In October of 2014, we gave a group of Harvard students a test. But it was not just any test. It was the 1964 Louisiana Literacy Test. Exactly 50 years ago, states in the American South issued this exact test to any voter who could not “prove a fifth grade education.” Unsurprisingly, the only people who ever saw this test were blacks and, to a lesser extent, poor whites trying to vote in the South. In order to pass, voters needed to answer all 30 questions correctly in 10 minutes. Just one question wrong was grounds for disenfranchisement.
Since this test, in principle, was equivalent to proving a fifth grade education, we thought it might be interesting to see if some of the brightest young minds in the world could pass this literacy test. We did our best to recreate the testing conditions that black and poor white voters faced back in 1964. Thirty questions. Ten minutes. Not a single question wrong. If anyone could pass a basic literacy test, it would be Harvard students right?
Wrong. None of them passed the test. None of them passed the test because no one can pass the test. You see, Louisiana’s literacy test was designed to be failed. Just like all the other literacy tests issued in the South at the time, this test was not about testing literacy at all. It was a legitimate sounding, but devious measure that the State of Louisiana used to disenfranchise people that had the wrong skin tone or belonged to the wrong social class. Most of the test’s questions are purposely ambiguous. No matter what was written down, the registrar official would simply say the person’s interpretation of the question was wrong. And just like that, countless black and poor white voters in the South were disenfranchised.

Awards for his work include the AAAS Prize for the best article in the behavioral sciences, the Association of American Publishers Prize for the best book in the social and behavioral sciences, the German Psychology Award, and the Communicator Award of the German Research Foundation.

"In recent years, conservatives seeking to suppress voter turnout have typically favored voter ID legislation, which disproportionately harms minority groups, but the co-hosts of “Fox & Friends” have another idea: bring back poll tests.
Discussing a proposal that would require North Dakota students to correctly answer 60 out of 100 questions on a civics test in order to graduate from high school, the program’s Steve Doocy lamented that teens graduate from high school not knowing “squat” about American history. But Doocy wouldn’t stop at testing high school students.
“I think not only would it be great if high school students had to have a proficiency in America,” Doocy said, “but I think they should have a test before you vote.”

Rates of literacy in the United States depend on which of the various definitions of literacy is used. Governments may label individuals who can read a couple of thousand simple words they learned by sight in the first four grades in school as literate. Other sources may term such individuals functionally illiterate if they are unable to use basic sources of written information like warning labels and driving directions. The World Factbook prepared by the CIA defines literacy in the United States as "age 15 and over can read and write." The literacy rates are not completely measurable.

Hedges v. Obama is a lawsuit filed January 13, 2012 against the Obama Administration and Members of the U.S. Congress by a group including former New York Times reporter and current Truthdig columnist Christopher Hedges challenging the National Defense Authorization Act for Fiscal Year 2012 (NDAA) which permits the U.S. government to indefinitely detain people who are part of or substantially support Al Qaeda, the Taliban or associated forces engaged in hostilities against the United States.
The plaintiffs contend that Section 1021(b)(2) of the law allows for detention of citizens and permanent residents taken into custody in the U.S. on "suspicion of providing substantial support" to groups engaged in hostilities against the U.S. such as al-Qaeda and the Taliban[4] respectively that the NDAA arms the U.S. military with the ability to imprison indefinitely journalists, activists and human-rights workers based on vague allegations.[6]
The principal allegation made by the plaintiffs against the NDAA is that the vagueness of critical terms in the NDAA could be interpreted by the U.S. federal government in a way that authorizes them to label journalists and political activists who interview or support outspoken critics of the Obama administration's policies as "covered persons," meaning that they have given "substantial support" to terrorists or other "associated groups".[7]
A federal court in New York has issued a permanent injunction blocking the indefinite detention powers of the NDAA but the injunction was stayed by the Second Circuit Court of Appeals pending appeal by the Obama Administration.
The group of journalists, activists, and academics, as well as a member of Iceland's parliament around Christopher Hedges filed an application, a so-called "Emergent Application to Vacate Temporary Stay of Permanent Injunction"[143] (docket 12A600,[144] with the U.S. Supreme Court on December 12, 2012. With the application the group asked the Supreme Court to lift the stay pending appeal order issued by the U.S. Second Circuit Court of Appeals on October 12, 2012 and thus to put back into effect District Judge Forrest's order from September 12, 2012 which permanently enjoined enforcement of § 1021(b)(2) of the National Defense Authorization Act for Fiscal Year 2012. The new application was filed with Justice Ruth Bader Ginsburg, who handles such emergency matters from the Second Circuit geographic area. She has the authority to decide the issue on her own, or sh

The US Dеpartment of Education, Institute of Education Sciences has conducted large scale assessment of adult proficiency in 1992 and 2003 using a common methodology from which trends could be measured. The study measures Prose, Document, and Quantitative skills and 19,000 subjects participated in the 2003 survey. There was no significant change in Prose or Document skills and a slight increase in Quantitative attributes. As in 2008, roughly 15% of the sample could function at the highest levels in all three categories. Roughly 40% were at either basic or below basic levels of proficiency in all three categories.[2] The study identifies a class of adults who, although not meeting criteria for functional illiteracy, face reduced job opportunities and life prospects due to inadequate literacy levels relative to the requirements of contemporary society.
The study, the most comprehensive study of literacy ever commissioned by the U.S. government, was released in April 2002 and reapplied in 2003 giving trend data. It involved lengthy interviews of over 90,700 adults statistically balanced for age, gender, ethnicity, education level, and location (urban, suburban, or rural) in 12 states across the U.S. and was designed to represent the U.S. population as a whole. This government study showed that 21% to 23% of adult Americans were not "able to locate information in text", could not "make low-level inferences using printed materials", and were unable to "integrate easily identifiable pieces of information." Further, this study showed that 41% to 44% of U.S. adults in the lowest level on the literacy scale (literacy rate of 35 or below) were living in poverty.[2]
A follow-up study by the same group of researchers using a smaller database (19,714 interviewees) was released in 2006 that showed some upward movement of low end (basic and below to intermediate) in U.S. adult literacy levels and a decline in the full proficiency group.[3]
Thus, if this bottom quantile of the study is equated with the functionally illiterate, and these are then removed from those classified as literate, then the resultant literacy rate for the United States would be at most 65-85% depending on where in the basic, minimal competence quantile one sets the cutoff.
The 15% figure for full literacy, equivalent to a university undergraduate level, is consistent with the notion that the "average" American reads at a 7th or 8th grade level which is also consistent with recommendations, guidelines, and norms of readability for medication directions, product information, and popular fiction.
Jonathan Kozol, in his book Illiterate America, suggests that the very high figures of literacy may be due to poor methodology.[6] The Census Bureau reported literacy rates of 86% based on personal interviews of a relatively small portion of the population and on written responses to Census Bureau mailings. They also considered individuals literate if they simply stated that they could read and write, and made the assumption that anyone with a fifth grade education had at least an 80% chance of being literate. Kozol notes that, in addition to these weaknesses, the reliance on written forms would have obviously excluded many individuals who did not have a literate family member to fill out the form for them. Finally, he suggests that because illiterate people are likely to be unemployed and may not have telephones or permanent addresses, the census bureau would have been unlikely to find them (and that if they did, these people might be especially reluctant to talk to a stranger who might be a bill collector, tax auditor, or salesperson).
