Mumia has been transferred to general prison population
As of 1/27/12, Mumia Abu-Jamal has officially been transferred to General Prison Population after being held in Administrative Custody ("The Hole" or Solitary Confinement) at SCI Mahanoy, Frackville, PA for 7 weeks. This is the first time Mumia has been in General Population since his arrest in 1981.

This comes within hours of the of delivery of over 5,500 signed petitions to Department of Corrections headquarters in Camp Hill, PA and a compliant filed with the support of United Nations Special Rapporteur on Torture, Juan Mendez.

PLEASE NOTE that while this is a victory in transferring Mumia out of the torturous Restricted Housing Unit (RHU), we call upon the closure of ALL restricted housing units. Furthermore, we call upon the IMMEDIATE RELEASE of Mumia Abu-Jamal and are not disillusioned by this transfer.

My Friends of OWS,|

My message will have to be brief. But let not this brevity take from it, its strength.

You are the central movement of the hour. You're raising questions that are in the hearts of millions. Your motto, "We are the 99%," has been heard, heeded, and responded to by millions. You can be certain that the 1% have heard you clearest of all.

Your work, however, is just beginning. You must deepen, strengthen, and further your work until it truly reaches the 99%, almost all of us: workers, Black folk, Latinos and Latinas, LGBTs, immigrants, Asians, artists, all of us, for we are integral parts of the 99%. I salute you and hope fervently that you will grow beyond number.

Though I speak to you today by proxy, I'm confident that you will hear my voice soon.

Supreme Court ruling
on Mumia Abu-Jamal

Today the United States Supreme Court rejected a request from the Philadelphia District Attorney’s Office to overturn the most recent federal appeals court decision declaring Mumia Abu-Jamal’s death sentence unconstitutional. The Court’s decision brings to an end nearly thirty years of litigation over the fairness of the sentencing hearing that resulted in Mr. Abu-Jamal’s being condemned to death. Mr. Abu-Jamal will be automatically sentenced to life in prison without the possibility of parole unless the District Attorney elects to seek another death sentence from a new jury.

The NAACP LDF and Professor Judith Ritter represent Mr. Abu-Jamal in the appeal of his conviction and death sentence for the 1981 murder of a police officer in Philadelphia. The Supreme Court’s decision marks the fourth time that the federal courts have found that Mr. Abu-Jamal’s sentencing jury was misled about the constitutionally mandated process for considering evidence supporting a life sentence.

“At long last, the profoundly troubling prospect of Mr. Abu-Jamal facing an execution that was produced by an unfair and unreliable penalty phase has been eliminated,” said John Payton, Director-Counsel of LDF. “Like all Americans, Mr. Abu-Jamal was entitled to a proper proceeding that takes into account the many substantial reasons why death was an inappropriate sentence.” Professor Ritter stated, “Our system should never condone an execution that stems from a trial in which the jury was improperly instructed on the law.”

Mr. Abu-Jamal’s case will now return to the Philadelphia County Court of Common Pleas for final sentencing.

Troy was found guilty of murdering a police officer 19 years ago, based upon the testimony of 9 witnesses. Since then 7 of those 9 recanted their testimony entirely, and there are enormous problems with the testimony of the remaining 2 witness accounts. There is NO OTHER EVIDENCE. The murder weapon was never found. There was no DNA to test. Troy was killed by lethal injection on September 21, 2011.

To All:

I want to thank all of you for your efforts and dedication to Human Rights and Human Kindness, in the past year I have experienced such emotion, joy, sadness and never ending faith. It is because of all of you that I am alive today, as I look at my sister Martina I am marveled by the love she has for me and of course I worry about her and her health, but as she tells me she is the eldest and she will not back down from this fight to save my life and prove to the world that I am innocent of this terrible crime.

As I look at my mail from across the globe, from places I have never ever dreamed I would know about and people speaking languages and expressing cultures and religions I could only hope to one day see first hand. I am humbled by the emotion that fills my heart with overwhelming, overflowing Joy. I can't even explain the insurgence of emotion I feel when I try to express the strength I draw from you all, it compounds my faith and it shows me yet again that this is not a case about the death penalty, this is not a case about Troy Davis, this is a case about Justice and the Human Spirit to see Justice prevail.

