Employment equity, as defined in Canadian law by the Employment Equity Act, requires employers to engage in proactive employment practices to increase the representation of four designated groups: women, people with disabilities, Aboriginal peoples, and visible minorities. The Act states that "employment equity means more than treating persons the same way but also requires special measures and the accommodation of differences."
The Act requires that employers remove barriers to employment that disadvantage members of the four designated groups. Examples of employment barriers are wheelchair inaccessible buildings, that create a physical barrier to people with disabilities, or practices that make some people feel uncomfortable, such as holding management meetings in strip clubs. The term reasonable accommodation is often used for the removal of such barriers to employment. Employers are also required to institute positive policies and practices for the hiring, training, retention and promotion of members of the designated groups. Positive policies include good hiring practices, for example, asking all job candidates the same interview questions, or advertising a job widely and in places where it is likely to reach female or minority applicants.

Rising inequality is a key focus in today’s policy discussions and media discourse. Building on research from The Institute for New Economic Thinking at the Oxford Martin School (INET Oxford), Professor Brian Nolan, Director of the Employment, Equity and Growth Programme at INET Oxford and Professor John Muellbauer, Deputy Director of Economic Modelling at INET Oxford, will consider the causes and consequences of inequality, and what can be done to address it.

Building on the author’s work for British Women Archaeologists, this paper will begin by discussing the fight for equal access to Higher Education, before turning to employment conditions in the Heritage Sector. The paper will consider the issues of sexism in the workplace, maternity and paternity rights, as well as gendered networking, mentoring, and promotion – all factors contributing to a gender pay gap of £2,149 per year; with women often working below their skills level and leaving the sector in their 30s. The paper ends with a series of solutions for us to take forward, in the year that the Equality Challenge Unit introduces the new Gender Equality Charter Mark for the Humanities and Social Sciences (the equivalent of Athena SWAN). As a newly chartered profession, will we create a CIfA that is committed to working pro-actively to achieve employment equity.

Black economic empowerment and employment equity measures have not made much headway in undoing apartheid's legacy in South Africa, and racial criteria in university admissions in the USA have been greatly contested in the courts.

This panel will examine intergenerational equity issues raised by employment discrimination laws, including those protecting the elderly from discrimination. Those laws, minimum wage laws, laws favoring unionization, and laws countering arbitrary dismissal have obvious appeal. But many of those very laws greatly raise the costs to business of entry-level hiring. One consequence may be that many young people are only able to enter the work force as interns or fellows. This may be especially true for minorities. Are these costs worth the benefits? Is there some middle ground?

The ANC government has been addressing this legacy of disadvantage and injustice through job creation programmes, progressive legislation and legal reform. The Employment Equity Act of 1998 is an example, obliging employers to implement affirmative action measures to ensure equal representation of designated groups (black people, women and people with disabilities). However, in the last 16 years since the Act was implemented, there has been disappointment, disillusion and frustration about the slow pace of transformation. The Constitutional Court landmark ruling during the last week in the case Ms Renate Barnard vs The National Commissioner of the SAPS has put this issue on its head.

Building on the author’s work for British Women Archaeologists, this paper will begin by discussing the fight for equal access to Higher Education, before turning to employment conditions in the Heritage Sector. The paper will consider the issues of sexism in the workplace, maternity and paternity rights, as well as gendered networking, mentoring, and promotion – all factors contributing to a gender pay gap of £2,149 per year; with women often working below their skills level and leaving the sector in their 30s. The paper ends with a series of solutions for us to take forward, in the year that the Equality Challenge Unit introduces the new Gender Equality Charter Mark for the Humanities and Social Sciences (the equivalent of Athena SWAN). As a newly chartered profession, will we create a CIfA that is committed to working pro-actively to achieve employment equity.

This episode of Rights and Recourse we are discussing the Employment Equity Act with strong emphasis on Affirmative Action.
A defining feature of the South African labour market is the disparity in access to and quality employment. Apartheid education and labour policies produced a strong racial gradient in unemployment, employment and wage rates. The ANC government has been addressing this legacy of disadvantage and injustice through job creation programmes, progressive legislation and legal reform. The Employment Equity Act of 1998 is an example, obliging employers to implement affirmative action measures to ensure equal representation of designated groups (black people, women and people with disabilities). However, in the last 16 years since the Act was implemented, there has been disappointment, disillusion and frustration about the slow pace of transformation. The Constitutional Court landmark ruling during the last week in the case Ms Renate Barnard vs The National Commissioner of the SAPS has put this issue on its head.

Affirmative action to advance equality is a controversial issue in many countries. Black economic empowerment and employment equity measures have not made much headway in undoing apartheid's legacy in South Africa, and racial criteria in university admissions in the USA have been greatly contested in the courts.
This video shows a panel discussion which aimed to answer the question, "Does Affirmative Action Create Unfair Advantage?" To answer this, the panelists explored the advantages and disadvantages of affirmative action policies favouring certain disadvantaged groups, as well as the British approach to positive duties.
The panel discussion took place in June 2014 at University College London and was chaired by Sir Bob Hepple QC. Panelists include Trustees from the Equal Rights Trust: Dr Gay McDougall, Helen Mountfield QC, Judge Kate O’Regan, as well as Dr Dimitrina Petrova, Executive Director of the Trust.
