The panel will discuss the social and political consequences of the CJEU Google Spain and UPC Telekabel decisions and their implementation across Europe by internet companies. In the former case, search engines can be obliged to amend search results that are produced on the basis of a name and are out of date, in order to comply with data protection obligations – the initial decision on how to restrict information lies with the search engine. In the latter case, Internet access providers can have blocking or filtering obligations imposed on them, with the (privacy invasive?) tool to impose this restriction being chosen in the first instance by the Internet access provider. Do safeguards exist that ensure balanced implementation of both of these rulings? If not, how can these be created? Speakers will come from EU institutions, industry and civil society. The Right to be Forgotten is one of the most controversial (new) rights in the proposed upcoming General Data Protection Regulation. The Google Spain ruling by the CJEU (Google Spain SL, Google Inc. v Agencia Española de Protección de Datos, Mario Costeja González, C131/12, ECLI:EU:C:2014:317) of 13 May 2014 made clear that an RtbF in fact already exits under the Data Protection Directive 95/46/EC. The Court held that the processing of data which is “inadequate, irrelevant or excessive” (i.e. not merely inaccurate) might also be incompatible with the Directive. In such cases, where the data is incompatible with the provisions of article 6(1)(e) to (f) of the Directive, relating to data quality, the information and links in the list of results must be erased by search engines. Since the CJEU ruling the debates regarding the meaning and scope of an RtbF have taken a new turn, Google and others have taken steps to implement the judgment and policy makers and supervisory authorities have taken further steps to clarify the right and devise practical procedures for implementing it.
It is fair to say that there have been a variety of responses to the CJEU judgment. One of the factors influencing peoples‘ responses to the very idea of ‘a right to be removed from search engine results’ is their cultural background. Another important point of discussion is the enforceability of this ‘right’. In this panel we explore the different perceptions of the RtbF as framed by the CJEU with respect to search engines in the US, Europe and Asia. The panel will address topics such as:
What are the dominant opinions about the right as clarified by the CJEU in different regions around the globe?
How does the RtbF relate to other rights, such as freedom of expression and freedom of information in different regions?
Who decides what to take down and under what criteria?
How we can ensure a transparent and accountable deletion mechanism?
How we can streamline the RtbF in different jurisdictions offered by the same global service?

With the publication of the 17th draft Rules of Procedure for the Unified Patent Court (UPC) expected later this year, the first five ratifications of the UPC Agreement confirmed and the short-listing of judges underway, momentum is gathering towards the opening of the new court.
But, the UPC will not operate in isolation. In particular, the UPC must work alongside and interact with the existing national courts, the CJEU and the EPO. This gives rise to a number of important questions and tactical issues.
In this webinar, lawyers from our UK and German patent team shed light on these complex but critical questions.

The proliferation of new legal institutions and strategies for solving administrative disputes (operating either complementary or as an alternative to the court system) are currently modifying the relationship between law and administration. These new tools are competing with the traditional models of dispute resolution (mainly courts) by employing different methods. One of these developments can be seen in the rise and success of ombudsmanship. The European Ombudsman has developed norms of a non-legal character for the assessment of the conduct of the administration, contributing to the growth of a body of ethical norms applied by public administration – ombudsprudence.
The European Ombudsman has been from the beginning one of the promoters of good administration in the EU. As part of the institution’s endeavours, transparency and participation hold an important place. The paper tries to assess the ombudsprudence of the office in recent years in what regards the principles of good governance relating to transparency and participation. The empirical research is based on an analysis of a sample of the Ombudsman’s decisions from 2010 to 2015. It will analyse the cases relating to transparency and participation pursued by the European Ombudsman, the good governance norms developed by the institution in the process thereof, and how this jurisprudence relates to the legal framework of the EU in this field, as well as to the jurisprudence of the CJEU. The ultimate aim of the paper is to determine whether the institution has brought a clear contribution to the development of the transparency principle beyond the existing legal texts.

