Before passage of OBRA-87 legislation, nurse aides were allowed to work in nursing homes and skilled nursing facilities without any formal training, but the public concern, and low quality standards in the facilities for profit maximization prompted the federal authorities to pass legislation to improve the quality of care. The OBRA regulations require each state to develop state-approved nurse aide training programs, and establish minimum requirements and standards for nursing assistant competency.

The state-approved training program ranges from 75 to 175 hours. The training is divided into two parts; theoretical classroom instructions, and clinical hands-on experience.
