On Monday, November 15, 2004, a New York State courts officer was ordered to the home of Peter and Joan Porco. Peter, a 52-year-old State Appellate Division court clerk, had not reported to his Albany office for work that morning. Upon entering the two-story home at 36 Brockley Drive, the officer discovered Peter's lifeless blood-soaked body near the front door. An Albany County medical examiner would determine that Peter had sustained massive fatal head injuries.[2] Joan Porco was soon discovered by police officers lying in the couple's blood-drenched bed, and had suffered severe head and facial trauma. She would lose her left eye and a portion of her skull.

The National Labor Relations Board (NLRB) is an independent agency of the United States government charged with conducting elections for labor union representation and with investigating and remedying unfair labor practices. Unfair labor practices may involve union-related situations or instances of protected concerted activity. The NLRB is governed by a five-person board and a General Counsel, all of whom are appointed by the President with the consent of the Senate. Board members are appointed to five-year terms and the General Counsel is appointed to a four-year term. The General Counsel acts as a prosecutor and the Board acts as an appellate judicial body from decisions of administrative law judges. As of 2013, the NLRB is headquartered at 1099 14th Street NW, Washington, D.C with over 30 regional, sub-regional, and residential offices throughout the U.S. In April 2009, President Obama nominated Craig Becker (Associate General Counsel of the Service Employees International Union), Mark Gaston Pearce (a member on the Industrial Board of Appeals, an agency of the New York State Department of Labor), and Brian Hayes (Republican Labor Policy Director for the Senate Committee on Health, Education, Labor and Pensions) to fill the three empty seats on the NLRB.[75] Becker's nomination appeared to fail on February 8, 2010, after Republican Senators (led by John McCain) threatened to filibuster his nomination.[77][84] President Obama said he would consider making recess appointments to the NLRB due to the Senate's failure to move on any of the three nominations.[84] On March 27, 2010 Obama recess appointed Becker and Pearce.[85] On June 22, 2010, a voice vote in the Senate confirmed Pearce to a full term, allowing him to serve until August 27, 2013. The same day, the Senate confirmed Republican nominee Brian Hayes of Massachusetts by voice vote. Flynn, and Richard Griffin.[89] The appointments were criticized by Republicans, including the House Speaker John Boehner, as unconstitutional and a brazen attempt to undercut the role of the Senate to advise and consent the executive branch on appointments.[90] Although made as recess appointments, critics questioned their legality, arguing that Congress had not officially been in recess as pro forma sessions had been held.[91] Former U.S. attorney general Edwin Meese stated that in his opinion, since the appointments were made when the Senate was demonstrably not in recess they represented a constitutional abuse of a high order.[92] On January 12, 2012 the U.S. Justice Department released a memo stating that appointments made during pro forma sessions are supported by the Constitution and precedent.[93] On January 25, 2013, a panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled that President Obama's recess appointments were invalid as they were not made during an intersession recess of the Senate. How Judges Decide Cases: Inside the Judicial Decision-Making Process - Lawyers & Jury Trials (1990) The judiciary (also known as the judicial system' or court system) is the system of courts that interprets and applies the law in the name of the state. The judiciary also provides a mechanism for the resolution of disputes. Under the doctrine of the separation of powers, the judiciary generally does not make law (that is, in a plenary fashion, which is the responsibility of the legislature) or enforce law (which is the responsibility of the executive), but rather interprets law and applies it to the facts of each case. This branch of the state is often tasked with ensuring equal justice under law. It usually consists of a court of final appeal (called the Supreme court or Constitutional court), together with lower courts. In many jurisdictions the judicial branch has the power to change laws through the process of judicial review. Courts with judicial review power may annul the laws and rules of the state when it finds them incompatible with a higher norm, such as primary legislation, the provisions of the constitution or international law. Judges constitute a critical force for interpretation and implementation of a constitution, thus de facto in common law countries creating the body of constitutional law. In the US during recent decades the judiciary became active in economic issues related with economic rights established by constitution because economics may provide insight into questions that bear on the proper legal interpretation.[3] Since many countries with transitional political and economic systems continue treating their constitutions as abstract legal documents disengaged from the economic policy of the state, practice of judicial review of economic acts of executive and legislative branches have begun to grow. In the 1980s, the Supreme Court of India for almost a decade had been encouraging public interest litigation on behalf of the poor and oppressed by using a very broad interpretation of several articles of the Indian Constitution.[4] Budget of the judiciary in many transitional and developing countries is almost completely controlled by the executive. The latter undermines the separation of powers, as it creates a critical financial dependence of the judiciary. The proper national wealth distribution including the government spending on the judiciary is subject of the constitutional economics. It is important to distinguish between the two methods of corruption of the judiciary: the state (through budget planning and various privileges), and the private.[5] The term judiciary is also used to refer collectively to the personnel, such as judges, magistrates and other adjudicators, who form the core of a judiciary (sometimes referred to as a bench), as well as the staffs who keep the system running smoothly. In common law jurisdictions, courts interpret law, including constitutions, statutes, and regulations. They also make law (but in a limited sense, limited to the facts of particular cases) based upon prior case law in areas where the legislature has not made law. For instance, the tort of negligence is not derived from statute law in most common law jurisdictions. The term common law refers to this kind of law. In civil law jurisdictions, courts interpret the law, but are prohibited from creating law, and thus do not issue rulings more general than the actual case to be judged. Jurisprudence plays a similar role to case law. In the United States court system, the Supreme Court is the final authority on the interpretation of the federal Constitution and all statutes and regulations created pursuant to it, as well as the constitutionality of the various state laws; in the US federal court system, federal cases are tried in trial courts, known as the US district courts, followed by appellate courts and then the Supreme Court. State courts, which try 98% of litigation,[9] may have different names and organization; trial courts may be called courts of common plea, appellate courts superior courts or commonwealth courts.[10] The judicial system, whether state or federal, begins with a court of first instance, is appealed to an appellate court, and then ends at the court of last resort.[11] In France, the final authority on the interpretation of the law is the Council of State for administrative cases, and the Court of Cassation for civil and criminal cases. In the People's Republic of China, the final authority on the interpretation of the law is the National People's Congress. Other countries such as Argentina have mixed systems that include lower courts, appeals courts, a cassation court (for criminal law) and a Supreme Court. The Supreme Court of the United States is the highest judicial body in the United States. Its membership consists of the Chief Justice of the United States and eight associate justices. The justices are nominated by the President of the United States and appointed after confirmation by the United States Senate. Justices of the Supreme Court have life tenure and receive a salary which is set at $255,500 per year for the chief justice and at $244,400 per year for each associate justice as of 2014. On August 7, 2010, Justice Elena Kagan became the 112th justice to serve on the Court. The Supreme Court was created in 1789 by Article III of the United States Constitution, which stipulates that the "judicial Power of the United States, shall be vested in one supreme Court" together with any lower courts Congress may establish.[1] Congress organized the Court that year with the passage of the Judiciary Act of 1789. It specified the Court's original and appellate jurisdiction, created thirteen judicial districts, and fixed the number of justices at six (one chief justice and five associate justices).[6][7] Since the passage of the Judiciary Act, Congress has occasionally altered the size of the Supreme Court, historically in response to the country's own expansion in size. Membership was decreased in 1801 to five, then increased to seven members in 1807, to nine in 1837, and to ten in 1863. It was then reduced to seven in 1866. In 1869, Congress set the Court's size to nine members, where it has remained since.[8] While the justices of the Supreme Court are appointed for life, some choose to retire: a total of 54 have retired or resigned.
