Madison police chief Larry Muncey announced on Thursday that officer Eric Parker will be fired, hours after the victim Sureshbhai Patel filed a federal lawsuit through an attorney . The lawsuit says Patel, who is still in hospital, suffered injuries, including partial paralysis, after Parker stopped him and tripped him to the ground even as he was explaining he knew very little English and tried to indicate he was visiting his son nearby. Madison police concluded from its investigation into the incident that the officer's actions "did not meet the high standards and expectations" of his department, chief Muncey said, while apologizing to Patel, his family, and the community . Muncey added that the FBI was conducting a "parallel inquiry to ascertain if there were any federal violations". Indian consular officials visited Patel in the hospital after New Delhi took note of the brutal attack, which was cap tured on police's own videos. Video and audio feed recorded on police dash-cam showed the officer patting down Patel after stopping him on the sidewalk and suddenly throwing him to the ground, face down, with great force.Patel is then handcuffed and dragged and lifted to his feet, but his knees keep collapsing and he is unable to stand. Police also released audio of a non-emergency call to police, in which a neighbour describes Patel as a "skinny black guy" and says that he'd "never seen him before" in the neighbourhood. He says Patel was "just wandering around" the area and "walking close to the garage", not peeping into garages as police initially suggested. When asked to estimate Patel's age, the caller guesses it to be in the 30's. In a lawsuit against the Madison police department, Patel's lawyer Hank Sherrod has alleged that his client's constitutional civil rights were violated and he is seeking unspecified damages. "Right now our aim to ensure Patel recovers well and we're happy to report that he is making good progress," Sherrod told TOI on Friday , adding that they were yet to discuss any figure. He also clarified that Patel did not have to be a US citizen or even a permanent resident to initiate a civil rights lawsuit. Patel is a Green Card holder. Patel, who does not have health insurance cover in the US, has undergone cervical fusion surgery to relieve pressure on his spinal cord and has regained some feeling in his arms and one leg. Sherrod said doctors were pleased with the pace of his recovery and his client was motivated to improve quickly . A fund that was established on Thursday to help cover the cost of his medical care raised $46,000 (at the time of writing) of a $ 100,000 target. Meanwhile, many of Madison's citizens spoke up on various forums for Patel and against the aggressive policing practices in the US. "Police culture of `Subdue, Detain and Arrest First -get the facts later' must change," said one concerned resident, while a second writer described it as "Another example of an idiot with a gun and a badge on a power trip.
