The legal systems of the world today are generally based on one of three basic systems: civil law, common law, and religious law – or combinations of these. However, the legal system of each country is shaped by its unique history and so incorporates individual variations.
Civil law is the most widespread system of law around the world.[citation needed] It is also sometimes known as Continental European law. The central source of law that is recognized as authoritative are codifications in a constitution or statute passed by legislature, to amend a code.
While the concept of codification dates back to the Code of Hammurabi in Babylon ca. 1790 BC, civil law systems mainly derive from the Roman Empire, and more particularly, the Corpus Juris Civilis issued by the Emperor Justinian ca. AD 529. This was an extensive reform of the law in the Byzantine Empire, bringing it together into codified documents. Civil law was also partly influenced by religious laws such as Canon law and Islamic law. Civil law today, in theory, is interpreted rather than developed or made by judges. Only legislative enactments (rather than legal precedents, as in common law) are considered legally binding.

If every one of those cases went to trial, the justice system would quickly collapse under the load. Thus, more than 96 percent of all cases end in a plea bargain.

One year has passed since the gruesome death of a mentally ill inmate at New York's notorious Riker's Island Jail. But despite the death having been ruled a suicide, no action has been taken against those responsible. The 39-year-old Bradley Ballard was simply left in his cell to die. Prison guards denied him medication until it was too late.

In American kids as young as seven years old have been tried as adults and over 2,500 children are facing life sentences. Many argue that if a child isn't old enough to drink or drive legally that they should be sparred being put on trail as an adult for committing a crime. http://democracynow.org - The U.S. Justice Department has concluded that the police and city courts in Ferguson, Missouri, routinely engaged in a pattern and practice of discrimination against African Americans. Despite comprising about 66 percent of the local population, African Americans accounted for 93 percent of arrests, 88 percent of incidents where force was used, 90 percent of citations and 85 percent of traffic stops. The Justice Department, which launched its report after the police killing of Michael Brown, also uncovered at least three municipal Ferguson emails containing racist language or images. "The report does not give me hope. What gives me hope is that people across America are finally waking up," says Michelle Alexander, author of the best-selling book, "The New Jim Crow: Mass Incarceration in the Age of Colorblindness." "There is a system of racial and social control in communities of color across America. … What we see now is that we do have the power to make things change. The question is are we going to transition from protest politics to long-term, strategic movement building?”

At the event, former Air Force Chief Prosecutor Colonel Don Christensen (Ret.), joined Senator Gillibrand and others in support of MJIA. This was be Col Christensen’s first media appearance since announcing in a New York Times Magazine cover story that he has left the Air Force after 23 years to become President of Protect Our Defenders (POD). Having served 21 years as an U.S. Air Force JAG, four as the Chief Prosecutor—the longest tenure for anyone in that position—as well as a defense attorney and a judge in a number of high profile cases, Col Christensen brings a unique perspective to the ongoing sexual assault crisis in the military, and has witnessed first hand the failures of the military justice system.

For example, it is possible that law enforcement DNA databases will expand to include millions of individuals not convicted of any crime. Moreover, depending on what rules govern access, such databases could also be used for purposes that range from determining paternity to assessing predispositions to certain diseases or behaviors. Thus the use of DNA technology will involve tough trade-offs between individual and societal interests.This book, written by a distinguished group of authors including U.S. Supreme Court Justice Stephen Breyer, explores the ethical, procedural, and economic challenges posed by the use of DNA evidence as well as future directions for the technology. After laying the conceptual historical, legal, and scientific groundwork for the debate, the book considers bioethical issues raised by the collection of DNA, including the question of control over DNA databases. The authors then turn to the possible genetic bases of human behavior and the implications of this still-unresolved issue for the criminal justice system. Finally, the book examines the current debate over the many roles that DNA can and should play in criminal justice.

AR and VR are heads up type displays that may be useful to society..
It was an idea often believed before that character building or decision making ability was a real value, and that it could be improved with exercise in character building. Research shows that decision making ability is indeed like a muscle, and that it can be improved with the right level of the best exercises, and that a person's ability to make decisions has a finite store of value, then like a tired muscle, it is to reduced avail to use it. So while this won't work 100% it would at least improve behavior.
Going after all the bad guys, like cancer cells itself is expensive since they are using up more and more of the bodies resources to defend. What if all the bad guys were removing more to good, and cured, then the whole body of society has more resources for higher justice.
The idea of what's often called justice is also that two wrongs make a right. Yet DCA often cures cancer by giving it enough energy to relax the reflex of harm and retribution to healthy cells around them..
The sweet pleasure of AR like love is like a giant river, that by love alone will sooner or later "overflow" and "cause much harm", so here I'm not saying that comfort alone is the cure for anything. Only with the distinction of truth to improve this by VR exercise would this be of worth.
If AR and VR were well used, this might be a far cheaper and far more healthy for society if a high level of worth were reached.
You may say that crime like cancer is incurable, and is never to be trusted. But if it could be cured it wouldn't be cancer. These types of behavior improving methods may change the nature of the justice system, because of shorter sentences. Many like the families of the harmed would want the "justice of vengeance" and this is natural. So while I believe most inmates could be cured, like with the worst of the fraud in the healthcare industry, only the central worst part of the problem would have to be found by e.g. truth detectors like MRI and completely rendered out. Sort of like in Germany after WWII when we stopped the worst and wisely hoped to heal the rest. Abraham Lincoln said he outlived some of his enemies, and made friends with all the rest. It may be mostly about money, and vengeance less so. The families who were harmed could be paid by the families of the wrongdoer.
AR and VR are also being considered for use by the police, mostly in stopping crime. While the majority of police no doubt are not harmful to most people, another use of value here would be for character/reflex building for the police to improve in situations when they accidentally or by anger sometimes harm innocent people.

