Surrogacy is an arrangement in which a woman carries and delivers a child for another couple or person. This woman, the surrogate mother, may be the child's genetic mother (called traditional surrogacy), or she may be genetically unrelated to the child (called gestational surrogacy).
If the surrogate receives compensation beyond the reimbursement of medical and other reasonable expenses, the arrangement is called commercial surrogacy, otherwise it is often referred to as altruistic surrogacy.
In a traditional surrogacy the child may be conceived via home artificial insemination using fresh or frozen sperm or impregnated via IUI (intrauterine insemination), or ICI (intracervical insemination) performed at a health clinic.
A gestational surrogacy requires the implantation of a previously created embryo, and for this reason the process always takes place in a clinical setting.
The intended parent or parents, sometimes called the social parents, may arrange a surrogate pregnancy because of homosexuality, female infertility, or other medical issues which make pregnancy or delivery impossible, risky or otherwise undesirable. The intended parent may also be a single man wishing to have his/her own biological child, or a single woman unable to take a pregnancy to full-term. The sperm or eggs may be provided by the 'commissioning' parents, but donor sperm, eggs and embryos may also be used.
Baby M (born March 27, 1986) was the pseudonym used In re Baby M, 537 A.2d 1227, 109 N.J. 396 (N.J. 02/03/1988) for the infant whose legal parentage was in question.
"In re Baby M" was a custody case that became the first American court ruling on the validity of surrogacy. William Stern and his wife, Elizabeth Stern, entered into a surrogacy agreement with Mary Beth Whitehead, whom they found through a newspaper advertisement. According to the agreement, Mary Beth Whitehead would be inseminated with William Stern's sperm (making her a traditional, as opposed to gestational, surrogate), bring the pregnancy to term, and relinquish her parental rights in favor of William's wife, Elizabeth. After the birth, however, Mary Beth decided to keep the child. William and Elizabeth Stern then sued to be recognized as the child's legal parents.
The New Jersey court ruled that the surrogacy contract was invalid according to public policy, recognized Mary Beth Whitehead as the child's legal mother, and ordered the Family Court to determine whether Whitehead, as mother, or Stern, as father, should have legal custody of the infant, using the conventional 'best interests of the child' analysis. Stern was awarded custody, with Whitehead having visitation rights.
Marissa Jaret Winokur (born February 2, 1973), sometimes credited as Marissa Winokur, is an American actress known for her performance as Tracy Turnblad in the highly successful Broadway musical adaptation of John Waters' film Hairspray, as well as her work on the Pamela Anderson sitcom Stacked. Winokur was born in New York City, the daughter of Maxine, a teacher, and Michael Winokur, an architect. She is Jewish. Winokur was a cheerleader and captain of her high school soccer team at Fox Lane High School. She later studied at The American Musical and Dramatic Academy, graduating from the integrated program.
