Appointed by President Clinton, Judge Baker currently serves on the U.S. Court of Appeals for the Armed Forces, which is an appellate body composed of five civilian judges that handles cases arising under the Uniform Code of Military Justice. He has been involved in decision-making processes regarding international law, armed conflict, security and intelligence throughout his career and has consulted on decisions regarding military actions in Somalia, Haiti, Bosnia, Kosovo, Iraq and to combat Al-Qaeda and other terrorist groups. He is considered to be one of the country’s finest national security scholars and is known for pursuing a philosophy of national security policy and process that is carefully crafted within the confines of the established laws that govern them.
Judge Baker attended Yale University as an undergraduate, served in the Marine Corps as an infantry officer and graduated from Yale Law School in 1990. He was a legislative aide to Senator Daniel Patrick Moynihan and went on to serve in a variety of important civil service capacities including appointments to the U. S. Department of State, the National Security Council, the Council to the President’s Foreign Intelligence Advisory and Intelligence Oversight Boards, and as Special Assistant to the President and Legal Advisor to the National Security Council.
He is the author of In the Common Defense: National Security Law for Perilous Times (a text widely used in the study of the subject), and, with Michael Reisman, Regulating Covert Action. Judge Baker is the recipient of the 1999 Colonel Nelson Drew Memorial Award (the NSC’s highest honor) and the Director of Central Intelligence's "Director's Award." He is also the great-grandson of John Henry Twachtman and a grand-nephew of WWI veteran J. Alden Twachtman, both formers members of the Cos Cob art colony.

Thames, 39, claims police conspired with a lab to falsify evidence in his 1995 trial. An appellate court ruled there was no evidence to prove his innocence.
Thames was convicted of murdering Susan Doll in Fort Collins. He was arrested for the crime in 1995. Doll had been raped and strangled and was murdered in August of 1989. DNA evidence linked Thames to her murder.
Multiple defense sources have told CBS4 that recent DNA testing has linked Thames to another murder.
Jacie Taylor, 19, was found dead in 1994 inside her Palisade apartment. She had been strangled with a dog leash, beaten and sexually assaulted.

The National Labor Relations Board (NLRB) is an independent agency of the United States government charged with conducting elections for labor union representation and with investigating and remedying unfair labor practices. Unfair labor practices may involve union-related situations or instances of protected concerted activity. The NLRB is governed by a five-person board and a General Counsel, all of whom are appointed by the President with the consent of the Senate. Board members are appointed to five-year terms and the General Counsel is appointed to a four-year term. The General Counsel acts as a prosecutor and the Board acts as an appellate judicial body from decisions of administrative law judges. As of 2013, the NLRB is headquartered at 1099 14th Street NW, Washington, D.C with over 30 regional, sub-regional, and residential offices throughout the U.S. In April 2009, President Obama nominated Craig Becker (Associate General Counsel of the Service Employees International Union), Mark Gaston Pearce (a member on the Industrial Board of Appeals, an agency of the New York State Department of Labor), and Brian Hayes (Republican Labor Policy Director for the Senate Committee on Health, Education, Labor and Pensions) to fill the three empty seats on the NLRB.[75] Becker's nomination appeared to fail on February 8, 2010, after Republican Senators (led by John McCain) threatened to filibuster his nomination.[77][84] President Obama said he would consider making recess appointments to the NLRB due to the Senate's failure to move on any of the three nominations.[84] On March 27, 2010 Obama recess appointed Becker and Pearce.[85] On June 22, 2010, a voice vote in the Senate confirmed Pearce to a full term, allowing him to serve until August 27, 2013. Under the doctrine of the separation of powers, the judiciary generally does not make law (that is, in a plenary fashion, which is the responsibility of the legislature) or enforce law (which is the responsibility of the executive), but rather interprets law and applies it to the facts of each case. This branch of the state is often tasked with ensuring equal justice under law. It usually consists of a court of final appeal (called the Supreme court or Constitutional court), together with lower courts. In many jurisdictions the judicial branch has the power to change laws through the process of judicial review. Courts with judicial review power may annul the laws and rules of the state when it finds them incompatible with a higher norm, such as primary legislation, the provisions of the constitution or international law. Judges constitute a critical force for interpretation and implementation of a constitution, thus de facto in common law countries creating the body of constitutional law. In the US during recent decades the judiciary became active in economic issues related with economic rights established by constitution because economics may provide insight into questions that bear on the proper legal interpretation.[3] Since many countries with transitional political and economic systems continue treating their constitutions as abstract legal documents disengaged from the economic policy of the state, practice of judicial review of economic acts of executive and legislative branches have begun to grow. It is important to distinguish between the two methods of corruption of the judiciary: the state (through budget planning and various privileges), and the private.[5] The term judiciary is also used to refer collectively to the personnel, such as judges, magistrates and other adjudicators, who form the core of a judiciary (sometimes referred to as a bench), as well as the staffs who keep the system running smoothly. The Supreme Court of the United States is the highest judicial body in the United States. Its membership consists of the Chief Justice of the United States and eight associate justices. The justices are nominated by the President of the United States and appointed after confirmation by the United States Senate. Justices of the Supreme Court have life tenure and receive a salary which is set at $255,500 per year for the chief justice and at $244,400 per year for each associate justice as of 2014. On August 7, 2010, Justice Elena Kagan became the 112th justice to serve on the Court.
The Supreme Court was created in 1789 by Article III of the United States Constitution, which stipulates that the "judicial Power of the United States, shall be vested in one supreme Court" together with any lower courts Congress may establish.[1] Congress organized the Court that year with the passage of the Judiciary Act of 1789. It specified the Court's original and appellate jurisdiction, created thirteen judicial districts, and fixed the number of justices at six (one chief justice and five associate justices).[6][7]
Since the passage of the Judiciary Act, Congress has occasionally altered the size of the Supreme Court, historically in response to the country's own expansion in size. Membership was decreased in 1801 to five, then increased to seven members in 1807, to nine in 1837, and to ten in 1863. It was then reduced to seven in 1866. In 1869, Congress set the Court's size to nine members, where it has remained since.[8] While the justices of the Supreme Court are appointed for life, some choose to retire: a total of 54 have retired or resigned. The average age of newly appointed justices is about 53 years old. Historically, the average length of service on the Court has been less than 15 years; however, since 1970 the average length of service has increased to about 26 years.