My daughter Lauren’s wedding this year was wonderful, one of the most special days in her life and mine. But it was tinged with sadness.
For Lauren’s adored Uncle Tommy, my brother, was not there. He had been murdered by his so-called lover, a woman named Jane Andrews.
She attacked him with a cricket bat as he lay sleeping and then stabbed him through the heart.
Since that horrific day in September 2000, I have become convinced that the British justice system fails constantly in its duty to the victims of crime and their families.
I also believe that all perspective about serious crime has been lost, as murder becomes trivialised and petty offences are treated with foolish severity.
Unforgivable
That’s why I was so pleased yesterday to read the Justice Secretary Michael Gove’s declaration that our legal system — riddled with delays and inefficiencies — needs urgent reform.
He admitted that the people most badly let down by the system ‘are those who must take part in it through no fault of their own — victims and witnesses of crime, and children who have been neglected’.
The human cost, he said, was ‘unforgivable’.
I pray that Mr Gove has the willpower to see his mission through successfully.
For me, my heartbroken 87-year-old mother, my sister, our children, our grand- children, and for millions like us, nothing is more important than justice reform.
My brother’s absence has been bitterly felt at every major family event since his murder — for instance, when my grandchildren were born.
Tommy would have treasured the role of great-uncle and the children would have loved him to bits. We made a place for his memory at Lauren’s wedding, with a special moment of remembrance. But he should have been there, and the fact that he wasn’t will always hurt our family.
By a cruel irony, his killer was released from prison last Friday. The Parole Board decided that Jane Andrews — who worked as an aide to Sarah, Duchess of York, during the Nineties — had been fully rehabilitated. This influx of money to judicial elections - due in large part the Supreme Court's ruling in Citizens United - means that judges are under increasing pressure to act like politicians by avoiding damaging attack ads and burnishing their "tough on crime" bona fides at the expense of real people facing criminal prosecution. Coupled with structural inequities that critics claim make it difficult for defendants to obtain real justice, does money in judicial elections threaten the legitimacy of our criminal justice system? What doe the experiences of judges teach us about how to maintain an independent judiciary in the face of these pressures? Why America's Justice System Is Broken
"During the first half of the 20th century and into the second, the incarceration rate in America hovered around 100 people per every 100,000. Then politicians decided to get "tough on crime." By 1996 there were 427 imprisoned for every 100,000. Today, there are about 707.
Thanks to the "criminalization of everything," almost three times as many felony cases enter the court system today as they did 25 years ago. If every one of those cases went to trial, the justice system would quickly collapse under the load. Thus, more than 96 percent of all cases end in a plea bargain.
"The system isn't geared to discover innocence or guilt — it's geared to get people through the system as quickly and efficiently as possible," says John Pollok, a defense lawyer who has defended clients ranging from the mayor of Waterbury, Connecticut to members of the Gambino crime family. "What it comes down to for a defense lawyer is really to try and minimize harm."*

There is a growing consensus that America's criminal justice system is in urgent need of reform. Today, about 2.4 million people are incarcerated in the US — by far the most in any country worldwide. Another 7 million people are under probation and on parole, and 65 million have criminal records, which often make it difficult or impossible to do things like secure college loans, find housing, or vote.
The American Justice Summit is bringing together those who are championing innovative, cost-effective solutions to the problems plaguing the criminal justice system. A series of panels and conversations will explore the personal, social, and financial inequities of America's prison system — and the ways to remedy them.

