Britain's highest court to hear Malaysia massacre case
April 22, 2015
A judicial review into the killing by British troops of 24 unarmed Malayan villagers could have far-reaching consequences for Britain, dredging up the country’s substantial backlog of violent colonial excesses.
The review will take place Wednesday at the Supreme Court in London and will also be attended by survivors and relatives of those killed by the Scots Guards in the village of Batang Kali in December 1948.
Two previous criminal investigations are said to have been blocked by uncooperative UK authorities, despite claims made in 1969 by a number of the guardsmen present on the day that they had been ordered to massacre the villagers.
“The bullets that killed half the inhabitants of Batang Kali can never return to their barrels and the time has long since passed when any soldiers who fired them might be prosecuted,” solicitor for the survivors, John Halford, told the Guardian.
“But when six of them have confessed to murder, eyewitnesses remain alive and forensic tests can confirm the killings were close-range executions, the law should demand an answer from the state. After all, those killed were British subjects living in a British protected state.
“They and their families have a right to meaningful justice.”
The UK government maintains that the case is too old to be worth digging into.
The Foreign Office has repeatedly said the case is not worth pursuing.
“It is very unlikely that a public inquiry could come up with recommendations which would help to prevent any recurrence,” it said.
“This was a deeply regrettable incident. The case will be heard in the Supreme Court on 22 and 23 April. It would not be appropriate to comment further whilst legal proceedings are ongoing,” the Ministry of Defence declared in a statement.
Crucially, the case could set an important precedent which has the potential to crack open the legal fortifications that the UK government has erected, over many years, in defense of its colonial past – most strikingly in Northern Ireland.
A number of UK legal and human rights NGO’s have high hopes for the case.

“The outcome of this case will have considerable implications in Northern Ireland, where many of the deaths that occurred during the Troubles happened before the enactment of the Human Rights Act in 1998,” Rights Watch UK director Yasmine Ahmed told the Guardian.
“Dealing with the past, whether through inquests or investigations, continues to be a battleground where the UK government seeks to deny families the right to truth,” Sara Duddy from the Derry-based Pat Finucane Centre, which promotes human rights and social change, told the paper
“The Batang Kali massacre is proof that the past will always come back to haunt us if it isn’t dealt with.”

The sinking of Prince of Wales and Repulse was a Second World War naval engagement that took place north of Singapore, off the east coast of Malaya, near Kuantan, Pahang, where the British Royal Navy battleship HMS Prince of Wales and battlecruiser HMS Repulse were sunk by land-based bombers and torpedo bombers of the Imperial Japanese Navy on 10 December 1941. In Japanese, the engagement was referred to as the Naval Battle off Malaya.

After 18 months fighting terrorists in the Malayan jungle, the 2nd Nyasaland Battalion of the King's African Rifles are home once again. It was blanco time for the men taking part in the homecoming Ceremonial Parade. This took place at Lusaka, when His Excellency the Governor-General officiated. During the Parade, the Military Medal was presented to Corporal Edward Morris, who shot a terrorist and captured a notorious Communist leader. A fall of rain marred the ceremony.

The Ruler, Tuanku Syed Putra, formerly the Raja of Perlis, received a royal salute from the Police Guard of Honour when he arrived for his installation. Already in the Tuanku Abdul Rahman Hall, important people from all parts of the Federation of Malaya had assembled, when Their Majesties entered in stately procession. The proclamation was read by the Prime Minister, Tuanku Abdul Rahman. Then, the Grand Chamberlain presented the golden Kris of State, symbol of power and authority, to the new ruler, the third Sovereign of the Federation, since it became independent.

The Ruler, Tuanku Syed Putra, formerly the Raja of Perlis, received a royal salute from the Police Guard of Honour when he arrived for his installation. Already in the Tuanku Abdul Rahman Hall, important people from all parts of the Federation of Malaya had assembled, when Their Majesties entered in stately procession. The proclamation was read by the Prime Minister, Tuanku Abdul Rahman. Then, the Grand Chamberlain presented the golden Kris of State, symbol of power and authority, to the new ruler, the third Sovereign of the Federation, since it became independent.