Dubious FBI lab work and testimony in Duckett's case and thousands of others from the 1980s and 1990s is receiving special scrutiny from the U.S. Department of Justice, which is overseeing a review of convictions.
"I am confident that when a court gets all of the relevant information in front of them, they will give him the review he deserves," said Mary Elizabeth Wells, an appellate lawyer who has represented Duckett for 20 years.
The latest questions about the 27-year-old murder case in Lake County arose after The Washington Post included Duckett in a report detailing efforts by the Justice Department and the FBI to ensure that fair-trial rights were not compromised by widespread problems in an FBI forensic unit that examined microscopic hair evidence.
The newspaper report suggested that tainted testimony may have led to hundreds of wrongful convictions.
Duckett, now 56, was convicted in 1988 of raping and strangling 11-year-old Teresa McAbee, partly on the strength of scientific testimony offered during his trial by former FBI Special Agent Michael Malone, whose laboratory work, methodologies and conclusions have been attacked, in retrospect, as shoddy and unreliable.
Malone was at one time well-known for forensic work he performed in high-profile cases, including those of John Hinckley, who tried to assassinate President Ronald Reagan; and Jeffrey MacDonald, a Green Beret Army surgeon convicted of murdering his wife and children at Fort Bragg, N.C.
Malone testified at Duckett's trial as an FBI expert in hair and fiber analysis and concluded there was a "high degree of probability" that a pubic hair found in the girl's panties came from Duckett, a rookie cop at the time.
Wells has argued in appeals that prosecutors presented Malone's flawed analysis as physical evidence that tied Duckett to the rape and murder of the child, whose body was found floating in Knight Lake near her mother's home. She has labeled Malone's testimony as "misleading at best."
The case against Duckett was built largely on circumstantial evidence, including the FBI's visual comparison of hair strands under a microscope, a method used far less today because of advances in DNA testing, now common in U.S. courtrooms.

