, his aide-de-camp, whom he met in the early 1970s and put on his payroll. Author Roger Rapaport wrote in his 1982 Brown biography California Dreaming: The Political Odyssey of Pat & Jerry Brown, "this combination clerk, chauffeur, fashion consultant, decorator and trusted friend had no discernible powers. Yet late at night, after everyone had gone home to their families and TV consoles, it was Jacques who lingered in the Secretary (of state's) office." Barzaghi and his sixth spouse Aisha lived with Brown in the warehouse in Jack London Square; Barzaghi was brought into Oakland city government upon Brown's election as mayor, where Barzaghi first acted as the mayor's armed bodyguard.
