This book analyzes how the Appellate Body uses particular principles of general international law in interpreting the WTO covered agreements. It deals equally with general international law and WTO law. The aim is to explain how the Appellate Body interprets and applies customary international law on treaty interpretation in dealing with the WTO covered agreements. The main concern is to analyze the judicial reasoning and ways of justifying judicial decision-making. In particular, it answers the question of how the Appellate Body explains its reading of WTO treaty language. It is argued that the Appellate Body has interpreted the WTO covered agreements in a contextual and effective manner, an approach that corresponds with general international law. The character of the WTO covered agreements has, nevertheless, confronted the Appellate Body with some questions of interpretation that were until recently unexplored or neglected by other courts and tribunals. In that sense, the Appellate Body has contributed to the development of general international law on treaty interpretation, or at least to its practice. WTO law is primarily treaty law, but increasingly soft law and broader themes and values from other disciplines, such as governance, variable geometry and legitimacy, are introduced and discussed. Customary international law - with the exception of the principles of treaty interpretation - and general principles of law are often seen as excluded entirely. An ancillary theme of this proposed monograph is the extent to which customary international law and general principles of law have penetrated WTO law through the technique of treaty interpretation.

This event will introduce the recent WTO Appellate Body report on India – Agricultural Products (DS430). In this dispute, the United States challenged the prohibitions imposed by India on the importation of various agricultural products from the United States purportedly because of concerns related to Avian Influenza (AI). A WTO panel ruled against India in some respects and India appealed several aspects of the panel’s findings. The Appellate body largely upheld the panel’s findings. The Appellate Body affirmed, among others the panel’s finding that India’s AI measures are not based on or conform to relevant international standards, are not based on risk assessment, arbitrarily and unjustifiably discriminate between Members where identical or similar conditions prevail, are significantly more trade restrictive than required to achieve India’s appropriate level of protection. The Appellate Body also upheld the panel’s finding that India failed to adapt its AI measures to regional sanitary and phytosanitary characteristics.
Talking Disputes is designed to allow for the discussion of specific WTO disputes by experts and interested professionals from relevant fields. One or two experts present key aspects of the case, setting the stage for a targeted discussion, and designated discussants provide substantive comments.

The Income Tax Act, 1961 specifies that any lease transaction for not less than 12 years or any sale transaction, above a prescribed transaction value limit tax, has to undergo a clearance process from the appellate body known as the Income Tax Appropriate Authority, constituted under the Income Tax Act. A joint application by the parties involved in the transaction is submitted along with processing fees to the Income Tax Authority, which takes upto a maximum of three months to grant the clearance, without which the sale transaction is not complete. This procedure is popularly known as the 37-(I) clearance, which is the application form number used for this purpose.

Appointed by President Clinton, Judge Baker currently serves on the U.S. Court of Appeals for the Armed Forces, which is an appellate body composed of five civilian judges that handles cases arising under the Uniform Code of Military Justice. He has been involved in decision-making processes regarding international law, armed conflict, security and intelligence throughout his career and has consulted on decisions regarding military actions in Somalia, Haiti, Bosnia, Kosovo, Iraq and to combat Al-Qaeda and other terrorist groups. He is considered to be one of the country’s finest national security scholars and is known for pursuing a philosophy of national security policy and process that is carefully crafted within the confines of the established laws that govern them.
Judge Baker attended Yale University as an undergraduate, served in the Marine Corps as an infantry officer and graduated from Yale Law School in 1990. He was a legislative aide to Senator Daniel Patrick Moynihan and went on to serve in a variety of important civil service capacities including appointments to the U. S. Department of State, the National Security Council, the Council to the President’s Foreign Intelligence Advisory and Intelligence Oversight Boards, and as Special Assistant to the President and Legal Advisor to the National Security Council.
He is the author of In the Common Defense: National Security Law for Perilous Times (a text widely used in the study of the subject), and, with Michael Reisman, Regulating Covert Action. Judge Baker is the recipient of the 1999 Colonel Nelson Drew Memorial Award (the NSC’s highest honor) and the Director of Central Intelligence's "Director's Award." He is also the great-grandson of John Henry Twachtman and a grand-nephew of WWI veteran J. Alden Twachtman, both formers members of the Cos Cob art colony.

This is a list of women on death row in the United States. The number of death row inmates fluctuates daily with new convictions, appellate decisions, sentence commutations, deaths (through execution or otherwise), and exonerations. Due to this fluctuation as well as lag and inconsistencies in inmate reporting procedures across jurisdictions, the information in this article may be out of date. The time on death row counter starts on the day they were first placed on death row. It does not count time incarcerated prior to sentencing nor does it discount time spent in prison off of death row in cases where death sentences were overturned before being reinstated.
Lisa M. Montgomery was convicted of the 2004 murder of Bobbie Jo Stinnett. Montgomery killed the pregnant Stinnett before delivering and kidnapping Stinnett's unborn baby.
Noted neuroscientist VS Ramachandran testified that Montgomery suffered from severe pseudocyesis delusion. Ramachandran testified that childhood sexual abuse and post-traumatic stress disorder predisposed her to pseudocyesis, a mental condition that causes a woman to falsely believe she is pregnant and exhibit outward signs of pregnancy. Ramachandran stated that Montgomery was suffering from a severe mental disease or defect when she committed the crime and that she was unable to appreciate the nature and quality of her acts. Federal prosecutor Roseann Ketchmark characterized Ramachandran's theory linking the murder/kidnapping to pseudocyesis as "voodoo science."

Figueroa was found to have been substantially abused and neglected over a long period of time before being killed with a baseball bat. Figueroa's body was found dumped behind the hedge of a Miami Beach home. He went unidentified for some time and became known in the media as "baby lollipops" due to the graphic on a T-shirt he was wearing.
The defense alleged that Cardona's partner, Olivia Gonzalez, was responsible. They appealed the conviction on the basis that the prosecution failed to disclose a number of inconsistent statements made by Gonzalez, who testified against Cardona at the trial. At trial, the defense was also precluded from questioning witnesses about an incident in which Gonzalez confessed to the crime. Gonzalez was judged to be deceptive on a number of questions during a polygraph, including questions regarding whether or not she struck him with a baseball bat in the two weeks prior to his death. When confronted with this information, she admitted hitting him with a bat on that day and stated that he could have died from the blow. The jury was not aware of this confession

The NLRB is governed by a five-person board and a General Counsel, all of whom are appointed by the President with the consent of the Senate. Board members are appointed to five-year terms and the General Counsel is appointed to a four-year term. The General Counsel acts as a prosecutor and the Board acts as an appellate judicial body from decisions of administrative law judges. As of 2013, the NLRB is headquartered at 1099 14th Street NW, Washington, D.C with over 30 regional, sub-regional, and residential offices throughout the U.S. In April 2009, President Obama nominated Craig Becker (Associate General Counsel of the Service Employees International Union), Mark Gaston Pearce (a member on the Industrial Board of Appeals, an agency of the New York State Department of Labor), and Brian Hayes (Republican Labor Policy Director for the Senate Committee on Health, Education, Labor and Pensions) to fill the three empty seats on the NLRB.[75] Becker's nomination appeared to fail on February 8, 2010, after Republican Senators (led by John McCain) threatened to filibuster his nomination.[77][84] President Obama said he would consider making recess appointments to the NLRB due to the Senate's failure to move on any of the three nominations.[84] On March 27, 2010 Obama recess appointed Becker and Pearce.[85] On June 22, 2010, a voice vote in the Senate confirmed Pearce to a full term, allowing him to serve until August 27, 2013.
