Others believe that the law is the most important part. Yet still others think that which judge you get assigned to is the most important part of your case. Some injured victims believe which expert you hire is the most important part of your case. In reality, these are all partially correct. Then again, they are all partially incorrect. When you bring a lawsuit seeking compensation for the harms and losses you suffered because of someone else's carelessness or negligence and your case goes to trial, THE MOST important part of your case is your credibility. How believable are you? Is what you are saying more likely right than wrong? Are there inconsistencies in your testimony? Are those inconsistencies significant? Are the other witnesses who are testifying in your trial believable? Are they credible? There is a specific legal instruction here in NY that the judge will give the jury at the end of your trial. This legal instruction basically says that if you find a witness has testified falsely about one thing, you are permitted to disregard all of his testimony. Legally, that's known as “Falsus in Uno.” That is a very powerful legal instruction focusing only on whether the jury believes a witness at trial. If a witness has testified falsely, this legal instruction gives the jury the right, if they choose, to disregard all of that witness's testimony.
