The power is more likely to be exercised on behalf of establishment political figures, not outsiders. The power is more likely to be exercised when it is consistent with the politics of the administration.

Cleveland Mayor Jackson, Vanita Gupta, the head of the Department of Justice’s Civil Rights Division, and Cleveland Police Chief Calvin Williams spoke about the new deal.

The U.S. Justice Department says nine soccer officials are among 14 people indicted on corruption charges for allegedly accepting bribes and kickbacks estimated at more than $150 million dollars over a 24-year period. The 47-count indictment against these individuals includes charges of racketeering, wire fraud, and money laundering that shut out competitors and kept lucrative contracts for themselves. U.S. Attorney General Loretta Lynch commented that these soccer officials violated the integrity of the game.
The schemes involving the fraud included the selection of South Africa as the host of the 2010 World Cup, the 2011 FIFA presidential elections and several sports marketing deals. The Justice Department has gotten involved because the alleged crimes were agreed to and prepared in the United States through U.S. bank accounts.
Law enforcement have raided the FIFA headquarter in Zurich,Switzerland and the North American headquarters in Miami, Florida and seized electronic data and documents. Investigators concluded there was not enough evidence to charge Ferguson police Officer Darren Wilson in the shooting death of Brown, a black teenager who was unarmed.
Justice Department officials did find a widespread pattern of unconstitutional abuse committed by the Ferguson police department, including the use of unreasonable stops and force on minority members of the community.
Michael Brown’s parents said Wednesday they were “saddened” and “disappointed” by the decision.
Attorney General Eric Holder said about not charging officer Darren Wilson, “I…know these findings may not be consistent with some people’s expectations.”
The Justice Department’s report on police in Ferguson showed that the “implicit and explicit racial bias” displayed officers there helped foster the unhappy environment that exploded into international view last summer after a police officer shot and killed an unarmed 18-year-old, Attorney General Eric H. Holder Jr. said Wednesday.
Frenzied demonstrations and confrontations between police and protesters dominated the streets of Ferguson after Darren Wilson, a white police officer, shot and killed Michael Brown in August. Seven months after the shooting, which sparked a national conversation on race and policing in the United States, the Justice Department released what Holder described as a “searing” report delving into the city’s police force.
The report highlighted repeated examples of bias in law enforcement and described a system that seemed to be built upon using arrest warrants to force money out of black residents. In addition, the Justice Department also pointed to several racist e-mails written by police and municipal court supervisors and highlighted numerous allegations of physical and bigoted activity on the part of officers.
“Seen in this context, amid a highly toxic environment, defined by mistrust and resentment, stoked by years of bad feelings and spurred by illegal and misguided practices, it is not difficult to imagine how a single tragic incident set off the city of Ferguson like a powder keg,” Holder said during a news conference Wednesday afternoon in Washington, D.C.
In Ferguson, it has become “routine” for officers to violate the constitutional rights of residents, he said. This behavior deepens the distrust that residents say has long existed, as encounters between police and residents “frequently and rapidly escalate and end up blatantly and unnecessarily crossing the line,” he said.
He described the investigation as fair, thorough and rigorous, and vowed to continue working with people in Ferguson and surrounding municipalities, calling the report “only the beginning” of a necessary process. After the Justice Department issued similarly harsh reports on the police departments of Cleveland and Albuquerque last year, city officials in both places reached settlements with the department and promised that reforms would follow.
Holder said that the Justice Department “reserves all of its rights and abilities” to force changes in Ferguson, a reminder that if city officials and federal officials are not able to negotiate a settlement, a federal lawsuit could follow.
“It is time for Ferguson’s leaders to take immediate, wholesale and structural corrective action,” he said Wednesday.

Michael Brown’s parents said Wednesday they were “saddened” and “disappointed” by the decision.

The Justice Department’s report on police in Ferguson showed that the “implicit and explicit racial bias” displayed officers there helped foster the unhappy environment that exploded into international view last summer after a police officer shot and killed an unarmed 18-year-old, Attorney General Eric H. Holder Jr. said Wednesday.
Frenzied demonstrations and confrontations between police and protesters dominated the streets of Ferguson after Darren Wilson, a white police officer, shot and killed Michael Brown in August. Seven months after the shooting, which sparked a national conversation on race and policing in the United States, the Justice Department released what Holder described as a “searing” report delving into the city’s police force.
The report highlighted repeated examples of bias in law enforcement and described a system that seemed to be built upon using arrest warrants to force money out of black residents. In addition, the Justice Department also pointed to several racist e-mails written by police and municipal court supervisors and highlighted numerous allegations of physical and bigoted activity on the part of officers.

