CENTENNIAL, Colo. - Lawyers for accused Aurora theater shooter James Holmes admit in a court filing released Wednesday that he killed 12 people and wounded many other moviegoers last year.
In the filing, Holmes' lawyers say he was "in the throes of a psychotic episode" at the time of the shootings.
Holmes has pleaded not guilty by reason of insanity to 166 counts in connection with the July 20, 2012 attack at the Century 16 movie theater. He was scheduled to undergo a lengthy mental examination, as a result of his plea.

CENTENNIAL, Colo. - Lawyers for accused Aurora theater shooter James Holmes admit in a court filing released Wednesday that he killed 12 people and wounded many other moviegoers last year.
In the filing, Holmes' lawyers say he was "in the throes of a psychotic episode" at the time of the shootings.
Holmes has pleaded not guilty by reason of insanity to 166 counts in connection with the July 20, 2012 attack at the Century 16 movie theater. He was scheduled to undergo a lengthy mental examination, as a result of his plea.
"[T]he evidence revealed thus far in the case supports the defense's position that Mr. Holmes suffers from a severe mental illness and was in the throes of a psychotic episode when he committed the acts that resulted in the tragic loss of life and injuries sustained by moviegoers on July 20, 2012," the motion states, but says other than the attack, " there is no evidence that Mr. Holmes presents a danger to the safety of the courtroom or a flight risk of any kind."
"It's not surprising. We've all known since he pleaded not guilty by reason of insanity that they were going to admit the acts," said legal analyst Dan Recht. "They're not going to dispute who did this, the question's going to be was Holmes psychotic and therefore was he insane?"

CENTENNIAL, Colo. (AP) -- The judge who oversaw Colorado theater shooter James Holmes' trial gave an impassioned defense of the jury and the process Monday after the mother of one of the wounded said Holmes' life sentence showed more concern for Holmes than for the victims.
"You can't claim there was no justice because it wasn't the outcome you expected," Judge Carlos A. Samour Jr. said in an unusual speech from the bench during Holmes' formal sentencing hearing for the 2012 attack.

Holmes, clad in red jail garb, showed no reaction as Medek described how her life had changed forever when her daughter Micayla Medek, 23, was shot and killed.
"I could barely get up and off the couch. Nothing seemed joyful. Just fear and despair. I will never be the same," she sobbed as her husband, Greg Medek comforted her.
Holmes was found guilty last month of murdering 12 people and wounding 70 in his July 2012 rampage in the Denver suburb of Aurora. Prosecutors have said about 100 victims are expected to testify at this hearing. They cannot address Holmes directly.
The jury did not reach a unanimous decision to execute Holmes for shooting up a crowded midnight screening of a Batman film, meaning the 27-year-old will get a life sentence.
While Holmes' first-degree murder convictions carry 12 automatic, consecutive life sentences with no parole, under Colorado law Arapahoe County District Court Judge Carlos Samour must formally impose the penalties.
Holmes was found guilty of 165 counts of murder, attempted murder and explosive charges, and the judge must also decide the punishment for those other offenses.

Sobbing victims told how the Colorado movie massacre gunman wrecked their lives, testifying on Monday (August 24) as a three-day hearing began at which James Holmes will be formally sentenced to life in prison with no parole.
"I went back to work after two months. I was a fryer operator for 34 years. I couldn't do my job. I couldn't concentrate," Rena Medek said, her voice choking with emotion. "I was responsible for the whole kitchen and my mind just wasn't my own. All I could think about was my daughter being shot."
Holmes, clad in red jail garb, showed no reaction as Medek described how her life had changed forever when her daughter Micayla Medek, 23, was shot and killed.
"I could barely get up and off the couch. Nothing seemed joyful. Just fear and despair. I will never be the same," she sobbed as her husband, Greg Medek comforted her.
Holmes was found guilty last month of murdering 12 people and wounding 70 in his July 2012 rampage in the Denver suburb of Aurora. Prosecutors have said about 100 victims are expected to testify at this hearing. They cannot address Holmes directly.
The jury did not reach a unanimous decision to execute Holmes for shooting up a crowded midnight screening of a Batman film, meaning the 27-year-old will get a life sentence.
While Holmes' first-degree murder convictions carry 12 automatic, consecutive life sentences with no parole, under Colorado law Arapahoe County District Court Judge Carlos Samour must formally impose the penalties.
Holmes was found guilty of 165 counts of murder, attempted murder and explosive charges, and the judge must also decide the punishment for those other offenses.

