Civil Rights & Liberties: Crash Course Government #23
Today, Craig is going to give you an overview of civil rights and civil liberties. Often these terms are used interchangeably, but they are actually very different. Our civil liberties, contained in the Bill of Rights, once only protected us from the federal government, but slowly these liberties have been incorporated to protect us from the states. We’ll take a look at how this has happened and the supreme court cases that got us here.

The Founding Fathers warned of a Federal Government bent on usurping the power, rights and privacy of its states and citizens. The list of federal overreach is alarming: a proposed National ID Card, establishing secret courts and utilizing warrantless searches, and betraying the medical privacy of ordinary citizens. We must defend our 4th Amendment rights. The Federal Government has overstepped its limited powers.
I thoroughly believe that America can prosper, preserve personal liberty, and repel national security threats without intruding into the personal lives of its citizens.

Despite being engaged in the perfectly legal activity of taking photographs out in public, the reactions from the two sheriff’s departments varied greatly. With one sheriff’s department solidly respecting our civil liberties and the other resorting to an illegal search, an illegal detainment as well as illegally running our tag through the Driver And Vehicle Information Database.

Well he is a liar and can not be trusted. Its a shame you can't trust the police any more. Just as Dzhokhar Tsarnaev faces the beginning of his trial for the bombing of the Boston Marathon, Paris shakes from the assassination of French magazine satirists. “A New Era of Terrorism” has commenced, according to The New York Times. Governments emit loose talk of “fundamental values.” Patriotic slogans such as “Boston Strong” paper over global anxiety, as everyone prepares for further massacres and retributions. Welcome to the new world order.
In this light, The Baffler magazine sponsored a neighborhood forum on the war on terror and the rule of law. Noam Chomsky, author of 9/11, and Kade Crockford, director of the ACLU of Massachusetts’ Technology for Liberty Project, for a discussion moderated by Baffler editor John Summers in the heart of Inman Square—the very neighborhood in which Dzhokhar and his alleged co-conspirator and older brother, Tamerlan Tsarnaev, lived, worked, shopped, and worshipped among us.

I first went to the Colonie Police station to do a 1st amendment test. On the surface they did great Sgt. Dinuzzo came out and said its fine film, and even asked if I needed anything. Well he is a liar and can not be trusted. Its a shame you can't trust the police any more. In the second half of the video I happen to come across 2 patrol cars going into Price Chopper and I stopped to see what was going on. While advising the occupants in the car of their rights Officer Matthew R. Overocker steps in to make sure they don't know their rights and thinks that it's not my place to tell them. Now they violated the 4th amendment on the passengers in the car through intimidation. And at the same time Sgt. Dinuzzo orders Officer Nicholas R. Morgan to run my plate. Now they knew who I was but they wanted to intimidate me and hope that my motorcycle was missing something, too bad for them I am all good. Police at their finest, intimidation, rights violations and un-trust worthiness. After the police left I had a chance to speak with the people in the car and the driver told me that the police said I called in the complaint on them. They can't help but lie. My guess is they didn't want me to talk with them. While sitting and talking Colonie PD kept circling the parking lot and sitting near by watching us. Just more intimidation on their part. This tells me the stories I have heard about Colonie PD is true and I need to keep a better eye on them.

American Civil Liberties Union sues two psychologists over role in CIA's torture program
The American Civil Liberties Union has sued two psychologists over their role in the torture of detainees in CIA-run prisons following the September 11 attacks.
The ACLU says former military psychologists James Mitchell and Bruce Jessen designed the torture methods and performed illegal human experimentation on prisoners. A 2014 US Senate report said the CIA paid 80 million dollars to the Mitchell Jessen and Associates company, which recommended waterboarding, cramped confinement, sleep deprivation and mock burial for prisoners. The ACLU says Mitchell and Jessen personally took part in torture sessions and oversaw the program's implementation

The ACLU says Mitchell and Jessen personally took part in torture sessions and oversaw the program's implementation. The ACLU’s lawsuit has been filed on behalf of three prisoners. Two of the victims suffered lasting psychological and physical damage while the third died due to dehydration and exposure to cold. The lawsuit said the psychologists were legally responsible for war crimes including torture and non-consensual medical and scientific human experimentation.