Cleveland police excessive force is the result of inadequate training, equipment, policies and engagement.
The department found concerns about search-and-seizure practices and systemic issues behind reckless and excessive force findings. Cleveland has inadequate policies to hold officers accountable.
Cleveland police have been under the microscope since the deadly chase from two years ago and most recently with the shooting of 12-year-old Tamir Rice .
But the focus of this investigation began with the Nov. 29, 2012 police chase and shooting of Timothy Russell and Malissa Williams. They led police on a 23-minute high-speed chase that ended with a shootout in the parking lot of Heritage Middle School in East Cleveland. Thirteen officers fired 137 shots.

Today the Justice Department announced that it was levying fines against some of the world's major banks for rigging the foreign-exchange markets. The fines announced totaled $2.8 billion. Yes, I know that's a lot of money, but the reality is it's just the cost of doing business for these banks.

The US Department of Justice has announced the arrest of a Chinese professor and the indictment of five other Chinese nationals over an alleged plot to steal trade secrets from two electronics manufacturers which design delicate electronic parts for iPhones.

Today the Justice Department announced that it was levying fines against some of the world's major banks for rigging the foreign-exchange markets. The fines announced totaled $2.8 billion. Yes, I know that's a lot of money, but the reality is it's just the cost of doing business for these banks.
If the Justice Department really wants to get serious on this issue I think they should put some of these bankers in jail, that's what they fear the most - not the money fines. Jail time is the answer to stamping out the illegal activity and white collar crime.
Meanwhile, Citigroup Inc. (NYSE:C), a stock I discussed last week as a buy, is practically unchanged for the day and remains higher for the week. The fines levied by the Justice Department against the banks were like water off a duck's back.
In today's video, I'm going to be looking at all the major markets including the three major indices. I will also be looking at gold, crude oil and the euro and time permitting, one or two stocks.

Paris Bank Forfeits Billions to US in Sanctions Violations
A huge Paris-based bank, BNP Paribas, has forfeited some $8.8 billion to the U.S. Department of Justice after it was convicted of handling funds in violation of U.S. sanctions against Iran, Cuba and Sudan.
Now U.S. justice officials are considering whether to use part of that forfeiture to compensate people harmed by the three governments.
New York State banking regulators, who worked alongside federal authorities on the BNP case, say BNP cleared more than $190 billion involving Iran, Cuba and Sudan from 2002 through 2012. State regulators also say the bank intentionally hid information from those transactions that would identify their source.
U.S. Attorney Preet Bharara said BNP Paribas engaged in “the hat trick of sanctions violations.” The prosecutor said the bank engaged in what he called “a tour de fraud.”
The forfeiture by BNP, fourth-largest bank in the world, became official on May 1 when the financial house was sentenced in federal court. It agreed on June 30, 2014 that it would give up the cash when it admitted guilt in the sanctions violations.
Then-U.S. Attorney General Eric Holder underscored the seriousness of the bank’s criminal activity.
“BNP Paribas went to really elaborate lengths to conceal prohibited transactions, cover its tracks, and deceive U.S. authorities,” Holder said, adding “These actions represent a serious breach of U.S. law.”
'Satellite banks'
The U.S. criminal complaint against BNP says it set up a network of so-called “satellite banks” to try to disguise both the origins and destinations of financial transactions.
BNP CEO Jean-Laurent Bonnafé admitted its role in a 2014 statement.
“We deeply regret that past misconduct that led to this settlement," he said
The Justice Department said earlier this month that it will be using the funds to compensate "persons and entities" harmed by the Cuban, Iranian, and Sudanese regimes.
"In an effort to better understand who may have been harmed by these regimes, the Justice Department is inviting individuals or their representatives to provide information describing the nature and value of the harm they suffered,” the department said in a statement.
Washington-based international attorney Steven Schneebaum said the settlement route could be complex.
“In the case of financial claims — expropriations, breached contracts, that sort of thing — the process would not be all that complicated,” he told VOA via e-mail.
“In the case of claimed deaths or unjust imprisonment, I imagine that the Department would apply lost earnings and pain-and-suffering guidelines that already exist [insurance companies use them routinely, and so do domestic courts in personal injury cases],” he wrote.
Attorney Heather Lowe with the better-governance and transparency group Global Financial Integrity, says that at least in the case of Sudan, group reparations are the best course of action.
“I'm not sure that individual claims is the right way to go about this,” Lowe told VOA via e-mail, “because you are talking about harms that were inflicted on an entire society; because the bank contributed to ensuring that a brutal regime continued to have access to funds to keep its soldiers paid, weapons supplied, etc.”
As for claims against the Cuban government, Schneebaum says that “is likely to be very contentious.
"Many Americans have already had their Cuban claims vetted by the FCSC [the Justice Department’s Foreign Claims Settlement Commission], and they have been waiting for a long time to receive anything," she said. "They will scream loudly if newcomers are allowed to jump the BNP ‘queue."
Claims involving Iran may face the same scrutiny, experts say
“An Iranian national whose company was nationalized by the ayatollahs in 1980 would have no justifiable claim in the U.S.: under U.S. law, s/he was not the victim of an illegal act. It is hard to see why such a person, who would not be allowed to file a lawsuit to vindicate his claim, should be rewarded in the United States,” attorney Schneebaum said.