This book analyzes how the Appellate Body uses particular principles of general international law in interpreting the WTO covered agreements. It deals equally with general international law and WTO law. The aim is to explain how the Appellate Body interprets and applies customary international law on treaty interpretation in dealing with the WTO covered agreements. The main concern is to analyze the judicial reasoning and ways of justifying judicial decision-making. In particular, it answers the question of how the Appellate Body explains its reading of WTO treaty language. It is argued that the Appellate Body has interpreted the WTO covered agreements in a contextual and effective manner, an approach that corresponds with general international law. The character of the WTO covered agreements has, nevertheless, confronted the Appellate Body with some questions of interpretation that were until recently unexplored or neglected by other courts and tribunals. In that sense, the Appellate Body has contributed to the development of general international law on treaty interpretation, or at least to its practice. WTO law is primarily treaty law, but increasingly soft law and broader themes and values from other disciplines, such as governance, variable geometry and legitimacy, are introduced and discussed. Customary international law - with the exception of the principles of treaty interpretation - and general principles of law are often seen as excluded entirely. An ancillary theme of this proposed monograph is the extent to which customary international law and general principles of law have penetrated WTO law through the technique of treaty interpretation.

James Baker: Lasting Post: Love, Law and Laureates: The Forgotten Legacis of WW
Judge James E. Baker explores WWI's influence on letters, law, remembrance and the concept of service.
Appointed by President Clinton, Judge Baker currently serves on the U.S. Court of Appeals for the Armed Forces, which is an appellate body composed of five civilian judges that handles cases arising under the Uniform Code of Military Justice. He has been involved in decision-making processes regarding international law, armed conflict, security and intelligence throughout his career and has consulted on decisions regarding military actions in Somalia, Haiti, Bosnia, Kosovo, Iraq and to combat Al-Qaeda and other terrorist groups. He is considered to be one of the country’s finest national security scholars and is known for pursuing a philosophy of national security policy and process that is carefully crafted within the confines of the established laws that govern them.
Judge Baker attended Yale University as an undergraduate, served in the Marine Corps as an infantry officer and graduated from Yale Law School in 1990. He was a legislative aide to Senator Daniel Patrick Moynihan and went on to serve in a variety of important civil service capacities including appointments to the U. S. Department of State, the National Security Council, the Council to the President’s Foreign Intelligence Advisory and Intelligence Oversight Boards, and as Special Assistant to the President and Legal Advisor to the National Security Council.
He is the author of In the Common Defense: National Security Law for Perilous Times (a text widely used in the study of the subject), and, with Michael Reisman, Regulating Covert Action. Judge Baker is the recipient of the 1999 Colonel Nelson Drew Memorial Award (the NSC’s highest honor) and the Director of Central Intelligence's "Director's Award." He is also the great-grandson of John Henry Twachtman and a grand-nephew of WWI veteran J. Alden Twachtman, both formers members of the Cos Cob art colony.

Talking Disputes |The India – Agricultural Products Dispute
This event will introduce the recent WTO Appellate Body report on India – Agricultural Products (DS430). In this dispute, the United States challenged the prohibitions imposed by India on the importation of various agricultural products from the United States purportedly because of concerns related to Avian Influenza (AI). A WTO panel ruled against India in some respects and India appealed several aspects of the panel’s findings. The Appellate body largely upheld the panel’s findings. The Appellate Body affirmed, among others the panel’s finding that India’s AI measures are not based on or conform to relevant international standards, are not based on risk assessment, arbitrarily and unjustifiably discriminate between Members where identical or similar conditions prevail, are significantly more trade restrictive than required to achieve India’s appropriate level of protection. The Appellate Body also upheld the panel’s finding that India failed to adapt its AI measures to regional sanitary and phytosanitary characteristics.
Talking Disputes is designed to allow for the discussion of specific WTO disputes by experts and interested professionals from relevant fields. One or two experts present key aspects of the case, setting the stage for a targeted discussion, and designated discussants provide substantive comments.

Serial killer - The Doll Murders
man already serving a life sentence for murder is suspected in another decades-old crime. On Wednesday, Douglas Thames lost his chance for an appeal.
Thames, 39, claims police conspired with a lab to falsify evidence in his 1995 trial. An appellate court ruled there was no evidence to prove his innocence.
Thames was convicted of murdering Susan Doll in Fort Collins. He was arrested for the crime in 1995. Doll had been raped and strangled and was murdered in August of 1989. DNA evidence linked Thames to her murder.
Multiple defense sources have told CBS4 that recent DNA testing has linked Thames to another murder.
Jacie Taylor, 19, was found dead in 1994 inside her Palisade apartment. She had been strangled with a dog leash, beaten and sexually assaulted.
The man who had been convicted and imprisoned for her murder, Robert Dewey, was exonerated and released from prison on Monday after new DNA testing indicated he had been wrongly accused.

