A marijuana joint found next to a slain Boston man in North Attleborough contained traces of both his DNA and the DNA of former New England Patriots star Aaron Hernandez, a Bristol County prosecutor said Thursday in an opening statement in Hernandez’s murder trial. A footprint at the murder scene in an industrial park also matched sneakers worn by Hernandez, and Hernandez’s DNA was found on a .45-caliber shell casing found in a car he had rented, Bristol County Assistant District Attorney Patrick Bomberg said. http://democracynow.org - Today marks the 1,000th day WikiLeaks founder Julian Assange has spent in political asylum inside Ecuador's London embassy. For the first time, Swedish prosecutors have opened the door to Assange's departure with a request to question him in London. Assange has never been charged over allegations of sexual assault, but has been holed up in the embassy since 2012, fearing a Swedish arrest warrant could lead to his extradition to the United States. We speak with one of Assange's lawyers, Michael Ratner, who argues the alleged sexual assault case is not strong enough to go forward. Prosecutors in the "American Sniper" murder trial say defendant Eddie Ray Routh was faking inanity. CNN's Ed Lavandera reports.
And now to the updates on the ongoing criminal probe on last week′s Germanwings crash. Prosecutors in Germany... say they′ve found records of web searches on suicide and cockpit doors... on a tablet computer... belonging to co-pilot Andreas Lubitz. Take a listen. ″According to the results, the user informed himself about medical treatments as well as different kinds of and the implementation of a suicide. On at least one day, he had searched for several minutes about cockpit doors and their safety precautions.″ Investigators believe the 27-year-old had used the device between March 16th and March 23rd... before crashing the passenger plane one day later... on March 24th. Based on this evidence, investigators said they believe Lubitz intentionally crashed the plane... when he locked the pilot out of the cockpit... and took control of the aircraft.// Meanwhile... a French prosecutor announced... that crews have finally found the second black box... the flight data recorder... adding there was ″reasonable hope″ it would provide useful information... though it was found blackened and burned.

ARIRANG NEWS 14:00 Hello everyone. You′re watching Arirang News. I′m Laah Hyun-kyung in Seoul. These are the stories we′re following at this hour... U.S. Ambassador to South Korea Mark Lippert, whose face was slashed with a knife by an attacker yesterday, is recovering well. Political analysts say this will not hurt Seoul-Washington ties. President Park Geun-hye tells Korean and UAE business leaders... that it′s time for Seoul and Abu Dhabi to extend their cooperation to "softer" sectors such as the pharmaceutical industry. Korea′s two main rival parties start discussions on raising the country′s minimum wage. But there are also concerns about the burden that the hike could put on smaller companies. Title: Prosecutors seek arrest warrant for man who attacked U.S. ambassador Our top story this afternoon prosecutors are seeking an arrest warrant for the man who attacked U.S. Ambassador to South Korea Mark Lippert. The assailant will likely have to face several charges, including attempted murder. Officials are also looking into whether the assault is related to his past pro-North Korea activities. Here′s Arirang′s Connie Kim. Prosecutors are seeking an arrest warrant to charge the man who carried out a bloody knife attack on U.S. Ambassador to South Korea Mark Lippert... with attempted murder, business obstruction and violence against a foreign envoy. A team of more than a hundred investigators will look into the motives behind the assault and whether the attacker was working with an accomplice. Police say the attack was intentional, considering that the 55-year-old was equipped with the 10-inch knife he used in the incident. He had reportedly been planning the attack for ten days. As he was being arrested at the site, Kim voiced his opposition to ongoing military exercises between Korea and the U.S. and demanded they come to a halt. Police are focusing on Kim′s pro-North Korea activities and are said to be considering charging him with violating the National Security Law, which bans support of North Korea. Kim traveled to North Korea seven times from 1999 to 2007. He also attempted to set up a memorial in Seoul to the late North Korean leader Kim Jong-il upon his death four years ago. The attack on the U.S. ambassador was the first of its kind in Korea. High-level officials from the government, ruling party and the presidential office of Cheong Wa Dae have agreed to share information with Washington in line with their bilateral ties. Lippert is at a local hospital recovering from surgery he received after the attack to repair his face and hand injuries… and doctors say he can be discharged as early as next week. Connie Kim, Arirang News. Title: U.S. media outlets focus on motive of Lippert′s attacker When the story of Ambassador Lippert broke yesterday, various global media outlets were quick to report on the attack. Most of the reports have been focusing on the motive behind the bloody slashing... and on h