Attorney Heather Lowe with the better-governance and transparency group Global Financial Integrity, says that at least in the case of Sudan, group reparations are the best course of action.
“I'm not sure that individual claims is the right way to go about this,” Lowe told VOA via e-mail, “because you are talking about harms that were inflicted on an entire society; because the bank contributed to ensuring that a brutal regime continued to have access to funds to keep its soldiers paid, weapons supplied, etc.”
As for claims against the Cuban government, Schneebaum says that “is likely to be very contentious.

According to the indictment, Pang and Zhang met while studying electrical engineering at University of Southern California and took jobs as engineers at Avago and Skyworks, respectively.

In March 2014, a California businessman was convicted of stealing DuPont trade secrets to help a state-owned Chinese company develop a white pigment used in a wide range of products.

(Washington, DC) – Judicial Watch today announced that, based on information uncovered through a Judicial Watch public records lawsuit against the City of Phoenix, the U.S. Congress has confirmed that an AK 47 rifle used in a July 29, 2013, gang-style assault on an apartment building that left two people wounded was part of the Obama Department of Justice (DOJ) Operation Fast and Furious gunrunning program.
An October 16 letter sent from Sen. Charles Grassley (R-IA) and Rep. Darryl Issa (R-CA) to Deputy Attorney General James Cole discloses that “we have learned of another crime gun connected to Fast and Furious. The [Justice] Department did not provide any notice to the Congress or the public about this gun.” Grassley (Ranking Member on the Senate Judiciary Committee) and Issa (Chairman of the House Oversight and Government Reform Committee) detail:
Based on the serial number [1977DX1654] from the police report obtained by Judicial Watch and documents obtained during our Fast and Furious investigation, we can confirm that the assault rifle recovered in the vehicle on July 30, 2013, was purchased by Sean Christopher Stewart. Stewart pled guilty to firearms trafficking charges resulting from his involvement with Operation Fast and Furious … Stewart purchased this particular firearm on December 8, 2009, one of 40 that he purchased that day while under ATF surveillance” (emphasis in original document).

The D.C. court was right — the government won’t start issuing grand jury subpoenas every time someone writes “my husband left underwear on the bathroom floor again; I could just kill him.” But they won’t because they don’t have the time, inclination, or the resources.
Instead, they will use their discretion to decide when to bring their vast power into play to pierce the anonymity of internet assholes (or for that matter, people who may have valid points on political matters but express them in the wrong fashion). That discretion is much more likely to be exercised where, as here, the person being trash-talked is a powerful federal judge in the district of that U.S. Attorney’s Office, a judge that the office must appear before every damned day. The power is more likely to be exercised on behalf of establishment political figures, not outsiders. The power is more likely to be exercised when it is consistent with the politics of the administration.

Department Of Justice Goes After Ferguson Police Department
"The lawsuit would move forward if the Missouri city doesn’t agree to fix alleged police tactics that involve racial discrimination.
The Department of Justice has been conducting a months-long investigation into Ferguson following the death of Michael Brown in August. According to CNN, the results of the investigation will allege that there has been a pattern of discrimination by the city’ s police force.
Details about the alleged discrimination were not immediately available, but CNN and Politico — which reported Tuesday on a possible DOJ case — both cited a recent lawsuit alleging that police targeted minorities for minor traffic violations and jailed them for not paying fines. That lawsuit was filed by St. Louis-area legal non-profit Arch City Defenders and argues that Ferguson, along with nearby Jennings, are relying on what amount to debtor’ s prisons.
However, Arch City Defenders Executive Director Thomas Harvey told BuzzFeed News in an email Wednesday that the “Politico narrative is completely misleading” and he does not know what the DOJ plans to do.
“To be clear, I have no information about the DOJ ’s intention,” Harvey wrote. “ I have no idea if they intend to take any action against Ferguson or any other town. They didn’ t say one way or the other.”
Additional details were not immediately available Wednesday and the Justice Department did not respond to BuzzFeed News’ request for comment."

