Lord Janner will not face child sex abuse charges, CPS says Labour peer Lord Janner will not face child sex abuse charges because the severity of his dementia makes him unfit to stand trial, the Crown Prosecution Service (CPS) has said. The abuse allegations relate to residents in Leicestershire children's homes between 1970 and the 1980s. Police condemned the CPS decision as "wrong", and the Labour Party has suspended the 86-year-old peer. Lord Janner "is entirely innocent of any wrongdoing", his family has said. A retired High Court judge will now review the CPS's handling of the case. 'Extremely disappointing' More than a dozen individuals made allegations to police relating to Greville Janner, the CPS said. The "core allegation" was that as MP for Leicester West at the time, Lord Janner befriended the manager of a children's care home to allow him access to children so he could "perpetrate serious sexual offences on children", the CPS said. Leicestershire Police interviewed more than 2,000 people throughout the course of their investigation, and a "comprehensive file of evidence" was submitted to the CPS. In a statement, Director of Public Prosecutions Alison Saunders said there was enough evidence to charge him with: Fourteen indecent assaults on a male under 16 between 1969 and 1988 Two indecent assaults between 1984 and 1988 Four counts of buggery of a male under 16 between 1972 and 1987 Two counts of buggery between 1977 and 1988 She said the CPS were "wrong" not to prosecute the Cardiff-born peer following investigations in 1991 and 2007. "The police made the decision not to pursue Greville Janner in 2002, which again we have looked at and in our view it was wrong," she told the BBC's World at One. A complaint of historical sexual abuse against Lord Janner is reportedly being investigated by Police in Scotland. A Labour peer whose home and House of Lords office have previously been searched in connection with historic child sex abuse allegations, will not be put on trial, it has been reported. The Director of Public Prosecutions Alison Saunders is expected to announce that it would not be in the public interest to proceed with a case against Lord Greville Janner, The Times newspaper said. The Crown Prosecution Service has confirmed it will make an announcement today. Lord Janner, served as an MP for 27 years, first for Leicester North West and then Leicester West. He was made a life peer in 1997 when he retired. In March last year Lord Janner's House of Lords office was searched, but he was not arrested. In 2013 his home in Barnet, north London was raided by police. The 86-year-old father of three is a former president of the Board of Deputies of British Jews, and has been active in efforts to get compensation for Holocaust victims. On his website, he says he speaks nine languages and is a member of the Magic Circle and the International Brotherhood of Magicians.

Police in Scotland are investigating a historic abuse complaint against Labour peer Lord Janner. The investigation relates to claims that Lord Janner took a boy north of the border in the 1970s and sexually assaulted him. Police Scotland said officers are carrying out an inquiry into a historic complaint. Detective Chief Superintendent Lesley Boal said: "Police Scotland is conducting an investigation into an historic complaint and, as such, it would be inappropriate to comment. "Police Scotland is absolutely committed to preventing all forms of child abuse and to keeping children safe, while bringing perpetrators of abuse to justice, regardless of the passage of time." The Daily Mail said the alleged victim made a report at a police station in Edinburgh in 1991. A Crown Office spokesman said: "We have not received a report in relation to this matter." A Labour peer whose home and House of Lords office have previously been searched in connection with historic child sex abuse allegations, will not be put on trial, it has been reported. The Director of Public Prosecutions Alison Saunders is expected to announce that it would not be in the public interest to proceed with a case against Lord Greville Janner, The Times newspaper said. The Crown Prosecution Service has confirmed it will make an announcement today. Lord Janner, served as an MP for 27 years, first for Leicester North West and then Leicester West. He was made a life peer in 1997 when he retired. In March last year Lord Janner's House of Lords office was searched, but he was not arrested. In 2013 his home in Barnet, north London was raided by police. A former director of public prosecutions has said he was "never informed" about an investigation into historical child sex allegations against former Labour MP Lord Janner. Lord Macdonald QC said it was of "great regret" that regional Crown Prosecution Service lawyers had failed to refer the case to him in 2007. He said he would have given the allegations his "close attention". Cardiff-born peer Lord Janner, 86, has always denied any wrongdoing. The abuse allegations against the Labour peer relate to children's homes in Leicestershire in the 1970s and 80s. On Thursday, current Director of Public Prosecutions Alison Saunders announced that there was enough evidence to bring charges against Lord Janner but that this would not happen because he was now too sick to stand trial. He was diagnosed with Alzheimer's disease in 2009. Ms Saunders also said the CPS had been "wrong" not to prosecute following investigations in 1991 and 2007. On Saturday, speaking to the BBC on a visit to North Cornwall, Home Secretary Theresa May, said she was "very concerned" over the decision not to prosecute the former Labour MP. She said: "It's not my decision, it's an entirely independent decision for the director of public prosecutions. "I've been very clear, in everything I've said so far about the child sex abuse issue... that I expect to see justice done." 'Obvious errors' Speaking to BBC Radio 4's Today programme on Saturday, Lord Macdonald said he had never been notified about the 2007 police investigation, for reasons which he "did not understand". "It was apparently a serious police investigation, and it should have been absolutely clear to the lawyers in Leicestershire that this case should have been sent to London. "I would have undoubtedly taken a look at it personally, and would have undoubtedly myself have considered the question as to whether or not Lord Janner should be charged, and I very much regret that that didn't happen." The decision on whether or not Lord Janner should now face charges was "reasonably finely balanced", he said, adding: "I think you could justify a decision going either way frankly." He said he had not seen all the material relating to the case, but that "in the light of the obvious errors of the CPS in the past with this case" it might have been better to resolve it in open court. Lord Janner was first interviewed in 1991 when his name was mentioned in the trial of Frank Beck, one of Britain's most notorious paedophiles who was jailed for abusing boys in his care at Leicestershire children's homes. The politician was accused of grooming and abusing a boy aged between 13 and 15, but the CPS did not pursue the case. He was investigated again in 2002 and 2006-7 when fresh allegations surfaced, but no action was taken, and the case was dropped. In the course of its most recent investigation launched in 2013, Leicestershire Police interviewed more than 2,000 people and a "comprehensive file of evidence" was submitted to the CPS. More than a dozen individuals made allegations to police relating to Lord Janner. The "core allegation" was that as MP for Leicester West at the time, Lord Janner befriended the manager of a children's care home to allow him access to children so he could "perpetrate serious sexual offences on children", the CPS said. Lord Janner denied this allegation. He is "entirely innocent of any wrongdoing", the peer's family has said. Prosecutors said that despite having enough evidence to charge the peer with 22 sex offences, he was now too unwell to stand trial. A retired High Court judge will now review the CPS's handling of the case.

