In jurisdictions following the English common law, equity is the set of maxims that "reign over all the law" and "from which flow all civil laws" (Bacon). http://howtomanageasmalllawfirm.com/ There are six key numbers that every self-respecting equity owner of a law firm should be looking at every month. Every month you should be looking at a budget, a budget variance report, a cash flow projection, an aged accounts receivables report and a cash position operating and trust. Remember these six key numbers. Once your revenues are over a million dollars then we can start talking about a balance sheet. Until your revenues are over a million dollars a balance sheet is really just a distraction. Until you get to that million dollar mark, you just need to manage the business and propel it to this point through a cash flow projection management. A decent bookkeeper, a good bookkeeper, should be able to give you these reports very easily. If your bookkeeper can't or won't give you a written budget variance report every month, a cash flow projection and six week cash flow projection you should consider getting a new bookkeeper. You need to know where you stand every month as far as revenues projected to come in, expenses projected to go out go. These are key numbers you need to be aware of, and you need a bookkeeper that will give you these numbers. I'm not saying this to be funny, I'm saying this seriously. You need a new bookkeeper! I've had this conversation with thousands of lawyers over the last 10 or 12 years and usually the problem is that the bookkeeper went to law school, in other words, usually the lawyer is being pennywise and pound foolish and trying to be their own bookkeeper. Here are a couple of tips on how to decide if you need to hire a new bookkeeper. First off, your bookkeeper is probably not very good unless they went to accounting school, have a finance degree or formally studied bookkeeping. For bookkeepers there is a very good chance that you may be a brilliant lawyer but a very bad bookkeeper. Number two, it is extremely difficult to be objective with ourselves and to hold ourselves accountable for our budget, budget variance report and our cash flow projections. That’s why the owners of the most successful solo and small law firms have an outside chief financial officer. This officer is appointed to sit there and go over the budget, variance report, cash flow projections,and make a plan based on the accounts receivables report. Once you have someone appointed to this job, you won’t go deeper and deeper with the client month after month and they owe you tons of money. You won’t have to go over the cash position in your operating account and your trust account. The way you get control over the finances of your law firm is by making the decision to plan and get help. You decide how you're going to live your life, how you're going to run your business and who can help you reach these goals. Don’t try to be your own bookkeeper. You can hire a bookkeeper in most markets today for $35, $45 an hour. As an attorney you may bill by the hour, which I don’t recommend, have a flat fee, value-based or other creative billing, either way, your time is worth much more then it would cost you to hire a bookkeeper. Being efficient, is one of the main goals every law firm should be focused on. What would take a good bookkeeper three hours takes you six. Not only does it take you a long time but you hate it. It makes you miserable, it doesn’t inspire you, it doesn’t make you excited and where do you think all of that energy goes to? It trickles over to the next time that you meet with a prospective client or a potential referral source. Get a good bookkeeper, ask the bookkeeper to watch this video. BOOK REVIEW EQUITY AND TRUSTS 8th edition By Alastair Hudson ISBN: 978 0 415 83687 6 ROUTLEDGE TAYLOR & FRANCIS GROUP www.routledge.com AN IDEAL TEXTBOOK ON TRUSTS AND EQUITY FOR THE UNDERGRADUATE, GRADUATE AND PRACTITIONER – WITH A COMPANION WEBSITE An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers Newly released by Routledge in its eighth edition, this is a book which could well prove that even a difficult area of the law can be rendered, well, considerably less difficult, even though still complex. In an erudite and clear-eyed scrutiny of equity and trusts, author Alistair Hudson, one of the acknowledged experts in this field, has obviously committed himself to shining a new light of understanding into a subject that many tend to consider dense, murky and complicated. The result, as the author explains, is a comprehensive analysis of both equity and the law of trusts suitable for undergraduate and post-graduates courses. It is also widely used by legal practitioners and has been cited in the courts of several jurisdictions. ‘This subject,’ adds Hudson ‘has everything, from birth, life, sex and lies, to vengeance, death and what comes after’. Examples abound in Jane Austen novels of young women threatened with homelessness when homes are due to be passed on to the male heir. Enter here, the power of the trust. ‘A trust’, says the author, ‘could be the protector for a young woman… or it could be the device which condemned her to penury.’ An excellent introduction to understanding the trust and the nature of equity is presented in Part 1 of this book. The nine parts which follow explain such issues as administration of trusts, trusts of homes and land, commercial and welfare uses of trust… trusts and equitable remedies… charities… and of course, much more. If you are in any way involved with this complex subject, it is important to acquire the newly minted 8th edition of this text, now fully updated and revised. In so doing you will also have access to the companion website, which contains a wealth of additional learning resources including tutorial podcasts and videos. What Riches sets out in this excellent “Optimize” book is a formidable explanation of what is readily recognized as one of the hardest legal concepts – Equity and Trusts - in easily understandable terms for what is are difficult areas of law for many to study (and teach) although it may look superficially easy to some as much is statute based! As with all the Routledge text books, this particular title is one of the best on the market giving a full introduction into the way in which equity and trusts operates in England and Wales with ‘Chapter Maps’ and sections on putting the learning into practice whereby learners can use the material throughout to good problem-answering use to maximize the marks sought. The ‘Chapter Summaries’ are also very useful allowing the learner to pull all the threads learnt together to assist the student with a strong measure of progress as the “Optimize” series develops. We also consider that this book has a much wider potential readership for anyone interested in the development of equity and trusts law as a topical area to study. One of the main reasons why we feel that the Routledge series of legal textbooks to be of outstanding value both in terms of cost and in content is the way in which their authors (all legal experts) explain substantive legal issues in such a readable fashion. For both tutors and students, a decision on which textbook or revision book to use is always difficult but it is clear to us from the feedback we have received from students that the Routledge texts lead the legal field and the Optimize series are particularly welcome. Many of their titles also have excellent links to websites sometimes marked as ‘companion websites’ as we have mentioned and they also add much assistance to the hard-pressed learner and is a great additional tool for all.