Fix The Broken Military Justice System - Full Press Conference - 12/2/14
Washington DC – On Tuesday, December 2, at 10:00 AM E.T., U.S. Senator Kirsten Gillibrand (D-NY) held a press conference to discuss her bipartisan Military Justice Improvement Act (MJIA) with Susan Collins (R-ME), Barbara Boxer (D-CA), Chuck Grassley (R-IA), Richard Blumenthal (D-CT), Ted Cruz (R-TX), Mazie Hirono (D-HI) and Rand Paul (R-KY). The legislation would remove the decision to prosecute major felonies, including rape and sexual assault, from the conflicted and often-biased chain of command, and put it in the hands of professionally trained, independent prosecutors. Senator Gillibrand is leading a bipartisan coalition of Senators to reintroduce and pass MJIA as part of the National Defense Authorization Act (NDAA), which is expected to be voted on in December.
At the event, former Air Force Chief Prosecutor Colonel Don Christensen (Ret.), joined Senator Gillibrand and others in support of MJIA. This was be Col Christensen’s first media appearance since announcing in a New York Times Magazine cover story that he has left the Air Force after 23 years to become President of Protect Our Defenders (POD). Having served 21 years as an U.S. Air Force JAG, four as the Chief Prosecutor—the longest tenure for anyone in that position—as well as a defense attorney and a judge in a number of high profile cases, Col Christensen brings a unique perspective to the ongoing sexual assault crisis in the military, and has witnessed first hand the failures of the military justice system.

Is DNA technology the ultimate diviner of guilt or the ultimate threat to civil liberties? Over the past decade, DNA has been used to exonerate hundreds and to convict thousands. Its expanded use over the coming decade promises to recalibrate significantly the balance between collective security and individual freedom. For example, it is possible that law enforcement DNA databases will expand to include millions of individuals not convicted of any crime. Moreover, depending on what rules govern access, such databases could also be used for purposes that range from determining paternity to assessing predispositions to certain diseases or behaviors. Thus the use of DNA technology will involve tough trade-offs between individual and societal interests.This book, written by a distinguished group of authors including U.S. Supreme Court Justice Stephen Breyer, explores the ethical, procedural, and economic challenges posed by the use of DNA evidence as well as future directions for the technology. After laying the conceptual historical, legal, and scientific groundwork for the debate, the book considers bioethical issues raised by the collection of DNA, including the question of control over DNA databases. The authors then turn to the possible genetic bases of human behavior and the implications of this still-unresolved issue for the criminal justice system. Finally, the book examines the current debate over the many roles that DNA can and should play in criminal justice.

Fr. Michael Bryant begins by discussing the Gospel Mandate to minister to the imprisoned. Many Scriptural references, including parables and sermons given by Jesus Christ, are calls to forgive those who have wronged us or society. Fr. Bryant then goes on to explain that, although we tend to believe the U.S. justice system is “fair, impartial, and balanced,” it is too punitive and does little to promote treatment, forgiveness, and restitution for crimes. True restorative justice is making sure that the needs of offenders, victims, and victims’ families and communities are met. Fr. Bryant points to several ministries, including his Welcome Home Reentry Program, which implement true restorative justice measures. These programs attempt to rehabilitate offenders, since their criminal activities are often rooted in poor societal conditions. Those who go through these programs are encouraged to “give back” to their communities in order to right their wrongs. Models like these have proven to be much more successful than those offered by the standard criminal justice system.

Christopher Burbank is the Chief of Police for the Salt Lake City Police Department. He speaks widely on the best practices for equitable, community-oriented policing and was among those who signed the amicus brief opposing the Stop and Frisk policy in NYC.

Justice Denied (UK’s justice system the scene of corruption and injustice) Part 1
A system that has to be just and fair enough to defend the rights of individuals is a major source of injustice and corruption in itself. This series of five fact-based documentaries takes us to the real world of the so-called justice in the UK. Here we see and hear the stories of five individuals who have been subject of miscarriages in the United Kingdom. Each episode focuses on ordinary, victim people who, through misfortune or mere bad luck, had to resort to the civil or the criminal justice system in order to seek redress but have been let down. At the end of the day, we get beneath the veneer of the judicial structure of the UK, which seemingly appears efficient and accessible, but in reality, suffers from endemic shortfalls.

Dr. McDougle’s primary area of research is program evaluation, project impact and the impact of violent crime on youth and community development. Her research involves working with service-based organizations and law enforcement agencies to evaluate the efficacy of programs offered to residents in communities that suffer many of the negative consequences resulting from high levels of crime, specifically violent crime.
Dr. McDougle is an Associate Professor in the Criminal Justice program and the Advisor for Research and Training at the L. Douglas Wilder School of Government and Public Affairs at Virginia Commonwealth University. Dr. Dr. McDougle received her undergraduate degree from Randolph-Macon College in Psychology, her Master of Science fro Virginia Commonwealth University in Criminal Justice and her Ph.D. in Developmental Psychology from Virginia Commonwealth University. Dr. McDougle’s primary area of research is program evaluation, project impact and the impact of violent crime on youth and community development. Her research involves working with service-based organizations and law enforcement agencies to evaluate the efficacy of programs offered to residents in communities that suffer many of the negative consequences resulting from high levels of crime, specifically violent crime.