The U.S. Justice Department says nine soccer officials are among 14 people indicted on corruption charges for allegedly accepting bribes and kickbacks estimated at more than $150 million dollars over a 24-year period. The 47-count indictment against these individuals includes charges of racketeering, wire fraud, and money laundering that shut out competitors and kept lucrative contracts for themselves. U.S. Attorney General Loretta Lynch commented that these soccer officials violated the integrity of the game.
The schemes involving the fraud included the selection of South Africa as the host of the 2010 World Cup, the 2011 FIFA presidential elections and several sports marketing deals. The Justice Department has gotten involved because the alleged crimes were agreed to and prepared in the United States through U.S. bank accounts.
Law enforcement have raided the FIFA headquarter in Zurich,Switzerland and the North American headquarters in Miami, Florida and seized electronic data and documents. FIFA president Sepp Blatter was not among the accused. FIFA Director of Communications Walter De Gregorio said that this is a good thing for FIFA.

Investigators concluded there was not enough evidence to charge Ferguson police Officer Darren Wilson in the shooting death of Brown, a black teenager who was unarmed.
Justice Department officials did find a widespread pattern of unconstitutional abuse committed by the Ferguson police department, including the use of unreasonable stops and force on minority members of the community.
Michael Brown’s parents said Wednesday they were “saddened” and “disappointed” by the decision.
Attorney General Eric Holder said about not charging officer Darren Wilson, “I…know these findings may not be consistent with some people’s expectations.”
The Justice Department’s report on police in Ferguson showed that the “implicit and explicit racial bias” displayed officers there helped foster the unhappy environment that exploded into international view last summer after a police officer shot and killed an unarmed 18-year-old, Attorney General Eric H. Holder Jr. said Wednesday.
Frenzied demonstrations and confrontations between police and protesters dominated the streets of Ferguson after Darren Wilson, a white police officer, shot and killed Michael Brown in August. Seven months after the shooting, which sparked a national conversation on race and policing in the United States, the Justice Department released what Holder described as a “searing” report delving into the city’s police force.
The report highlighted repeated examples of bias in law enforcement and described a system that seemed to be built upon using arrest warrants to force money out of black residents. In addition, the Justice Department also pointed to several racist e-mails written by police and municipal court supervisors and highlighted numerous allegations of physical and bigoted activity on the part of officers.
“Seen in this context, amid a highly toxic environment, defined by mistrust and resentment, stoked by years of bad feelings and spurred by illegal and misguided practices, it is not difficult to imagine how a single tragic incident set off the city of Ferguson like a powder keg,” Holder said during a news conference Wednesday afternoon in Washington, D.C.
In Ferguson, it has become “routine” for officers to violate the constitutional rights of residents, he said. This behavior deepens the distrust that residents say has long existed, as encounters between police and residents “frequently and rapidly escalate and end up blatantly and unnecessarily crossing the line,” he said.
He described the investigation as fair, thorough and rigorous, and vowed to continue working with people in Ferguson and surrounding municipalities, calling the report “only the beginning” of a necessary process. After the Justice Department issued similarly harsh reports on the police departments of Cleveland and Albuquerque last year, city officials in both places reached settlements with the department and promised that reforms would follow.
Holder said that the Justice Department “reserves all of its rights and abilities” to force changes in Ferguson, a reminder that if city officials and federal officials are not able to negotiate a settlement, a federal lawsuit could follow.
“It is time for Ferguson’s leaders to take immediate, wholesale and structural corrective action,” he said Wednesday.

The investigation found Cleveland police "engage in poor and dangerous tactics," including shootings and also excessive use of less lethal force, including Tasers.
Cleveland police excessive force is the result of inadequate training, equipment, policies and engagement.
The department found concerns about search-and-seizure practices and systemic issues behind reckless and excessive force findings. Cleveland has inadequate policies to hold officers accountable.
Cleveland police have been under the microscope since the deadly chase from two years ago and most recently with the shooting of 12-year-old Tamir Rice .
But the focus of this investigation began with the Nov. 29, 2012 police chase and shooting of Timothy Russell and Malissa Williams. They led police on a 23-minute high-speed chase that ended with a shootout in the parking lot of Heritage Middle School in East Cleveland. Thirteen officers fired 137 shots.

