In many common law jurisdictions (e.g. the Republic of Ireland, Canada, Hong Kong, India, Australia, New Zealand), an indictable offence is an offence which can only be tried on an indictment after a preliminary hearing to determine whether there is a prima facie case to answer or by a grand jury (in contrast to a summary offence). In the United States, a crime of similar severity is a felony, although it too proceeds after an indictment.

In relation to England and Wales, the expression "indictable offence" means an offence which, if committed by an adult, is triable on indictment, whether it is exclusively so triable or triable either way; and the term "indictable", in its application to offences, is to be construed accordingly. In this definition, references to the way or ways in which an offence is triable are to be construed without regard to the effect, if any, of section 22 of the Magistrates' Courts Act 1980 on the mode of trial in a particular case.

An either way offence allows the defendant to elect between trial by jury on indictment in the Crown Court and summary trial in the Magistrates' Court. However, the election may be overruled by the Magistrates' Court if the facts suggest that the sentencing powers of a Magistrates' Court would be inadequate to reflect the seriousness of the offence.

Julia Eileen Gillard (born 29 September 1961) is the 27th and current Prime Minister of Australia, in office since 24 June 2010.

Gillard was born in Barry, Wales and migrated with her family to Adelaide, Australia in 1966, attending Mitcham Demonstration School and Unley High School. In 1982 Gillard moved to Melbourne. She graduated from the University of Melbourne with Bachelor of Arts and Bachelor of Laws degrees in 1986. In 1987, Gillard joined the law firm Slater & Gordon working in industrial law, before entering politics.

Gillard was elected at the 1998 federal election to the House of Representatives seat of Lalor, Victoria, for the Australian Labor Party. Following the 2001 federal election, Gillard was elected to the shadow cabinet with the portfolios of Population and Immigration. The Reconciliation and Indigenous Affairs and the Health portfolios were added in 2003. In December 2006, Kevin Rudd was elected Labor leader and Leader of the Opposition, with Gillard as deputy leader.