Partial text: Simon Danczuk (Rochdale) (Lab): ...My involvement with the Crown Prosecution Service in recent years has mainly focused on the failure to prosecute child sex abusers. We know that in the 1960s, 70s and 80s people like Cyril Smith and Victor Montagu were allowed to continue to abuse children because the CPS was unable or unwilling to bring cases against them, even when it had the evidence. It is a legacy that should shame the CPS and the entire justice system, but these failures are not just a thing of the past. The case of Lord Janner is an interesting case study of the workings of the modern day CPS and its attitude towards alleged child abusers. We know that the CPS failed to press for prosecution of Lord Janner in 1991, 2002 and 2006, and the current Director of Public Prosecutions, Alison Saunders, has admitted that he should have been prosecuted. Now we hear that he cannot face justice because he is too ill. Before discussing the case in detail, I want to make the point that we cannot underestimate the effect that failed prosecutions have on the survivors of abuse. There are many people— Mrs Anne Main (in the Chair): Order. I caution the hon. Gentleman against discussing the case of Lord Janner in detail, rather than discussing the process of the Crown Prosecution Service. I am sure that he will stay completely in order, but I am just careful to ensure that he discusses the Crown Prosecution Service and its relationship to the case, rather than the case against Lord Janner itself. That is on advice from the Clerks. Simon Danczuk: I understand that, Mrs Main. Although there is no case against Lord Janner— Mrs Anne Main (in the Chair): No, it is not sub judice. There is no case against Lord Janner, but it is a long-established practice of the House not to criticise Members of the other House except on a substantive motion. I will let the hon. Gentleman carry on and, if he does not mind, I will jump in if I think he is going off piste, so to speak. Simon Danczuk: Thank you, Mrs Main. I always appreciate your guidance in these matters. The CPS’s failure to prosecute cases can have a real impact and can be extremely damaging. Research shows that child sexual abuse victims die on average 20 years early: they may commit suicide, become alcoholic or drug dependent, or just struggle to cope with life because of what has been done to them by their abusers. We know that abuse victims die in their 30s, 40s or 50s, while their abusers live into their 70s or 80s. Such a failing by the CPS also reduces the public’s faith in the justice system. It discourages people from reporting child sexual abuse because they think the CPS will say that the victims are unreliable; that it is not in the public interest; or, as in the case of Lord Janner, that the alleged perpetrator is too ill. Most importantly, failure by the CPS emboldens the perpetrators of child abuse. When the CPS failed to prosecute Cyril Smith in the 1960s, he went on to abuse for decades; and when the CPS failed to prosecute the Rochdale grooming gang in the early 2000s, it carried on raping Girl A for years afterwards. Poor white working class boys were considered unreliable witnesses in the 1960s in relation to Cyril Smith. Fast forward and poor white working class girls were considered unreliable witnesses in the 2000s. Returning to the case of Lord Janner, the shocking thing is that the CPS admits that the witnesses are not unreliable. It admits that Janner should face prosecution, but refuses to bring a case. I know the police are furious about this, and rightly so. Anyone who has heard the accusations would be similarly outraged. I have met Leicestershire police and discussed the allegations in some detail: children being violated, raped and tortured, some in the very building in which we now sit. The official charges are: 14 indecent assaults on a male under 16 between 1969 and 1988; two indecent assaults between ’84 and ’88; four counts of buggery of a male under 16 between ’72 and ’87; and two counts of buggery between 1977 and 1988. My office has spoken to a number of the alleged victims and heard their stories. I cannot overstate the effect that this abuse has had on their lives. To sum up, I want to make the following points about the case. If Lord Janner really is too ill to face prosecution, why cannot the courts establish this with a fitness-to-plead process? This would clear up doubts that still linger. For example, why was he still visiting Parliament on official visits after he was declared unfit to face justice? Why is he able to contribute to the law-making process in the House of Lords, but unable to face the law himself?