Twenty years ago the first European Ombudsman was elected and began work, following the creation of the office by the Treaty of Maastricht. The passage of time since then allows for reflection on the topic with a certain amount of experience and material for evaluation. The twentieth anniversary represents an opportunity to assess and discuss the position of the Ombudsman in the European political and legal order in the framework of a Colloquium gathering academics and practitioners. The Colloquium is addressed at an interdisciplinary audience interested in the phenomenon of the Ombudsman in the EU and will probably lead to a publication with a special issue of a renowned journal.
The contributions will endeavour to examine critically, from a variety of perspectives and methodologies - historical, administrative, political, legal and comparative - the development of the Ombudsman’s role in the landscape of EU institutions, bodies, offices and agencies which are involved in EU law and policy. The discussions will aim at evaluating what has been achieved in reality, by comparison both to the original objectives sought to be realised by its introduction as well as new needs and possibilities that subsequently emerged. Key themes to be addressed will be the effects the introduction of the Ombudsman has had on the EU’s system of accountability, as well as the changes and future possibilities and challenges for accountability in the EU due to the existence of the Ombudsman institution.
The Colloquium will be honoured by the presence of the current European Ombudsman, Emily O’Reilly, the first Ombudsman, Jacob Söderman, and his successor, P. Nikiforos Diamandouros.

There has been no piece of European legislation, which has sparked more intense debate as to the privacy/security distinction than the Data Retention Directive. After more than 6 years of the Directive being in force, these debates reached a head with the Directive being declared invalid by the CJEU in the Digital Rights Ireland case. However, almost one year on from the decision, there are a number of uncertainties as to what the decision means, the obligations it bestows on lawmakers and the consequences it will have. EU Member States may choose opposite paths in reacting to the decision and this may bring new court cases. The panel will consider the consequences of this judgment and where Data Retention goes from here.

The aim of this conference is to assess the effect of the EU Charter of Fundamental Rights on the effective application of the Area of Freedom Security and Justice, as provided for in the EU treaties particularly after the entry into force of the Lisbon Treaty. Sessions of the conference will take stock of how the Charter is mainstreamed at all stages of the legislative procedure from the impact assessment through the inter-institutional phase, the national perspective, including challenges and best practices in the application of the Charter when implementing EU law in the AFSJ as well as future developments, prospects and challenges.

The Right to be Forgotten is one of the most controversial (new) rights in the proposed upcoming General Data Protection Regulation. The Google Spain ruling by the CJEU (Google Spain SL, Google Inc. v Agencia Española de Protección de Datos, Mario Costeja González, C131/12, ECLI:EU:C:2014:317) of 13 May 2014 made clear that an RtbF in fact already exits under the Data Protection Directive 95/46/EC. The Court held that the processing of data which is “inadequate, irrelevant or excessive” (i.e. not merely inaccurate) might also be incompatible with the Directive. In such cases, where the data is incompatible with the provisions of article 6(1)(e) to (f) of the Directive, relating to data quality, the information and links in the list of results must be erased by search engines. Since the CJEU ruling the debates regarding the meaning and scope of an RtbF have taken a new turn, Google and others have taken steps to implement the judgment and policy makers and supervisory authorities have taken further steps to clarify the right and devise practical procedures for implementing it.
It is fair to say that there have been a variety of responses to the CJEU judgment. One of the factors influencing peoples‘ responses to the very idea of ‘a right to be removed from search engine results’ is their cultural background. Pokémon (ポケモン Pokemon?, /ˈpoʊkeɪmɒn/ poh-kay-mon)[1][2] is a media franchise owned by The Pokémon Company,[3] and created by Satoshi Tajiri in 1995.[4] It is centered on fictional creatures called "Pokémon", which humans capture and train to fight each other for sport.
The franchise began as a pair of video games for the original Game Boy, developed by Game Freak and published by Nintendo. The franchise now spans video games, trading card games, animated television shows and movies, comic books, and toys. Pokémon is the second-most successful and lucrative video game-based media franchise in the world, behind only Nintendo's Mario franchise.[5]

(now The Pokémon Company International), a subsidiary of Japan's Pokémon Co., now oversees all Pokémon licensing outside of Asia.[8] As of 2013, the Pokémon media franchise has grossed revenues of ¥4 trillion worldwide[9] (equivalent to US$40.98 billion). The brand earned $2 billion in 2014 alone.[10]

With the publication of the 17th draft Rules of Procedure for the Unified Patent Court (UPC) expected later this year, the first five ratifications of the UPC Agreement confirmed and the short-listing of judges underway, momentum is gathering towards the opening of the new court.
But, the UPC will not operate in isolation. In particular, the UPC must work alongside and interact with the existing national courts, the CJEU and the EPO. This gives rise to a number of important questions and tactical issues.
