The National Security Agency has grown in power since the 9-11 terrorist attacks. The secretive spy agency has faced scandals during two successive presidential administrations, first under President George W. Bush, and now under President Barack Obama. But the NSA's bulk collection of Americans' metadata began long before that, at the beginning of President Ronald Reagan's administration. In 1981, Reagan signed Executive Order 12333, which mandates the duties and foreign intelligence collection abilities of the 17 intelligence agencies in the US. The order is the superior authority guiding intelligence operations, including the ability to function outside the confines of a warrant or a court order upon approval of the attorney general. The US National Security Agency collects cellphone location data from around the world under a 1981 executive order signed by former president Ronald Reagan. Although Congress never authorized Executive Order 12333, the NSA said on Friday that the massive data collection does not violate the Foreign Intelligence Surveillance Act, which authorizes warrantless wiretapping by the spy agency, according to The Hill. NSA spokeswoman Vanee Vines said in a statement on Friday legal restrictions under the intelligence law still apply to the cellphone tracking. The spokeswoman said the agency "tries to avoid" collecting Americans' cellphone location information. "Again, the Agency's EO 12333 collection is outward-facing. We are not intentionally acquiring domestic information through this capability," she said. The Washington Post reported on Wednesday that the NSA collects almost 5 billion cellphone records a day, enabling the agency to track individuals' movements and map their relationships. Top-secret documents leaked by former NSA contractor Edward Snowden reveal that new projects have been created to analyze the huge amounts of data, providing the US intelligence community with an unimaginable mass surveillance tool. The scale, scope and potential impact of the new leaks put this spying tool on top of all the other NSA surveillance programs exposed since June. NSA agents can find cellphones anywhere in the world, retrace their movements and expose hidden relationships among individuals using them. "The paths that we travel every day can reveal an extraordinary amount about our political, professional, and intimate relationships," Catherine Crump, an attorney for the American Civil Liberties Union, said in a statement Wednesday after the NSA program was revealed.- published: 07 Dec 2013

US government sued over global spying activities
The American Civil Liberties Union has filed a lawsuit against the administration of President Barack Obama to force it to release more information about its spying activities. Alongside with the Media Freedom and Information Access Clinic at Yale Law School, the ACLU, which works to protect Americans' constitutional liberty, filed a Freedom of Information Act lawsuit on Monday urging the White House to disclose basic information about Executive Order 12,333, which governs US spying activities outside the country. "Although EO 12,333 permits the government to target foreigners abroad for surveillance, recent revelations have confirmed that the government interprets that authority to permit sweeping monitoring of Americans' international communications," read the complaint filed in federal court in New York. "How the government conducts this surveillance, and whether it appropriately accommodates the constitutional rights of American citizens and residents whose communications are intercepted in the course of that surveillance, are matters of great public significance and concern," it added. Documents after documents disclosed by American whistleblower Edward J. Snowden since June have shown how the National Security Agency collects phone records of all American citizens and tracks the use of US-based Web servers by all people around the world. Snowden's leaks have also showed the US government eavesdropped on phone calls of at least 35 world leaders, spied on Russia's leadership with the help of Sweden, and spied on the 2010 G8 and G20 summits in Toronto as well as the 2009 G20 summit in London with the help of the host countries' governments. The ACLU says that despite recent revelations, there is "still a crucial gap in our basic understanding" of such activities. "For instance, recent news reports indicate that, relying on the executive order, the NSA is collecting: nearly 5 billion records per day on the location of cell phones, including Americans' cell phones; hundreds of millions of contact lists or address books from personal email and instant messaging accounts; and information from Google and Yahoo user accounts as that information travels between those companies' data centers located abroad," the lawsuit pointed out. The ACLU said that spying conducted under the executive order is of particular concern because it is not overseen by US lawmakers and the Foreign Intelligence Surveillance Court, also known as the FISA court.- published: 31 Dec 2013

Edward Snowden y la NSA The National Security Agency The National Security Agency/Central Security Service (NSA/CSS) leads the U.S. Government in cryptology that encompasses both Signals Intelligence (SIGINT) and Information Assurance (IA) products and services, and enables Computer Network Operations (CNO) in order to gain a decision advantage for the Nation and our allies under all circumstances. The Information Assurance mission confronts the formidable challenge of preventing foreign adversaries from gaining access to sensitive or classified national security information. The Signals Intelligence mission collects, processes, and disseminates intelligence information from foreign signals for intelligence and counterintelligence purposes and to support military operations. This Agency also enables Network Warfare operations to defeat terrorists and their organizations at home and abroad, consistent with U.S. laws and the protection of privacy and civil liberties. Executive Order 12333, originally issued 4 December 1981, delineates the NSA/CSS roles and responsibilities. In part, the Director, NSA/Chief, CSS is charged to: • Collect (including through clandestine means), process, analyze, produce, and disseminate signals intelligence information and data for foreign intelligence and counterintelligence purposes to support national and departmental missions; • Act as the National Manager for National Security Systems as established in law and policy, and in this capacity be responsible to the Secretary of Defense and to the Director, National Intelligence; • Prescribe security regulations covering operating practices, including the transmission, handling, and distribution of signals intelligence and communications security material within and among the elements under control of the Director of the National Security Agency, and exercise the necessary supervisory control to ensure compliance with the regulations. EO 12333 was amended on 31 July 2008 in order to: • Align EO12333 with the Intelligence Reform and Terrorism Prevention Act of 2004; • Implement additional recommendations of the 9/11 and WMD Commissions; • Further integrate the Intelligence Community and clarify and strengthen the role of the DNI as the head of the Community; • Maintain or strengthen privacy and civil liberties protections. WASHINGTON (AP) - The National Security Agency on Friday said its tracking of cellphones overseas is legally authorised under a sweeping US presidential order. The distinction means the extraordinary surveillance program is not overseen by a secretive US intelligence court but is regulated by some US lawmakers, Obama administration insiders and inspectors general. Documents obtained from former NSA contractor Edward Snowden showed that the NSA gathers as many as 5 billion records every day about the location data for hundreds of millions of cellphones worldwide by tapping into cables that carry international cellphone traffic. The Washington Post said the collection inadvertently scoops up an unknown amount of US data as well. The NSA said Friday it was not tracking every foreign phone call and said it takes measures to limit how much US data is collected. The NSA has declined to provide any estimates about the number of Americans whose cellphones it has tracked because they were traveling overseas or their data was irrevocably included in information about foreigners' cellphones. "It is not ubiquitous," NSA spokesman Vanee Vines said in a statement. "NSA does not know and cannot track the location of every cell phone."