Title: U.S. media outlets focus on motive of Lippert′s attacker Since the story of Ambassador Lippert broke yesterday, global media outlets have been focusing on the motive behind the bloody slashing... and on how the attacker was protesting the ongoing military drills between the U.S. and South Korea. The Washington Post led with North Korea′s callous reaction to the incident and brought up the possibility of a return to heightened tensions on the Korean peninsula. CNN International also reported on how Pyongyang applauded the knife attack. Other news media pointed out the anti-American sentiment... underlying certain parts of South Korean society. The father of one of the victims of this week's plane crash in the French Alps called Saturday for airlines to take greater care over pilots' welfare. French prosecutors have said they believe German co-pilot Andreas Lubitz deliberately slammed the Germanwings flight into a mountain. Authorities have since said Lubitz hid evidence of an illness from his employers — including a sick note for the day of the crash. "I believe the airlines should be more transparent and our finest pilots looked after properly," said Philip Bramley, from Hull in northern England. "We put our lives and our children's lives in their hands." His 28-year-old son, Paul Bramley, was one of 150 people killed in Tuesday's disaster. Speaking near the site of the crash, Philip Bramley said Lubitz's motive was irrelevant. "What is relevant, is that it should never happen again; my son and everyone on that plane should not be forgotten, ever," he said. German prosecutors, who have been trying to determine what caused Lubitz to take such a devastating decision, met with their French counterparts Saturday to discuss the preliminary findings of their investigation. Duesseldorf prosecutors say Lubitz hid evidence of an illness from his employers — including a torn-up doctor's note that would have kept him off work the day authorities say he crashed Flight 9525. Searches conducted at Lubitz's homes in Duesseldorf and in the town of Montabaur turned up documents pointing to "an existing illness and appropriate medical treatment," but no suicide note was found, said Ralf Herrenbrueck, of the Duesseldorf prosecutors' office. Prosecutors didn't specify what illness Lubitz

Germanwings co-pilot Andreas Lubitz appears to have hidden evidence of an illness from his employers, including having been excused by a doctor from work the day he crashed a passenger plane into a mountain, prosecutors said Friday.
German prosecutors say they have found a medical certificate that showed the co-pilot of the Germanwings plane was not allowed to work on the day of the crash. The prosecutors released a statement in Dusseldorf, western Germany, on Friday. They say they have found evidence that the co-pilot of the crashed plane may have hidden evidence of an illness from his employers. Their investigation has found that documents showing the co-pilot Andreas Lubitz had received medical treatment. They did not disclose what Lubitz received treatment for. The investigators said they found medical certificates indicating that he was unfit to work on the day of the crash. They also said he tore up the medical notices. If such a certificate is issued in Germany, a worker is required to submit it to their employer and take a leave of absence on doctors' orders. But Germanwings said Lubitz had not submitted any such documents. The prosecutors said it would take several days to thoroughly analyze the medical documents.