Speaker(s): Shami Chakrabarti
Chair: Professor Conor Gearty
Recorded on 6 October 2015 at Old Theatre, Old Building
To mark the paperback release of On Liberty, Shami Chakrabarti will be in conversation with Conor Gearty and taking questions from the audience and Twitter. You can send your questions via Twitter to @LSELaw using #LSEShami.
In On Liberty Shami explores why our fundamental rights and freedoms are paramount in upholding democracy, and how they are coming under unprecedented pressure today. Since 9/11 governments have decided that human and civil rights, and the rule of law, are often too costly, and have offered an apparently simple trade-off: greater security in exchange for less freedom.
Drawing on her own life and work, and on Liberty’s campaigning on issues including privacy, 42 day detention and ASBOs, Shami shows why our rights are indispensable and looks to the future. These freedoms, for which generations have fought, both protect and empower us, and curb the power of the mighty – and what’s more, Shami warns, once gone, they will be almost impossible to recover.
Shami Chakrabarti is Director of the civil liberties advocacy organisation Liberty. She was a member of the panel of the Leveson Inquiry and is Chancellor of Oxford Brookes University and an alumna of LSE.
Conor Gearty (@conorgearty) is Director of the Institute of Public Affairs and Professor of Human Rights Law at LSE.
LSE Law (@lselaw) is an integral part of the School's mission, plays a major role in policy debates & in the education of lawyers and law teachers from around the world.

KURT OPSAHL is the Deputy General Counsel of the Electronic Frontier Foundation focusing on civil liberties, free speech and privacy law. Opsahl has counseled numerous computer security researchers on their rights to conduct and discuss research. Before joining EFF, Opsahl worked at Perkins Coie, where he represented technology clients with respect to intellectual property, privacy, defamation, and other online liability matters, including working on Kelly v. Arribasoft, MGM v. Grokster and CoStar v. LoopNet. Prior to Perkins, Opsahl was a research fellow to Professor Pamela Samuelson at the U.C. Berkeley School of Information Management & Systems. Opsahl received his law degree from Boalt Hall, and undergraduate degree from U.C. Santa Cruz. Opsahl co-authored "Electronic Media and Privacy Law Handbook.” In 2007, Opsahl was named as one of the “Attorneys of the Year” by California Lawyer magazine for his work on the O'Grady v. Superior Court appeal, which established the reporter’s privilege for online journalists. In addition to his work at EFF, Opsahl is a member of the USENIX Board of Directors.
NATE CARDOZO is a Staff Attorney on the Electronic Frontier Foundation’s digital civil liberties team. In addition to his focus on free speech and privacy litigation, Nate works on EFF's Who Has Your Back? report and Coders' Rights Project. Nate has projects involving automotive privacy, government transparency, hardware hacking rights, anonymous speech, electronic privacy law reform, Freedom of Information Act litigation, and resisting the expansion of the surveillance state. A 2009-2010 EFF Open Government Legal Fellow, Nate spent two years in private practice before returning to his senses and to EFF in 2012. Nate has a B.A. in Anthropology and Politics from U.C. Santa Cruz and a J.D. from U.C. Hastings where he has taught first-year legal writing and moot court.
EVA GALPERIN is EFFs Global Policy Analyst, and has been instrumental in highlighting government malware designed to spy upon activists around the world. A lifelong geek, Eva misspent her youth working as a Systems Administrator all over Silicon Valley. Since then, she has seen the error of her ways and earned degrees in Political Science and International Relations from SFSU. She comes to EFF from the US-China Policy Institute, where she researched Chinese energy policy, helped to organize conferences, and attempted to make use of her rudimentary Mandarin skills.
MARK JAYCOX is a Legislative Analyst for EFF. His issues include user privacy, civil liberties, surveillance law, and "cybersecurity." When not reading legal or legislative documents, Mark can be found reading non-legal and legislative documents, exploring the Bay Area, and riding his bike. He was educated at Reed College, spent a year abroad at the University of Oxford (Wadham College), and concentrated in Political History. The intersection of his concentration with advancing technologies and the law was prevalent throughout his education, and Mark's excited to apply these passions to EFF. Previous to joining EFF, Mark was a Contributor to ArsTechnica, and a Legislative Research Assistant for LexisNexis.
YAN ZHU is a Staff Technologist with EFF. Yan writes code and words to enable pervasive encryption and protect Internet users' privacy. The Supreme Court’s hearings on gay marriage made national headlines in April, and the verdict they give this month could change the state of civil liberties. Steve Shapiro, national ACLU legal director, discusses this and other ongoing, vital cases moving through the higher courts. In addition to tackling the topic of extending the right for lesbians and gays to marry, he’ll discuss reining in government surveillance, countering the Hobby Lobby decision, protecting voting rights, and tackling injustice in the criminal system.