I cannot answer all of your letters but I do read them all, I cannot see you all but I can imagine your faces, I cannot hear you speak but your letters take me to the far reaches of the world, I cannot touch you physically but I feel your warmth everyday I exist.

So Thank you and remember I am in a place where execution can only destroy your physical form but because of my faith in God, my family and all of you I have been spiritually free for some time and no matter what happens in the days, weeks to come, this Movement to end the death penalty, to seek true justice, to expose a system that fails to protect the innocent must be accelerated. There are so many more Troy Davis'. This fight to end the death penalty is not won or lost through me but through our strength to move forward and save every innocent person in captivity around the globe. We need to dismantle this Unjust system city by city, state by state and country by country.

I can't wait to Stand with you, no matter if that is in physical or spiritual form, I will one day be announcing,

"I AM TROY DAVIS, and I AM FREE!"

Mumia Abu-Jamal’s 1982 Death Sentence is Again Declared Unconstitutional

(New York, NY) —The United States Court of Appeals for the Third Circuit has unanimously declared that Mumia Abu-Jamal’s death sentence is unconstitutional. In today’s decision, the Court of Appeals reaffirmed its 2008 finding that Mr. Abu-Jamal’s sentencing jury was misled about the process forconsidering evidence supporting a life sentence. The Court found that, in violation of the United States Supreme Court’s 1988 decision in Mills v. Maryland, the jury was improperly led to believe that that it could only consider unanimously agreed upon evidence favoring a life verdict.

This mistake rendered Mr. Abu-Jamal’s death sentence fundamentally unfair.The NAACP Legal Defense & Educational Fund, Inc. (LDF) and Professor Judy Ritterof Widener Law School represent Mr. Abu-Jamal in this appeal of his 1982 conviction and death sentence for the murder of a police officer in Philadelphia, Pennsylvania.

“This decision marks an important step forward in the struggle to correct the mistakes of an unfortunate chapter in Pennsylvania history,” said John Payton, Director-Counsel of LDF. “Again acknowledging the existence of clear constitutional error in Mr. Abu-Jamal’s trial, the Court of Appeals’ decision enhances confidence in the criminal justice system and helps to relegate the kind of unfairness on which this death sentence rested to the distant past.”

Prof. Ritter noted that, “Pennsylvania long ago abandoned the confusing and misleading instructions and verdict slip that were relied on in Mr. Abu-Jamal’s trial in order to prevent unfair and unjust death sentences. Courts now use clear and unambiguous language to advise sentencing juries about their ability to consider evidence that favors a life verdict. Mr. Abu-Jamal is entitled to no less constitutional protection.”

Mr. Abu-Jamal he has been on death row in Pennsylvania for 29 years.

More than 500 people rally on Tuesday, November 9 in Philadelphia
More than 500 people, mostly African Americans and youth, mobilized for a noontime outdoor rally Nov. 9 in support of Mumia Abu-Jamal. The rally lasted through a hearing of the Third Circuit Court of Appeals that argued on whether the death sentence would be reinstated against Mumia, who has maintained his innocence since being railroaded to death row in 1982. The court’s ruling will be announced at a later date. Supporters for Mumia included a delegation from the Transport Workers Union Local 100; Charles Barron, the New York gubernatorial candidate for the Freedom Party; Free Mumia Coalition (NYC), International Concerned Family and Friends of Mumia Abu-Jamal and the International Action Center. Washington (CNN) -- The Supreme Court has tossed out a lower court ruling that nullified the death sentence for former Black Panther Mumia Abu-Jamal. He has been an outspoken activist from behind bars, claiming there were procedural errors during his capital sentencing, and that too few blacks were on the jury. Pennsylvania officials were appealing a federal court ruling on the sentencing question that went in Abu-Jamal's favor in 2008.

The justices made their announcement Monday, ordering a federal appeals court to revisit its earlier ruling granting a new sentencing hearing. The high court last year denied Abu-Jamal's separate petition for a new trial.

The appeals court now has the option of re-imposing the death sentence or ordering a new federal trial to hear other claims of injustice raised by Abu-Jamal.

Legal update on Mumia's case - Grave danger presists

Today, on Dec. 14, 2009, the U.S. Supreme Court has taken its last decisions for this year, taking X-mas holidays till January 11, the day it will officially resume its work.

