After attracting a lot of debate in the legal and Parliamentary Affairs committee of Parliament, with some MPs hitting at the lack of adequate time to look at the bills, the Attorney General has decided to withdraw the electoral commission amendment bill 2015.
The Government Chief whip Ruth Nankabirwa, explains that the proposed amendments were administrative matters which can be solved internally by the Electoral Commission and don’t require legislation.
The bill had sought to provide for the commission to transmit an electronic text based copy of voter’s register without photographs in order to reduce the cost of making copies of register available to political parties.
The same bill had sought also to re-designate registrars as district election administrators and provide for them to maintain and update the voters’ register and assist the commission to manage other activities in the electoral process.
The government Chief whip also disclosed that the 9th parliament will not amend the National Youth Council act and the Parliamentary elections act again to streamline the election of representative of special interest groups because time is not their ally.
She also defended the increment of the Parliamentary nomination fees from 200,000 shillings to 3million dismissing allegations that it is intended to block new

The passed amendments among others changed the Electoral Commission’s name to the Independent Electoral Commission. Parliament however rejected calls to expand the Commission, as well as increasing the number of years in the Commissioners’ terms to seven years.
Officials at the Dr.Badru Kiggundu led Commissionaire now anxiously waiting for the President to accent to the bill.
Jotham Taremwa the Commission Mouthpiece laughed off claims of a lack of independence as claimed by the opposition.
On independents, the Commission still requires candidates to their present programs before they are allowed to consult their voters.
But, how will independents affect the country’s politics?
Opposition political parties had demanded an overhaul of the Electoral commission and Electoral laws, something they failed to achieve due to NRM’s huge numbers in the house. This was one of the major proposals presented to Parliament by a combined Opposition and Civil society. Some Opposition MPs however voted with the NRM.
The Uganda Peoples’ Congress under James Akena has now threatened to discipline all its members who joined the NRM in supporting the bill, contrary to the party guidelines.
The Forum for Democratic Change Spokesperson meanwhile acknowledged losing the battle but not the war.

On independents, the Commission still requires candidates to their present programs before they are allowed to consult their voters.
But, how will independents affect the country’s politics?
Opposition political parties had demanded an overhaul of the Electoral commission and Electoral laws, something they failed to achieve due to NRM’s huge numbers in the house. This was one of the major proposals presented to Parliament by a combined Opposition and Civil society. Some Opposition MPs however voted with the NRM.
The Uganda Peoples’ Congress under James Akena has now threatened to discipline all its members who joined the NRM in supporting the bill, contrary to the party guidelines.
The Forum for Democratic Change Spokesperson meanwhile acknowledged losing the battle but not the war.

Four Electoral Commission officials among them the Chairperson Engineer Badru Kiggundu, secretary Sam Rwakoojo, Spokespersons Jonathan Taremwa and Paul Bukenya have asked the High court to strike out with costs the case in which a one Charles Nsubuga filed accusing them of violating the rights of the electorate to freely associate with presidential aspirants.
Through their lawyers led by Enos Tumusiime the officials say that Nsubuga flouted the electoral proceedures that require him to first address his greivances against the electoral process before the Commission.
The officials also argue its after the commission has resolved his complaints that he would appeal to the high court in case he is not satisfied.
In response Nsubuga's lawyers Fred muwema and John Mary Mugisha maintained that the officers were sued in their individual capacities for blocking consultative meetings for presidential aspirant Mbabazi in soroti and jinja where his supporters were attacked and dispersed with teargas by police; and therefore they cannot plead the legal immunity provided to them by the EC.
Nsubuga chose to go to the high court after he questioned the impartiality of the said officials who would sit and determine the complaint against them.
Presiding Judge Stephen Musota adjourned the case for further hearing on 14th this week

The NRM Electoral Commission Chairman, Tanga Odoi has dismissed media reports indicating that the party is dancing to the whims of it’s former secretary general, Amama Mbabazi to change registration fees and guidelines. Last thursday, Mbabazi failed to register for party flag bearer position citing illegalities in the fees and guidelines that have been set by the new party secretariat. While Odoi agrees that some changes have been made especially in regards to the set fines, he insists this was done after a review of many of the concerns raised by the different aspirants.
The party spokesperson Ofono Opondo has confirmed that both the former Vice president, Gilbert Bukenya and Premier Amama Mbabazi failed to turn up for quizzing before CEC but sent in their regrets requesting to honor the summons on the 23rd and 24th of this month respectively.

