Arbitrary Detention and Torture Widespread in Eastern Libya

I was pulled over after going through a yellow light. I was harassed for the smell of marijuana, I possess a real Health Canada LP license, current at the time of arrest and and still valid at this time. I was accused of not having a real license and was placed under (false) arrest, but given the order to put my hands behind my back before telling me I could place my prescription bottle and camcorder on the car, which made no sense to me. After getting out of my car with my hands up and also full, I was than assaulted, my head went back and hit my car leaving a dent as well as a side panel dent from my body, also a dent on my trunk from when he slammed my elbow into it. I was not resisting, when he threw me to the ground and than got on me, I was not going to go face first to the ground which is why he kept telling me to give him my hands when they were holding my upper body/head up while he tried to subdue me. I was falsely imprisoned and released with a promise to appear, which I was called back to give back and get back my medical marihuana after they realized they didn't have a clue what they were doing. They also asked for the promise to appear back but I never gave it to them. They forgot about the officer who called me a "faggot" while sitting cuffed in the back seat of the cruiser and told me we could settle it like men in the woods, said he'd take my cuffs off first, he also told me I had better learn to listen to police and stop bullshitting them, fucking idiots, they were bullshitting themselves! They don't apologize very well and I've been harassed by several other ignorant officers since than, also caught on video which I might upload later on, but this video is important because these bastards never pay for the shit they've done! I want justice. The doctor said I have a concussion, my arm is in extreme pain and I have neck and back pain and loss of memory. I cannot afford a lawyer and the Barrie Police are well protected in Ontario, meaning they can do whatever they fucking feel like but so can I, here's several videos I put together showing what happened to me. I had to get my car out of the tow the next morning. I hope this video goes viral, please share and let the city of Barrie and the world know that police corruption thrives in Hazzard County. FUCK THE POLICE! FILM THE POLICE!
This is compiled of several videos from my dash cam and at the end there is a couple from my cell phone. There are parts that jump from one scene to the next because the dash cam is motion detection, it stopped and started on it's own and I forgot to use a special feature to fade each clip in and out, sorry about that. I also have camcorder footage but not yet available as it is not yet on my computer.

A few weeks ago, a judge visited a prison in a city in the Islamic Republic of Iran, and spoke with some of the prisoners. Among them was a Baha’i who took the opportunity to inform him that when she became eligible for conditional release, she made a request in writing, but was subsequently told that it had been rejected by the Ministry of Intelligence. Asking to which authority she should now refer to regarding the future of her application, she was told by the judge that she is neither eligible for conditional release nor for furlough, because the public prosecutor is against it. “Whoever you write to,” he added “it will bounce and bounce and will come back to be placed in your case file.” And once again, when she asked what could be done, the judge gave a shocking response, unexpected when coming from a member of the judiciary. He simply said: “You have said yourself that you have nowhere to turn to. So you should quietly, peacefully, and silently finish your sentence and leave.”
Mr. President, the Baha’is in Iran are not only subject to arbitrary detention—since 2005, there have been over 820 of such arrests, which are in violation human rights norms—but throughout the judicial process they face an unjust treatment that clearly violates Iran’s own Penal and Criminal Procedure codes. Where is justice when a person – a law abiding citizen – is told by a judge – the very symbol of justice: “you have nowhere to turn to”?
The Baha’is in Iran ask for no special privilege, but only for their rights, and they hope that the international community and the High Commissioner for Human Rights will continue to put pressure on the government of the Islamic Republic of Iran to put an end to this manifestly unjust discrimination.

Arbitrary arrest and arbitrary detention are the arrest or detention of an individual in a case in which there is no likelihood or evidence that they committed a crime against legal statute, or in which there has been no proper due process of law.
Arbitrarily arresting or detaining persons contradicts rule of law established in democracies as well as habeas corpus and is thereafter illegal in those regimes. In practice in the 2000s (decade), arbitrary arrest or detention (the definitions of these terms vary between different national jurisdictions) is typically tolerated by the legal system for a short duration, of a few hours up to a few days, in most democracies, especially in response to political street demonstrations. It is often a characteristic of dictatorships or police states, which may also engage in forced disappearance.
Virtually all individuals who are arbitrarily arrested are given absolutely no explanation as to why they are being arrested, and they are not shown any arrest warrant.[2] Depending on the social context, many or the vast majority of arbitrarily arrested individuals may be held (people also get abused while in jail) incommunicado and their whereabouts can be concealed from their family, associates, the public population and open trial courts.[3][4] Many individuals who are arbitrarily arrested and detained suffer physical or psychological torture during interrogation, as well as extrajudicial punishment and other abuses in the hands of those detaining them.
Arbitrarily depriving an individual of their liberty is strictly prohibited by the United Nations' division for human rights. Article 9 of the 1948 Universal Declaration of Human Rights decrees that "no one shall be subjected to arbitrary arrest, detention or exile";[5] that is, no individual, regardless of circumstances, is to be deprived of their liberty or exiled from their country without having first committed an actual criminal offense against a legal statute, and the government cannot deprive an individual of their liberty without proper due process of law. As well, the International Covenant on Civil and Political Rights specifies the protection from arbitrary arrest and detention by the Article 9.