Surprisingly, in the case of my client Mumia Abu-Jamal the Supreme Court hasn't yet taken a decision whether he will live and get a new jury trial determing his sentence, or whether he will die under the hands of the executioner. Actually, we had won a partial victory last year before the U.S. Appeals Court since the federal judges with their March 27, 2008 decision held out the prospect of a conversion of the death verdict into a life sentence. All the same, Mumia is still on death row because the prosecution filed an appeal wit the Supreme Court in order to push through his execution. Mumia is now in the greatest danger to be executed since his arrest on December 9, 1981.

New York—On Aug. 21 the Solidarity Center here was filled with five hours of inspiring sounds: music and spoken word from talented artists (photo right) brought together to support the case of political prisoner Mumia Abu-Jamal, known worldwide as the “voice of the voiceless.”

Black Waxx Recordings and Artists and Activists United for Peace organized the celebration to officially release a powerful two-disc CD called “On the Move—Sounds Inspired by Mumia Abu-Jamal.” It aims to help raise broader awareness of the political significance of Mumia’s case and why he should be set free immediately after spending more than 27 years on Pennsylvania’s death row. Throughout the evening, the audience clapped, sang, cried and chanted during the performances. Some of the artists who lent their voices to the CD—such as Nana Soul, Stephanie Rice, SoSoon, Maya Azucena, Spiritchild, Latisha Devine, Melinda Davis and others—gave live performances. The acclaimed, legendary film director Melvin Van Peebles and Pam Africa from International Concerned Family and Friends of Mumia Abu-Jamal gave special remarks. U-Savior Washington, a film director and a producer of the CD, presided over the program.

August 21 has been designated “Black August” because on this day, 38 years ago, Soledad Brother and Black Panther Party leader George Jackson was assassinated by prison guards in San Quentin prison.

In 2004, the NAACP voted unanimously (with one "nay" vote) to "reiterate its support of the international movement for a new and fair trial for Mumia Abu-Jamal."  Yet the organization has done nothing since that time to ensure justice for Mumia. This April, the US Supreme Court ruled on Mumia Abu-Jamal's 27- year struggle against injustice and racism in the courts:  no new trial, no hearing, no opportunity for the mounds of evidence of Mumia's innocence to be presented, no recognition of the widely denounced violations of Mumia's constitutional rights, especiall, of racial bias.

The following call was sent out by the Free Mumia Abu-Jamal Coalition (NYC): We call on our elected officials to speak out on the threatened execution of Mumia Abu-Jamal Despite mounds of evidence of his innocence and ample legal basis for overturning his conviction, and after 27 years of police, prosecutorial, and judicial misconduct, Mumia has been denied a new trial by the U.S. Supreme Court. He now faces execution or life in prison without parole.

All indications are that the District Attorney of Philadelphia, the Fraternal Order of Police, and the media supporters of both will be relentless in continuing to seek Mumia’s execution. The US Supreme Court has turned down Mumia's perfectly precedented appeal re striking Blacks from juries.  In the historic Batson decision in 1986, as well as in the recent Texas case of Thomas miller-El, the Supreme Court ruled that prosecutors cannot strike jurors on the basis of race.

The first video titled "New Evidence for Mumia" features Ramona Africa of MOVE, a solidarity message from Venezuela, a presentation at the crime scene by Journalists for Mumia focusing on alleged eye witness Robert Chobert's missing taxi and testimony from Billy Cook's trial, and most dramatically Pam Africa in front of DA Lynne Abraham's office detailing the different new evidence of both DA misconduct and Mumia's innocence. Africa focused particularly on the newly discovered crime scene photos that were suppressed by the DA in 1982 and 1995. Legal update on Mumia Abu-Jamal

On July 7, the United States Court of Appeals for the Third Circuit in Philadelphia filed a petition on the case of death-row political prisoner Mumia Abu-Jamal. Robert R. Bryan, lead counsel for Abu-Jamal, submitted the petition on June 27 focusing on the racist exclusion of Black jurors during Abu-Jamal’s original trial in 1982.

Abu-Jamal was convicted of first degree murder of a white police officer on July 3, 1982, and has been fighting for the right to a new trial to prove his innocence. He was denied the right to legal representation at his trial and was railroaded to Pennsylvania’s death row due to his revolutionary politics.

If the Third Circuit rules against the petition, the next appeal will be sent to the U.S. Supreme Court.