The Peoples Democratic Party (PDP) has asked the Attorney General of the Federation (AGF), Mallam Abubakar Malami and the chairman of the Independent National Electoral Commission (INEC), Prof. Mahmud Yakubu, to resign their positions.
According to the party, Malami misled the INEC into arriving at an “unconstitutional decision” to allow the All Progressives Congress (APC) to substitute its candidate in the inconclusive Kogi State governorship election.
Briefing journalists in Abuja on Tuesday, PDP’s National Publicity Secretary, Chief Olisa Metuh, said the party was shocked that INEC, a supposedly independent electoral umpire could succumb to the antics of the APC by following the “unlawful directive” of an obviously partisan AGF to substitute a candidate in the middle of the ballot process.
Metuh said, “We are all aware that the two legal documents guiding INEC in the conduct of elections; the Constitution and the Electoral Act, have provisions for electoral exigencies as well as empower the electoral body to fully take responsibility for any of its actions or inactions without undue interference from any quarters whatsoever.
“We are therefore at a loss as to which sections of these two relevant laws, INEC and the AGF relied on in arriving at their bizarre decision to substitute a dead candidate in an on-going election even after the timelines for such has elapsed under all the rules.

Kiggundu’s comments were in reaction to the circulation on social media of the image of a truck bearing voter education messages but that has been decorated with NRM posters and has been carrying supporters of the party’s presidential candidate Yoweri Museveni. Kiggundu spoke to the press at the Commission’s headquarters in Kampala.

The recently concluded NRM primaries were dogged with electoral violence, ballot stuffing and other forms electoral malpractices.
The party’s electoral commission is now grappling with petitions starting with LC1 to LCV, with losers challenging the manner in which the vote was held.
Commission chairperson Dr Tanga Odoi says all petitions will be cleared before the end of next week.
The Party assembled a team of 47 lawyers that is disposing off the petitions.
Some candidates have however lost patience with the pace at which the petitions are handled.

Nankabirwa competed against Zimulinda and a one Agnes Nambuyira.
The petition was due for hearing at 2:00pm but supporters could not hold back their anxiety.

President Muhammadu Buhari has said that election tribunals should go beyond cancelling and ordering rerun of an election to investigating and prosecuting those indicted for electoral offences.
The president said this at the State House Abuja while swearing in the Chairman of the Independent National Electoral Commission (INEC), Prof. Mahmood Yakubu, and five national commissioners of the commission.
Buhari said anyone found to have perpetrated electoral malpractice — whether they are individuals, candidates or party agents; institutions such as political parties or electoral body; or public officers like electoral staff and security agents — should be prosecuted.
He noted that it was high time the country's justice system addressed the shortcomings in the justice administration of the electoral tribunals.
He therefore directed that perpetrators of electoral violence and thuggery should not be spared, saying until the system stops covering up all forms of electoral malpractice, Nigeria could hardly get it right.
"It is long overdue that our justice system addresses these shortcomings. It is not just enough for an election to be cancelled and a new one ordered. It would be much better if all whose actions or inactions led to the cancellation of such election are investigated and if culpable prosecuted, whether they are individuals, candidates or party agents, institutions such as political party, electoral body, or public officers as electoral staff or security agents.
"Similarly, perpetrators of electoral violence and thuggery should not be spared. Unless our system stops covering up all forms of electoral malpractices we can hardly get it right. No system endures with impunity," he said.

This debate took place in the run-up to the November 2012 parliamentary elections in Sierra Leone as part of an evaluation of the impact of voter knowledge initiatives.
J-PAL affiliated professor Katherine Casey (Stanford Graduate School of Business), J-PAL Executive Director Rachel Glennerster, along with former J-PAL North America Senior Policy Manager Kelly Bidwell partnered with the civil society organization Search for Common Ground to evaluate how the dissemination of political information through debates impacted voter knowledge and behavior, campaign spending, and the performance of elected politicians. The study found that watching debates substantially increased political knowledge, policy alignment, and vote shares for higher-quality candidates. The debates also encouraged politicians to invest more in their constituencies, both during the campaign and one year later.