CENTENNIAL, Colo. - In trembling, tearful voices, two daughters of a man killed in the Colorado theater shooting told a judge Monday his death shattered their lives and left them in a black hole of sorrow.
They were the first of at least 100 victims and witnesses who are expected to testify about the July 20, 2012, attack’s impact on their lives during shooter James Holmes’ formal sentencing hearing.
“There’s no human language that can convey the pain I have witnessed seize ahold of my family,” said Kristian Cowden, whose father Gordon Cowden was the oldest of 12 people gunned down by Holmes in the attack.
Her sister, Brooke, described “drowning in pain and sadness.”
The three-day sentencing hearing gives survivors a chance to share their harrowing stories with the judge, but it won’t change Holmes’ sentence. Jurors already determined that Holmes will spend the rest of his life in prison without parole for the attack that also wounded 70 others.
Judge Carlos A. Samour Jr. will formally sentence Holmes to life on 24 counts of first-degree murder — two for each of those killed. This week’s testimony will help him determine Holmes’ sentences on 141 other counts that include attempted murder and an explosives charge. Samour has not set a limit on the number of people who can testify at the hearing.
Holmes will also have an opportunity to speak, though he declined to do so during his trial.
Many victims took the stand during Holmes’ four-month trial earlier this summer about the terror and carnage he inflicted on more than 400 people who filled the seats at a sold-out midnight movie premiere of “The Dark Knight Rises” in the Denver suburb of Aurora. Holmes, a former graduate student in neuroscience, slipped into the darkened theater, threw gas canisters into the crowd and opened fire with a shotgun, assault rifle and semi-automatic pistol.
State corrections officials will determine where Holmes will be incarcerated after an evaluation that includes his mental health. That could last up to 60 days, Department of Corrections spokeswoman Adrienne Jacobson said.
Colorado prisons have an extensive mental health care system, and Holmes, who has been diagnosed with varying forms of schizophrenia, could wind up in the department’s mental hospital, the 250-bed San Carlos Correctional Facility in Pueblo.
The department has four levels of security for inmates, and those serving a life sentence, like Holmes, are usually classified at the highest or second-highest security level, Jacobson said. She said she couldn’t speculate on what kind of prison routine Holmes or any inmate would have.

CENTENNIAL, Colo. - Lawyers for accused Aurora theater shooter James Holmes admit in a court filing released Wednesday that he killed 12 people and wounded many other moviegoers last year.
In the filing, Holmes' lawyers say he was "in the throes of a psychotic episode" at the time of the shootings.
Holmes has pleaded not guilty by reason of insanity to 166 counts in connection with the July 20, 2012 attack at the Century 16 movie theater. He was scheduled to undergo a lengthy mental examination, as a result of his plea.
"[T]he evidence revealed thus far in the case supports the defense's position that Mr. Holmes suffers from a severe mental illness and was in the throes of a psychotic episode when he committed the acts that resulted in the tragic loss of life and injuries sustained by moviegoers on July 20, 2012," the motion states, but says other than the attack, " there is no evidence that Mr. Holmes presents a danger to the safety of the courtroom or a flight risk of any kind."
"It's not surprising. We've all known since he pleaded not guilty by reason of insanity that they were going to admit the acts," said legal analyst Dan Recht. "They're not going to dispute who did this, the question's going to be was Holmes psychotic and therefore was he insane?"

Sobbing victims told how the Colorado movie massacre gunman wrecked their lives, testifying on Monday (August 24) as a three-day hearing began at which James Holmes will be formally sentenced to life in prison with no parole.
"I went back to work after two months. I was a fryer operator for 34 years. I couldn't do my job. I couldn't concentrate," Rena Medek said, her voice choking with emotion. "I was responsible for the whole kitchen and my mind just wasn't my own. All I could think about was my daughter being shot."
Holmes, clad in red jail garb, showed no reaction as Medek described how her life had changed forever when her daughter Micayla Medek, 23, was shot and killed.
"I could barely get up and off the couch. Nothing seemed joyful. Just fear and despair. I will never be the same," she sobbed as her husband, Greg Medek comforted her.
Holmes was found guilty last month of murdering 12 people and wounding 70 in his July 2012 rampage in the Denver suburb of Aurora. Prosecutors have said about 100 victims are expected to testify at this hearing. They cannot address Holmes directly.
The jury did not reach a unanimous decision to execute Holmes for shooting up a crowded midnight screening of a Batman film, meaning the 27-year-old will get a life sentence.
While Holmes' first-degree murder convictions carry 12 automatic, consecutive life sentences with no parole, under Colorado law Arapahoe County District Court Judge Carlos Samour must formally impose the penalties.
Holmes was found guilty of 165 counts of murder, attempted murder and explosive charges, and the judge must also decide the punishment for those other offenses.
The onetime neuroscience graduate student had pleaded not guilty by reason of insanity. Prosecutors had sought the death penalty.
After the victim impact testimony, lead prosecutor George Brauchler will present his sentencing argument.
Defense lawyers can present mitigation evidence on the attempted murder convictions, but it is unclear if they will do so. It is also unknown whether Holmes will make a statement. He declined to speak in his own defense throughout the trial.
The California native could ultimately be sentenced to a maximum of 3,318 years in prison, in addition to the mandatory life sentences, prosecutors said.
