Ji Myung-kil explains. A sweeping anti-corruption law will go into effect starting as early as September next year,... after an 18-month grace period. But critics are already calling for revisions. One concern, they say, is that an individual can be charged under both the anti-corruption law and criminal law. "The criminal statute allows for the punishment of those who receive bribes in exchange for favors... and the anti-corruption law allows for the punishment of a person who takes money or gifts in the amount specified regardless of the existence of a favor. That could lead to a double punishment for a single person." Another stickler is that the law does not have a clause that allows for the punishment of those who give bribes or ask for favors. Public figures who receive bribes worth more than 900 U.S. dollars can be jailed for up to three years or fined up to five times the value of the money or gifts received. The law was originally aimed at rooting out corruption within the government, but was expanded to apply to other individuals with public influence such as teachers and journalists. What can also be disconcerting, according to critics, is the possible strengthening of the prosecution′s power,... such as the possibility of abusing its investigative powers,... especially where politicians or CEOs are concerned. "Prosecutors will be able to exploit their authority using the anti-corruption law, as it makes it easier for investigations to be conducted with little proof... since the law says a recipient can be punished even in the absence of a favor." Some lawmakers have also raised concerns that the law is unfair because it does not include civic groups, which are seen as the largest interest groups within society. Ji Myung-kil, Arirang News.

In most developed countries, adultery is not a criminal offense, but that′s not the case in Korea, just yet. Korea′s Constitutional Court has already rejected petitions four times in the past,... with the rationalization being: it could weaken social morality. But that notion is being challenged again... and the answer is set to come out tomorrow. Sohn Jung-in tells us more. Back in 2008, Korean actress Ok So-ri filed a petition with the Constitutional Court challenging the application of criminal law to adultery. She had been sued by her husband for having an affair. She challenged the constitutionality of the law by arguing that a person should have the right to choose the person who they want to love. But the court rejected the appeal, and after an ugly battle with her now ex-husband, a local court sentenced her to eight months in prison. Seven years has passed since then, but the debate on whether adultery is constitutional or not is still a hot potato in Korea. The law is under review once again after a number of individuals filed petitions in the wake of the Ok case, and the court is to issue its ruling on Thursday. Four appeals have been brought before the top court since 1990, but each time the law was ruled constitutional. However, the latest request by Ok in 2008... was short of one vote to overturn the statute, with the number of judges saying the law is unconstitutional surpassing those who didn′t for the first time. More than six of nine justices must agree to repeal the law. Adultery has been seen as a criminal offense in Korea for over 60 years. It remains to be seen whether the criminality of what many see as a private matter will be overturned in Thursday′s ruling. Sohn Jung-in, Arirang News.

The Examiner 2015-04-19Constitutionality is the condition of acting in accordance with an applicable constitution; the status of a law, a procedure, or an act's accordance with the laws or guidelines set forth in the applicable constitution. When one of these (laws, procedures, or acts) directly violates the constitution it is unconstitutional. All the rest are considered constitutional until challenged and declared otherwise.
An act (or statute) enacted as law either by a national legislature or by the legislature of a subordinate level of government (such as a state or province) may be declared unconstitutional.
However, governments do not just create laws. Governments also enforce the laws set forth in the document defining the government -- in the Constitution. In the United States, the failure to seat duly elected representatives of the people following a proper election, or the failure to provide for such elections would be unconstitutional even in the absence of any legislated laws whatsoever.
When the proper court determines that a legislative act (a law) conflicts with the constitution, it finds that law unconstitutional and declares it void in whole or in part. This is called judicial review. The portion of the law that is declared void is considered to be struck down, or the entire statute is considered to be struck from the statute books.
The Police Federation of England and Wales is the representative body to which all police officers in England and Wales up to and including the rank of Chief Inspector belong. There are 141,000 members as of July 2009. Members can elect not to pay subscriptions and thereby not receive the legal representation and other benefits that paying members receive, but they still continue officially to be members of the federation. In reality only a very few officers have ever decided not to pay their full subscription dues. Superintendents have their own association, the Police Superintendents' Association of England and Wales, whilst the Association of Chief Police Officers represents the most senior ranks.
The Police Federation of England and Wales was set up by the Police Act 1919 after two police strikes. The government of the day were frightened by the prospect of the police going on strike and created the Police Federation of England and Wales and withdrew the right of officers in the UK to strike.