Hey, It's Just The Cost Of Doing Business
Hey, It's Just The Cost Of Doing Business
Today the Justice Department announced that it was levying fines against some of the world's major banks for rigging the foreign-exchange markets. The fines announced totaled $2.8 billion. Yes, I know that's a lot of money, but the reality is it's just the cost of doing business for these banks.
If the Justice Department really wants to get serious on this issue I think they should put some of these bankers in jail, that's what they fear the most - not the money fines. Jail time is the answer to stamping out the illegal activity and white collar crime.
Meanwhile, Citigroup Inc. (NYSE:C), a stock I discussed last week as a buy, is practically unchanged for the day and remains higher for the week. The fines levied by the Justice Department against the banks were like water off a duck's back.
In today's video, I'm going to be looking at all the major markets including the three major indices. I will also be looking at gold, crude oil and the euro and time permitting, one or two stocks.

Paris Bank Forfeits Billions to US in Sanctions Violations
Paris Bank Forfeits Billions to US in Sanctions Violations
A huge Paris-based bank, BNP Paribas, has forfeited some $8.8 billion to the U.S. Department of Justice after it was convicted of handling funds in violation of U.S. sanctions against Iran, Cuba and Sudan.
Now U.S. justice officials are considering whether to use part of that forfeiture to compensate people harmed by the three governments.
New York State banking regulators, who worked alongside federal authorities on the BNP case, say BNP cleared more than $190 billion involving Iran, Cuba and Sudan from 2002 through 2012. State regulators also say the bank intentionally hid information from those transactions that would identify their source.
U.S. Attorney Preet Bharara said BNP Paribas engaged in “the hat trick of sanctions violations.” The prosecutor said the bank engaged in what he called “a tour de fraud.”
The forfeiture by BNP, fourth-largest bank in the world, became official on May 1 when the financial house was sentenced in federal court. It agreed on June 30, 2014 that it would give up the cash when it admitted guilt in the sanctions violations.
Then-U.S. Attorney General Eric Holder underscored the seriousness of the bank’s criminal activity.
“BNP Paribas went to really elaborate lengths to conceal prohibited transactions, cover its tracks, and deceive U.S. authorities,” Holder said, adding “These actions represent a serious breach of U.S. law.”
'Satellite banks'
The U.S. criminal complaint against BNP says it set up a network of so-called “satellite banks” to try to disguise both the origins and destinations of financial transactions.
BNP CEO Jean-Laurent Bonnafé admitted its role in a 2014 statement.
“We deeply regret that past misconduct that led to this settlement," he said
The Justice Department said earlier this month that it will be using the funds to compensate "persons and entities" harmed by the Cuban, Iranian, and Sudanese regimes.
"In an effort to better understand who may have been harmed by these regimes, the Justice Department is inviting individuals or their representatives to provide information describing the nature and value of the harm they suffered,” the department said in a statement.
Washington-based international attorney Steven Schneebaum said the settlement route could be complex.
“In the case of financial claims — expropriations, breached contracts, that sort of thing — the process would not be all that complicated,” he told VOA via e-mail.
“In the case of claimed deaths or unjust imprisonment, I imagine that the Department would apply lost earnings and pain-and-suffering guidelines that already exist [insurance companies use them routinely, and so do domestic courts in personal injury cases],” he wrote.
Attorney Heather Lowe with the better-governance and transparency group Global Financial Integrity, says that at least in the case of Sudan, group reparations are the best course of action.
“I'm not sure that individual claims is the right way to go about this,” Lowe told VOA via e-mail, “because you are talking about harms that were inflicted on an entire society; because the bank contributed to ensuring that a brutal regime continued to have access to funds to keep its soldiers paid, weapons supplied, etc.”
As for claims against the Cuban government, Schneebaum says that “is likely to be very contentious.
"Many Americans have already had their Cuban claims vetted by the FCSC [the Justice Department’s Foreign Claims Settlement Commission], and they have been waiting for a long time to receive anything," she said. "They will scream loudly if newcomers are allowed to jump the BNP ‘queue."
Claims involving Iran may face the same scrutiny, experts say
“An Iranian national whose company was nationalized by the ayatollahs in 1980 would have no justifiable claim in the U.S.: under U.S. law, s/he was not the victim of an illegal act. It is hard to see why such a person, who would not be allowed to file a lawsuit to vindicate his claim, should be rewarded in the United States,” attorney Schneebaum said.