In Lebanon the prison population is exceeding almost three times the capacities of the detention facilities. Meanwhile, large number of detainees and prisoners could be immediately released if they avail adequate legal assistance.
Every year, CLDH provides lawyers for inmates who cannot afford it and this legal assistance allows dozens of persons to be released, thus safeguarding their fundamental rights.

Libya's internationally recognized government and its forces have carried out widespread arbitrary detentions and torture in prisons in the east of the country, Human Rights Watch said on Wednesday. The New York-based group said in January and April 2015 it gained rare access to detention facilities in al-Bayda and Benghazi controlled by the Libya Army and Justice and Interior ministries, and interviewed 73 detainees individually without guards present. According to Human Rights Watch, "Many detainees said that interrogators had forced them under torture to 'confess' to serious crimes." Detainees described other abuses, including lack of due process, scarce medical care, lack of notification of families about their detention, and poor conditions.

On February 1st, 2015 the engineer Tarek RABAA was set free after 4 years, 6 months and 20 days of arbitrary detention in Lebanese jails. Summoned to the ministry of defense on 12 July 2010, the 44 years old Lebanese engineer was subsequently detained. An arrest warrant was issued a month later on pretended charges of "collaborating with the enemy".
For over three months – until his transfer to Roumieh Prison on 26 October 2010 – Rabaa was repeatedly subjected to severe torture carried out with the aim of extracting confessions from him. At the time, he was, in fact, forced to sign official incriminating documents. He was then brought before a military court on 7 February 2011.
Moreover, Rabaa had always claimed his innocence. During his detention, he even carried out a hunger strike for more than two weeks demanding that he be freed or, at the very least, put under the protection of the law. Upon his release, he declared: "I am innocent and I will prove my innocence because there is neither evidence nor a confession of the charges against me."
While welcoming his liberation, Alkarama organization has called upon the Lebanese authorities to investigate all allegations of torture and to prosecute their perpetrators, as demanded by the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Lebanon is party since 2000....

Mohamed Nasheed, the first democratically-elected President of the Maldives, is currently serving a draconian prison sentence following an unfair trial on trumped-up terrorism charges. The lawfulness of his detention, which came as part of a widespread crackdown on democracy, human rights and the rule of law by the current Maldivian government, was challenged before the UN Working Group on Arbitrary Detention. Mr. Nasheed’s wife and legal counsel will comment on the Working Group’s ruling, which was made public on 5 October 2015, and explain why the former President should immediately be released from detention.

This Zoom tutorial with law students of the CQU School of Business and Law consists of two parts. The first part examines the concept of "matter" and judicial power. The second part looks at the limitations on governmental power to interfere with the rights and freedoms of Australians by looking at the constitutional basis of their rights and freedoms, even in the absence of a Bill of Rights. Using case problems, we explore the constitutional basis for the rights and freedoms of Australians, despite the absence of a Bill of Rights; the constitutional constraints on governmental powers to interfere with the rights and freedoms of Australians; the implied freedom of political communication and freedom from arbitrary detention; and
how and why an ex post facto law can be valid in Australia.

On the 27th of June, 2014, the UN Human Rights Council (HRC) established a Commission of Inquiry (COI) on Eritrea to investigate and officially document the alleged systematic violations of human rights in Eritrea. The COI will collect testimonies from victims, victim’s families, and witnesses in the Diaspora to document their suffering and to allow their stories to be heard in the hopes of obtaining justice for these victims, both alive and deceased. The COI has until June 2015 to collect this information and present its findings to the HRC at its 29th Session.
This video is an interview conducted by Human Rights Concern-Eritrea (HRCE) with Lemma Adhanom who in 1994 was conscripted into 1st round of the so called Eritrea National Service. He was later remobilized and fought in the bloody 1998-2000 border war between Eritrea and Ethiopia.
He reflects on the things he witnessed during the war and after; including extrajudicial execution, torture, arbitrary detention, inhumane treatments and wide spread rape of female conscripts by high ranking officers which continues til this day.
Lemma was imprisoned when he tried to air his opinion and eventually decided to flee Eritrea when his life was threatened.
This is his Story...

This decision by the HRC is aimed at exposing and holding those in Eritrea responsible for the rampant and horrific human rights violations committed since 1993. The COI has until June 2015 to collect this information and present its findings to the HRC at its 29th Session
On September 26, 2014, the President of the UN Human Rights Council appointed Mike Smith (Australia) and Victor Dankwa (Ghana) to serve in the Commission of Inquiry, together with Sheila Keetharuth (Mauritius), the council’s special rapporteur on human rights in Eritrea.
Listed below are some of the human rights violations that the International Criminal Court deems as possible ‘crimes against humanity’. Anyone that has experienced or witnessed any of these or other forms of violations by the regime in Eritrea is urged to come forward and provide their testimony. Please note, testimonies to the UN Commissioners can be given in public or private. As with all cases handled by Human Rights Concern Eritera (HRC-E), extensive support and guidance will be provided.
