COURT COMPLAINT OVER INSULT TO NATIONAL FLAG A Private complaint has been file on the file of IIIth Addl. Chief Metropolitian Magistrate, Nampally, Hyderabad, Telangana State vide SR No. 5006 Of 2015 today by Mohammed Rasheeduddin, Joint Secretary of Citizens Forum for Equity and Justice against the below mentioned persons i.e. Suvarna Vinayak, Co-Ordinator, State Council for Education Research and Training (S.C.E.R.T.), Hyderabad, Telangana. S. Jagannadha Reddy, Director, State Council for Education Research and Training (S.C.E.R.T.), Hyderabad, Telangana. Prajasakti Daily Printing Press, Plot NO.21/1, Azamabad Industrial Area, Hyderabad, Telangana. Kala Jyothi Processes Pvt. Ltd,Hyderabad, Telangana. That on the cover page of Telugu reader text book of Ninth standard for government of Telangana there is being a photographic image which shows a lady carrying our country’s national flag in a cartoon and that in the said picture the national flag is dishonoured and given disrespect. As per the Flag Code of India, 2002, takes effect from January 26, 2002 and supersedes the ‘Flag Code-India’ as it existed. PART 1, GENERAL 1.1 The National Flag shall be a tri-colour panel made up of three rectangular panels or sub-panels of equal widths. The colour of the top panel shall be India saffron (Kesari) and that of the bottom panel shall be India green. The middle panel shall be white, bearing at its centre the design of Ashoka Chakra in navy blue colour with 24 equally spaced spokes. The Ashoka Chakra shall preferably be screen printed or otherwise printed or stenciled or suitably embroidered and shall be completely visible on both sides of the Flag in the centre of the white panel. But contrary to the same the Ashoka Chakra is printed in different colour and with different number of spokes. That THE PREVENTION OF INSULTS TO NATIONAL HONOUR ACT, 1971 No. 69 of 1971 (23rd December, 1971) which was Amended by the Prevention of Insults to National Honour (Amendment) Act, 2005, No. 51 of 2005 on 20th December, 2005 it is clearly mentioned in Section 2 of the Act that Whoever in any public place or in any other place within public view burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon or otherwise shows disrespect to or brings into contempt (whether by words, either spoken or written, or by acts) the Indian National Flag or the Constitution of India or any part thereof, shall be punished with imprisonment for a term which may extend to three years, or with fine, or with both which includes any picture, painting, drawing or photograph, or other visible representation of the Indian National Flag, or of any part or parts thereof, made of any substance or represented on any substance. That the said book a copy of which has been submitted along with this complaint is being published by Prajasakti Daily Printing Press, Plot NO.21/1, Azamabad Industrial Area, Hyderabad, Telangana on behalf of Telangana Government Text Books Press, Hyderabad and printed at Kala Jyothi Processes Pvt. Ltd, Hyderabad. That the copyright holder of the said book is the Director of School Education, Government of Telangana, Saifabad, Hyderabad, Telangana and Mr, S. Jagannadha Reddy, Director, State Council for Education Research and Training (S.C.E.R.T.) & Mr Suvarna Vinayak, Co-Ordinator, State Council for Education Research and Training (S.C.E.R.T.), Hyderabad, Telangana are the persons responsible for the composing and publishing the said book . The said book is being included in the syllabus for high school studies al over the state in both private and govt. Schools and if no proper action is taken against the responsible persons and the steps are not being taken for removing above mentioned changes it may send wrong message to minds of students with regard to National Flag that all the above mentioned are equally responsible for the dishonor of the Indian National Flag as per The Prevention Of Insults To National Honour Act 1971 and are liable to be punished as per the law. That the complainant is the resident of the above mentioned address which comes under the jurisdiction of Police Station Banjara Hills and a complaint was also given to the Inspector Of Police, Police Station Banjara HIls, Hyderabad, Telangana over the issue on 6-08-2015 but no action has been taken by the police till today therefore a private complaint under section 200 of Cr.P.C has been filed in the criminal court to take immediate legal action against the above mentioned as per the law and arrest and punish them in the interest of National Dignity.
