In Irish society, the courts and the law were largely libertarian, and operated within a purely stateless manner. This society persisted in this libertarian path for roughly a thousand years until its brutal conquest by England in the seventeenth century. And, in contrast to many similarly functioning primitive tribes (such as the Ibos in West Africa, and many European tribes), preconquest Ireland was not in any sense a "primitive" society: it was a highly complex society that was, for centuries, the most advanced, most scholarly, and most civilized in all of Western Europe. A leading authority on ancient Irish law wrote, "There was no legislature, no bailiffs, no police, no public enforcement of justice... There was no trace of State-administered justice."
1. "They certainly had access to both gold and silver from native sources; they traveled abroad and knew the monetary usages of their neighbors; and the metalworkers capable of creating such masterpieces as the Tara brooch or the Ardagh chalice were certainly capable of striking coins...The essentially libertarian nature of Irish society can also be seen in the fact that the native Irish never issued coinage." http://mises.org/journals/lf/1971/1971_04.pdf
2. "In addition, cities and walled towns were brought to Ireland by invaders; the early Irish people did not have these places of mass congregation that supported cities and marketplaces." http://www.daviddfriedman.com/Academ...%20Osborne.htm
3. Property rights in Irish law: http://mises.org/journals/jls/1_2/1_2_1.pdf
4. "While a comprehensive survey of the Irish law of property and property rights cannot yet be written, we can already see that the idea of private ownership permeates those aspects of the law which have been subjected to recent study. The Irish frankly and openly used assessments of property as the criterion for determining a man's social and legal status, the extent of his capacity to act as a surety or compurgator, and to fix the amounts of compensation due him as a victim of crime or any kind of injury..." http://books.google.com/

Kevin Flanagan discusses Ireland's ancient Brehon Laws on the Hill of Uisneach, Westmeath, as part of the Uisneach Fire Festival 2015 (uisneach.ie).
'Brehon Law' refers to an ancient system of justice that was prevalent in Ireland for 1000's of years prior to its conquest. Hailed as a true justice system this restituionary based approach for justice rested with the very will of the people.
Uisneach Hill is among Ireland's most sacred ancient sites. For millennia Druids, Warriors, Poets, and Kings gathered at this Hill as a place of ceremony, worship, and the pronouncement of important laws and customs. Its primary feast was Bealtaine or the Festival of the Bright-Fire, where all fires in all the land were left extinguished on May 1st only for the first great fire of Summer to be lit by the Druids upon Uisneach Hill. Representatives of Clans and Tuatha from all over the land would travel here to gather fire and embers. Bringing these to their homelands every fire in the country was then said to have been lit by the first fire of Summer.
Here, Kevin Flanagan discusses the Brehon Law, Irish mythology, the rights of women in early Ireland, and the need to consider the old ways for guidance in today's uncertain world.

Civil law (legal system)
Civil law (or civilian law) is a legal system originating in Europe, intellectualized within the framework of late Roman law, and whose most prevalent feature is that its core principles are codified into a referable system which serves as the primary source of law. This can be contrasted with common law systems whose intellectual framework comes from judge-made decisional law which gives preceden

In my view there are 6 types of societies in regard to the state:
1. Pre-state society: A society whose members are of a mentality that they can form states de novo, but don't due to a lack of food surplus or are in the process of state formation (like Harappa). State formation takes longer in more spread out areas.
2. Early State Society: Where people actually worship the state and believe the state - through a king, priest, or whoever - to actually be qualitatively superior to everyone else and fit to dictate. Usually it was believed they were channeling the will of god.
3. Modern State Society: A society with a cynical "realist" view that there's nothing special about a state, it's just necessary to maintain order (Here's looking at you dipshit!). This comes from states having been around as far back as anyone can remember.
4. De facto stateless society: A society that doesn't have a centralized law-making agency but whose people fit the mentality of the modern state society. Examples of this are stateless Pennsylvania and Rhode island and various areas cascading through the mild west.
5. Stateless Society: A society of people who don't view states as legitimate and so treat them with the same skepticism they would any other firm. Thus, realizing they're bullshit, don't form states de novo. Examples of this are Somalia, Ireland and Iceland.
6. Ideologically Anti-Statist Society: A society of people who recognize the state as a positive BAD and oppose the state. Unfortunately, the only examples of this are the anarchists who couple their anti-statism with pre-marginalist LTV bugaboos and various other inane "anti-authoritarian" baubles.
In some times and places people will regress from #3 to #2. The most obvious regression is Nazi Germany and perhaps Italy. Revolutionary periods appear to be prone to this regression from Modern to Early state mentalities.
I believe the revolution in the USSR was a regression from a modern state - russians didn't like the czar but thought that order needed to be maintained somehow, and then when the communists started taking over the general mentality shifted back to an early state mentality.
Ironically, Spain and Russia, despite being economically backward, seemed to have somewhat modern mentalities prior to revolution. The Nationalist victory in Spain, in my estimation, prevented further regression, as the nationalists actually lacked majority support (though not to the same degree as the czarists in Russia). And so more Spaniards supported the Communists than Nationalists, but the state was now Nationalist, which means most Spaniards were NOT worshipping Franco, meaning Spain was slightly in the Modern State Society category. IMO this limited the mass-killings the Franco Regime could get away with. If the communists won, Spain would have been more in the Early State category and would have drifted more that way as propaganda and public schooling took effect, resulting in the megadeaths of similar population proportion as in Germany and the USSR.

Civil law (or civilian law) is a legal system originating in Europe, intellectualized within the framework of late Roman law, and whose most prevalent feature is that its core principles are codified into a referable system which serves as the primary source of law. This can be contrasted with common law systems whose intellectual framework comes from judge-made decisional law which gives precedential authority to prior court decisions on the principle that it is unfair to treat similar facts differently on different occasions (doctrine of judicial precedent ; stare decisis).
Historically, a civil law is the group of legal ideas and systems ultimately derived from the Code of Justinian, but heavily overlaid by Napoleonic, Germanic, canonical, feudal, and local practices, as well as doctrinal strains such as natural law, codification, and legal positivism.

This video explains for the first time in the European Archeology ( Pena Grana 2011) the reason why throughout all Celtic Europe there is a common Celtic Law [and Political Organization, Science, and Metrology, etc].
This was possible due to the existence of a vertically organized powerfull Celtic clergy, ruled by a visible and infallible head. A clergy integrated by the second sons of the greatest noble families of Europe , trained in a common area and discipline, in prestigious international seminars .Este video explica pela primeira vez na Arqueologia Européia (André Pena Granha 2011) o motivo pelo que todo o direito, público e privado Celta, bem como a ciência e a metrología, etc., é comum em toda a Europa Celta.
Obrigado