The attack was intended as a preventive action in order to keep the U.S. Pacific Fleet from interfering with military actions the Empire of Japan was planning in Southeast Asia against overseas territories of the United Kingdom, the Netherlands, and the United States. There were simultaneous Japanese attacks on the U.S.-held Philippines and on the British Empire in Malaya, Singapore, and Hong Kong.
From the standpoint of the defenders, the attack commenced at 7:48 a.m. Hawaiian Time. The base was attacked by 353 Japanese fighter planes, bombers, and torpedo planes in two waves, launched from six aircraft carriers. All eight U.S. Navy battleships were damaged, with four being sunk. All but one (Arizona) were later raised, and six of the eight battleships were returned to service and went on to fight in the war. The Japanese also sank or damaged three cruisers, three destroyers, an anti-aircraft training ship, and one minelayer. 188 U.S. aircraft were destroyed; 2,403 Americans were killed and 1,178 others were wounded. Important base installations such as the power station, shipyard, maintenance, and fuel and torpedo storage facilities, as well as the submarine piers and headquarters building (also home of the intelligence section) were not attacked. Japanese losses were light: 29 aircraft and five midget submarines lost, and 65 servicemen killed or wounded. One Japanese sailor, Kazuo Sakamaki, was captured.
The attack came as a profound shock to the American people and led directly to the American entry into World War II in both the Pacific and European theaters. The following day, December 8, the United States declared war on Japan. Domestic support for non-interventionism, which had been strong, disappeared. Clandestine support of Britain (e.g., the Neutrality Patrol) was replaced by active alliance. Subsequent operations by the U.S. prompted Germany and Italy to declare war on the U.S. on December 11, which was reciprocated by the U.S. the same day.
Years later several writers alleged that parties high in the U.S. and British governments knew of the attack in advance and may have let it happen (or even encouraged it) with the aim of bringing America into war. However, this advance-knowledge conspiracy theory is rejected by mainstream historians.
There were numerous historical precedents for unannounced military action by Japan. However, the lack of any formal warning, particularly while negotiations were still apparently ongoing, led President Franklin D. Roosevelt to proclaim December 7, 1941, "a date which will live in infamy". In order to control the epidemic, the British Malaya Government established Sungai Buloh Leprosy Settlement for the segregation and treatment of those with the disease. The settlement was a self-supporting community, and it soon became "home" for the patients. They were promised free therapy for life, and the then government consented to let them reside permanently in the settlement. However, in late 2007, development encroached upon the settlement, and disturbed the tranquil lives of the elderly residents there. The stories of the residents are recorded in this documentary, revealing how their lives and the fate of the settlement are interwoven......

While the United States was still struggling to emerge from the Great Depression at the end of the 1930s, and would do so partly because of the war, Japan had emerged from its own period of depression, which had begun in 1926, by the mid-1930s. Many of the young soldiers mobilized into the Japanese army by the early 1930s came from the rural areas, where the effects of the depression were devastating and poverty was widespread. Their commitment to the military effort to expand Japanese territory to achieve economic security can be understood partly in these terms. The depression ended in the mid-1930s in Japan partly because of government deficits used to expand greatly both heavy industry and the military.
Internationally, this was a time when "free trade" was in disrepute. The great powers not only jealously protected their special economic rights within their colonies and spheres of influence, but sought to bolster their sagging economies through high tariffs, dumping of goods, and other trade manipulation. The Japanese, with few natural resources, sought to copy this pattern. They used cutthroat trade practices to sell textiles and other light industrial goods in the East Asian and U.S. markets, severely undercutting British and European manufacturers. They also developed sources of raw materials and heavy industry in the colonies they established in Korea, Taiwan and Manchuria. Japan used high tariffs to limit imports of American and European industrial products.
The Japanese military faced a particular tactical problem in that certain critical raw materials — especially oil and rubber — were not available within the Japanese sphere of influence. Instead, Japan received most of its oil from the United States and rubber from British Malaya, the very two Western nations trying to restrict Japan's expansion. U.S. President Franklin D. Roosevelt's embargo of oil exports to Japan pressured the Japanese navy, which had stocks for only about six months of operations.
The Japanese army, for its part, was originally concerned with fighting the Soviet Union, because of the army's preoccupation with Manchuria and China. The Japanese army governed Manchuria indirectly through the "puppet" state of Manchukuo and developed heavy industry there under its favorite agencies, disliking and distrusting the zaibatsu (large Japanese corporations). But the Soviet army's resistance to Japanese attacks was sufficient to discourage northern expansion.
Meanwhile in 1937, the intensification of Chinese resistance to the pressure of the Japanese military drew Japan into a draining war in the vast reaches of China proper, and in 1940 into operations in French Indochina, far to the south. Thus, when the navy pressed for a "southern" strategy of attacking Dutch Indonesia to get its oil and British Malaya to control its rubber, the army agreed.
While it seems that economic factors were important in Japanese expansion in East Asia, it would be too much to say that colonialism, trade protection, and the American embargo compelled Japan to take this course. Domestic politics, ideology and racism also played a role.
Domestic Politics
The political structure of Japan at this time was inherited from the Meiji era and was increasingly dominated by the military. During the Meiji period, the government was controlled by a small ruling group of elder statesmen who had overthrown the shogun and established the new centralized Japanese state. These men used their position to coordinate the bureaucracy, the military, the parliament, the Imperial Household, and other branches of government. Following their deaths in the early 1920s, no single governmental institution was able to establish full control, until the 1931 Manchurian Incident, when Japan took control of Manchuria. This began a process in which the military behaved autonomously on the Asian mainland and with increasing authority in politics at home.
From 1937 on, Japan was at war with China. By the time General Hideki Tôjô became prime minister and the war against the United States began in 1941, the nation was in a state of "total war" and the military and their supporters were able to force their policies on the government and the people. The wartime regime used existing government controls on public opinion, including schools and textbooks, the media, and the police, but Japan continued to have more of an authoritarian government than a totalitarian one like Hitler's Germany. In particular, the government was never able to gain real control of the economy and the great zaibatsu, which were more interested in the economic opportunities provided by the military's policies than in submitting loyally to a patriotic mission.