Prosecutors, Germanwings Co Pilot Should Have Been Out Sick Find out more : http://news365worldwide.blogspot.com/2015/03/prosecutors-germanwings-co-pilot-should.html
The co-pilot believed to have deliberately crashed a Germanwings passenger jet into the French Alps, killing all 150 people on board, was supposed to be on sick leave the day of the crash but hid evidence of his illness from his employer, German prosecutors said Friday. Torn-up doctor's notes were found in a search of 27-year-old Andreas Lubitz's homes in two German cities, including one excusing him from work the day of the crash. A statement from prosecutors said found medical documents indicated "an existing illness and appropriate medical treatment." The statement did not disclose what the illness was. Media reports have suggested Lubitz suffered from depression, but a Dusseldorf hospital that last saw Lubitz on March 10 for a diagnosis denied he was treated there for depression. German authorities said they found no suicide note or evidence of political or religious motivation for the crash. In France on Friday, officials said they had recovered between 400 and 600 body parts from the crash site. None of the bodies was found intact. On Thursday, French prosecutor Brice Robin said in a televised news conference that Lubitz appeared to have engineered the crash after locking the pilot out of the cockpit. French Prime Minister Manuel Valls called on Germanwings' parent company, Lufthansa, to reveal as much information as possible to help the public understand why the co-pilot might have crashed the plane. Lufthansa implements new rules Lufthansa announced Friday that it would implement new rules requiring two crew members to be in the cockpit at all times. Europe's aviation safety agency recommended that all airlines adopt the standard. The U.S. has required at least two people inside the cockpit of an airborne plane since the September 11, 2001, terrorist attacks. A member of the flight crew must stand in if a pilot needs to leave. Other airlines have taken similar action, including Air Canada, which announced a new protocol Thursday immediately mandating two people in a cockpit at all times during a flight. Prosecutor Robin said the plane's cockpit voice recorder indicated Lubitz, alone with the controls, manually sent the Airbus A-320 jetliner into a gradual eight-minute final descent at 700 kilometers an hour. Co-pilot's homes searched German police Friday searched the two homes where the co-pilot stayed when not flying: an apartment he kept in Dusseldorf, and his parents' home in the small German town of Montabour. Officials said Lubitz was not on any terrorist watch lists. But German media reported that Lubitz had taken time off work in the past for "burnout" or depression. Mattias Gebauer, chief online correspondent for the German newspaper Der Spiegel, on Friday quoted classmates of Lubitz as saying he had taken a six-month break from flight training in 2009 because of "burnout." The German paper Bild backed that report, saying Lubitz had been getting medical help for depression. Lufthansa CEO Carsten Spohr has said he would not know if medical issues caused Lubitz's break in training, because German privacy rules prevent such disclosures from becoming public. He said Lubitz's medical tests indicated he was "100 percent fit to fly" with no restrictions. The airline is likely to face liability claims from the families of those who died in the crash. An international agreement limits compensation to about $157,000 per passenger, but if the carrier is proven negligent, relatives could pursue a higher payout. Prosecutor Robin said the cockpit recordings showed that passengers were not aware of the plane's deadly trajectory until just moments before the crash, when screams can be heard. Robin said the recording also indicated that the commanding pilot — who most likely had left the controls to use the restroom — repeatedly pounded on the cockpit door to try to gain re-entry. His efforts were greeted with complete silence, and Robin said the only sound coming from behind the locked, reinforced cockpit door during the descent was Lubitz's breathing. "The breathing is not panting. It's a classic human breathing," Robin said, adding that preliminary findings did not show any links between the crash and terrorism. Flight 9525 was bound from Barcelona, Spain, to the German city of Dusseldorf, with 144 passengers and six crew, when it crashed about 100 kilometers north of the French Riviera city of Nice. People from at least 18 countries were aboard the flight, with 72 Germans and at least 35 Spaniards among the casualties. There were no distress calls from the aircraft during the descent.

German prosecutors say they have found documents that show Germanwings co-pilot Andrea Lubitz, who allegedly crashed his aircraft into the French Alps on Tuesday, was receiving medical treatment. Full story: New details are emerging from the homes linked to Andreas Lubitz, the co-pilot officials believe deliberately crashed a plane in the French Alps on Tuesday. German prosecutor Christoph Kumpa says documents have been found showing that Lubitz was receiving medical treatment. (SOUNDBITE) (German) PROSECUTOR CHRISTOPH KUMPA SAYING: "The fact there were torn up sick notes among other things, that were found, which were recent and even from the day of the crime, support the assumption based on the preliminary examination that the deceased hid his illness from his employer and his professional colleagues." The revelation follows allegations by French prosecutors that Lubitz may have locked the captain out of the cockpit and steered the Germanwings flight from Barcelona to Duesseldorf into its fatal descent, killing all 150 people on board. Officials say the captain can be heard on the flight recordings trying to force his way back inside. German prosecutors say there are no signs of any political or religious motives that may have influenced Lubitz and they have not found a suicide note... but they say that a full evaluation of the documents would take some days. The Hindu 2015-04-17The prosecutor is the chief legal representative of the prosecution in countries with either the common law adversarial system, or the civil law inquisitorial system. The prosecution is the legal party responsible for presenting the case in a criminal trial against an individual accused of breaking the law.
Prosecutors are typically lawyers who possess a law degree, and are recognized as legal professionals by the court in which they intend to represent the state (the society) (that is, they have been admitted to the bar).
They usually only become involved in a criminal case once a suspect has been identified and charges need to be filed. They are typically employed by an office of the government, with safeguards in place to ensure such an office can successfully pursue the prosecution of government officials. Often, multiple offices exist in a single country, especially those countries with federal governments where sovereignty has been bifurcated or devolved in some way.
Since prosecutors are backed by the power of the state, they are usually subject to special professional responsibility rules in addition to those binding all lawyers. For example, in the United States, Rule 3.8 of the ABA Model Rules of Professional Conduct requires prosecutors to "make timely disclosure to the defense of all evidence or information ... that tends to negate the guilt of the accused or mitigates the offense." Not all U.S. states adopt the model rules, however U.S. Supreme Court cases and other appellate cases have ruled that such disclosure is required. Typical sources of ethical requirements imposed on prosecutors come from appellate court opinions, state or federal court rules, and state or federal statutes (codified laws).
