TERMS AND CONDITIONS

 

By entering the ‘Chinese New Year cash back offer (“the Promotion”), you are agreeing to the following terms and conditions (“Terms and Conditions”), which will run from the 19 February 2015 to the 5 March 2015 (“the Promotional Period”).

Anyone who enters the Promotion (an “Entrant”) will be deemed to have understood these Terms and Conditions and will be bound by them.

 

Who can enter

1.     Entry is open to all residents of Australia aged 18 years and over who have an account with Oneflare, except employees and immediate families of the Promoter, associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

2.     Entrants may use the promotional code multiple times within the Promotional Period.

 

How to enter

 

3.     In order to enter ‘the Promotion’ entrants must follow the rules below (“the Rules”)

o    Entrants must post a job through www.oneflare.com.au during the Promotional Period.

o    Entrants must use the promo code 'CNY15' when requesting a service.

o     Entrants must hire a service provider in order to receive $15 cash back off the service.

o     Once a service provider has been hired and the job has been completed and paid for, customer must leave feedback for the hired business on their Oneflare profile and then email support@oneflare.com with their bank details and the $15 will be deposited to the nominated account.

When to enter

 

4.     The Promotion commences from the 19 February 2015 and closes at 23:59 (AEST) on the 5 March 2015 (the “Promotional Period”).  Entry can only be made during the Promotional Period.

5.     To receive $15 for the service, entrants must post a job by 5 March 2015, then hire a business registered on Oneflare and then leave feedback to the hired business’ profile page on Oneflare site.

6.     Each customer will be deposited $15 into their nominated bank account, once the service provider has been hired, the job has been completed and paid for, and feedback has been left by the customer on the hired business’ Oneflare profile.

7.     Customer must agree to participate and co-operate as required in any subsequent promotional activities and/or media relating to the Promotion.

8.     The Promoter has the right to check that the customer has hired the service provider and completed the job before receiving the $15 promotion.

9.     All customers agree to receive promotional emails from Oneflare Pty Ltd until such time as they wish to unsubscribe and be taken off the Oneflare email list. All data collected by Oneflare is subject to the privacy policy listed under the heading “Privacy Policy”.

10.  The promoter’s decision in relation to any aspect of the Promotion is final and no correspondence will be entered into.

 

Further Terms and Conditions

 

11.  The Promoter reserves the right to amend these Terms and Conditions if this promotion cannot be run as originally planned. The Promoter may also cancel or suspend this promotion if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this promotion.  

12.  The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation are reserved.  

13.  If the voucher is unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.  

14.  The Promoter cannot guarantee that any credit returned to the Promoter due to non-delivery to their bank account will be re-sent to the customer.

15.  The Promoter reserves the right to request customers to sign a customer’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, or proof of entry validity in order to claim the voucher. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a customer cannot provide suitable proof, the customer will forfeit the cash back in whole and no substitute will be offered.  

16.  The Promoter reserves the right to rejudge in the event of a customer, claiming to be a valid entrant, being unable to satisfy these Terms and Conditions.  

17.  The promoter’s decision in relation to any aspect of the promotion is final and binding on each person who enters. Chance plays no part in determining any entrant. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.

18.  Voucher is subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for cash lost in transit.

19.  All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. Oneflare Pty Ltd and its related entities collect customers’ personal information for the purpose of conducting and promoting this promotion (including but not limited to determining and notifying winners). We do not sell personal information to other organisations. We may disclose personal information to essential service providers who provide services in connection with our products and services.

20.  In participating in the promotion, the customer agree to participate and co-operate as required in all promotional activities relating to the Promotion, including but not limited to promoting the customer’s photo, which accompanied their entry on the oneflare.com website and Oneflare social media channels. The customer agrees to granting the promoter a perpetual and non-exclusive licence to use such information in all media worldwide, including online social networking sites, and the customer (and their companions) will not be entitled to any fee for such use.  

21.  Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

22.  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
