Comments by Kits residents Mike Lount and David Fine November 8, 2013 FOR IMMEDIATE RELEASE BC Supreme Court Orders City to Stop Hadden Park Bike Path Construction on Kits Point November 8, 2013 -- Vancouver, BC - The Supreme Court of British Columbia today set down an order that the Vancouver Board of Parks and Recreation and the City of Vancouver be restrained from any construction of a paved bike path running through Hadden Park on Kits Point, until a hearing can be held to determine the path's legality. A lawsuit was filed on Monday, November 4th, 2013, by Ms. Megan Carvell Davis, an historian on the park. Ms. Carvell Davis argues that the construction of the approved 12-foot wide asphalt paved bike lane through Hadden Park violates the terms under which the land was originally gifted to the city. The land on which Hadden Park sits was bequeathed to the city by Mr. Harvey Hadden in 1928, with the stipulation that Vancouver City and Park Board "shall keep the property as near as possible in its present state of nature... it being the desire of the Grantor, that those using the park, shall, as far as reasonably be, enjoy the same in its natural state and condition." In recent weeks, neighbourhood residents and other concerned citizens from across the Lower Mainland have held rallies protesting the section of the bike lane that would run through Hadden Park. Ms. Carvell Davis argues that this City-approved bike path is in direct contravention of Mr. Hadden's wishes when he deeded the space to be used as natural parkland. Legal counsel for Ms. Carvell Davis, Robert Kasting, says, "We are encouraged that the City of Vancouver and the Vancouver Park Board obtained legal advice and have consented to having an injunction in place against them. We hope that this will begin a dialogue between the Park Board and the public on how to build the Greenway Bicycle Corridor, meanwhile preserving their obligations as trustees of the Hadden Trust." The City is court-ordered to halt any construction of the bike lane through Hadden Park until the Court addresses Ms. Carvell Davis's Petition. The date of the trial is yet to be determined. Ms. Carvell Davis states, "Mr. Harvey Hadden smiles upon us today; he would be pleased to know the park he bequeathed, for all citizens, for all time, has been protected. Thank you." Ms. Carvell Davis and her legal counsel will be holding a press conference at 11:30 am, today, November 8th, 2013, in Hadden Park, located on Ogden Avenue, between Chestnut and Maple Streets, to provide further details.