The National Labor Relations Board (NLRB) is an independent agency of the United States government charged with conducting elections for labor union representation and with investigating and remedying unfair labor practices. Unfair labor practices may involve union-related situations or instances of protected concerted activity. The NLRB is governed by a five-person board and a General Counsel, all of whom are appointed by the President with the consent of the Senate. Board members are appointed to five-year terms and the General Counsel is appointed to a four-year term. The General Counsel acts as a prosecutor and the Board acts as an appellate judicial body from decisions of administrative law judges. As of 2013, the NLRB is headquartered at 1099 14th Street NW, Washington, D.C with over 30 regional, sub-regional, and residential offices throughout the U.S. In April 2009, President Obama nominated Craig Becker (Associate General Counsel of the Service Employees International Union), Mark Gaston Pearce (a member on the Industrial Board of Appeals, an agency of the New York State Department of Labor), and Brian Hayes (Republican Labor Policy Director for the Senate Committee on Health, Education, Labor and Pensions) to fill the three empty seats on the NLRB.[75] Becker's nomination appeared to fail on February 8, 2010, after Republican Senators (led by John McCain) threatened to filibuster his nomination.[77][84] President Obama said he would consider making recess appointments to the NLRB due to the Senate's failure to move on any of the three nominations.[84] On March 27, 2010 Obama recess appointed Becker and Pearce.[85] On June 22, 2010, a voice vote in the Senate confirmed Pearce to a full term, allowing him to serve until August 27, 2013. The same day, the Senate confirmed Republican nominee Brian Hayes of Massachusetts by voice vote. Hayes' term ended on December 16, 2012.[86] Becker's term, as a recess appointee, ended on December 31, 2011.[87] Effective August 28, 2011, Pearce was named chairman to replace Democrat Wilma Liebman, whose term had expired.[88] On January 4, 2012, Obama announced recess appointments to three seats on the board: Sharon Block, Terence F. Flynn, and Richard Griffin.[89] The appointments were criticized by Republicans, including the House Speaker John Boehner, as unconstitutional and a brazen attempt to undercut the role of the Senate to advise and consent the executive branch on appointments.[90] Although made as recess appointments, critics questioned their legality, arguing that Congress had not officially been in recess as pro forma sessions had been held.[91] Former U.S. attorney general Edwin Meese stated that in his opinion, since the appointments were made when the Senate was demonstrably not in recess they represented a constitutional abuse of a high order.[92] On January 12, 2012 the U.S. Justice Department released a memo stating that appointments made during pro forma sessions are supported by the Constitution and precedent.[93] On January 25, 2013, a panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled that President Obama's recess appointments were invalid as they were not made during an intersession recess of the Senate. It further concluded that the Recess Appointments Clause only permitted the President to fill a vacancy if it arose during an intersession recess of the Senate, and the President moved to fill it during the same recess.[94] At the Obama Administration's request, the U.S. Supreme Court has agreed to hear the case, National Labor Relations Board v . Noel Canning, No. 12-1281.

Presentation of the "Common Law Grand Jury" by Rodger Dowdell of the National Liberty Alliance on why it is "Time To Take Back America" and how to do it. Common Law defined in Wiki: "Common law (also known as case law or precedent) is law developed by judges through decisions of courts and similar tribunals that decide individual cases, as opposed to statutes adopted through the legislative process or regulations issued by the executive branch. A "common law system" is a legal system that gives great precedential weight to common law, so that consistent principles applied to similar facts yield similar outcomes. The body of past common law binds judges that make future decisions, just as any other law does, to ensure consistent treatment. In cases where the parties disagree on what the law is, a common law court looks to past precedential decisions of relevant courts. If a similar dispute has been resolved in the past, the court is usually bound to follow the reasoning used in the prior decision (this principle is known as stare decisis). If, however, the court finds that the current dispute is fundamentally distinct from all previous cases (called a "matter of first impression"), judges have the authority and duty to make law by creating precedent. Thereafter, the new decision becomes precedent, and will bind future courts.
In practice, common law systems are considerably more complicated than the simplified system described above. The decisions of a court are binding only in a particular jurisdiction, and even within a given jurisdiction, some courts have more power than others. For example, in most jurisdictions, decisions by appellate courts are binding on lower courts in the same jurisdiction, and on future decisions of the same appellate court, but decisions of lower courts are only non-binding persuasive authority. Interactions between common law, constitutional law, statutory law and regulatory law also give rise to considerable complexity. However, stare decisis, the principle that cases should be decided according to consistent principled rules so that similar facts will yield similar results, lies at the heart of all common law systems.
