Grounds of Judgment
Perhaps more than anywhere else in the world, the nineteenth century encounter between East Asia and the Western world has been narrated as a legal encounter. Commercial treaties—negotiated by diplomats and focused on trade—framed the relationships among Tokugawa-Meiji Japan, Qing China, Choson Korea, and Western countries including Britain, France, and the United States. These treaties created a new legal order, very different than the colonial relationships that the West forged with other parts of the globe, which developed in dialogue with local precedents, local understandings of power, and local institutions. They established the rules by which foreign sojourners worked in East Asia, granting them near complete immunity from local laws and jurisdiction. The laws of extraterritoriality looked similar on paper but had very different trajectories in different East Asian countries.
Par Cassel's first book explores extraterritoriality and the ways in which Western power operated in Japan and China from the 1820s to the 1920s. In Japan, the treaties established in the 1850s were abolished after drastic regime change a decade later and replaced by European-style reciprocal agreements by the turn of the century. In China, extraterritoriality stood for a hundred years, with treaties governing nearly one hundred treaty ports, extensive Christian missionary activity, foreign controlled railroads and mines, and other foreign interests, and of such complexity that even international lawyers couldn't easily interpret them.
Extraterritoriality provided the springboard for foreign domination and has left Asia with a legacy of suspicion towards international law and organizations. The issue of unequal treaties has had a lasting effect on relations between East Asia and the West. Drawing on primary sources in Chinese, Japanese, Manchu, and several European languages, Cassel has written the first book to deal with exterritoriality in Sino-Japanese relations before 1895 and the triangular relationship between China, Japan, and the West. Grounds of Judgment is a groundbreaking history of Asian engagement with the outside world and within the region, with broader applications to understanding international history, law, and politics. —Oxford University Press

Contexte :
La planète est au cœur d’une crise économique, sociale et écologique sans précédant, qui avait était anticipée par les livres précédents de Michel Saloff Coste, notamment « Le Management du troisième Millénaire », qui a connu quatre éditions successives et est devenu un livre de référence dans son domaine. Dans ce nouveau livre Michel Saloff Coste actualise et poursuit sa réflexion sur les enjeux du troisième millénaire. Le passé, pour comprendre le présent, le présent pour anticiper le futur.
Objectif :
Ce livre rend accessible la compréhension des grands enjeux du XXIème siècle dans un langage clair et facilement assimilable pour le plus grand nombre.
Méthode :
Le livre est construit sur un triptyque : Passé, Présent, Futur, qui permet de mettre en perspective les enjeux actuels en comparaison avec les évolutions du passé. Le présent est décrit dans ses caractéristiques les plus singulières en montrant comment les conditions actuelles de l’humanité créent une situation complètement nouvelle. La dynamique créée par le passé et par le présent permet d’anticiper les grandes questions du futur en terme de rupture et de continuité.
Modalités :
Ce livre se nourrit du travail de réflexion lancé par Michel Saloff Coste dans le cadre de l’Université Intégrale, qui depuis février 2008 poursuit un travail de réflexion sur les enjeux du Troisième Millénaire au sein du Club de Budapest France, fondé en 1995. Par ailleurs, ce livre intègre les connaissances et expériences de différents voyages d’études de Michel Saloff Coste effectués en Asie, en Amérique et en Europe entre 1995 et 2010.
Ce livre est le fruit de travail cumulé de recherche, mené depuis trente ans par Michel Saloff Coste sur cette thématique.

Michel Saloff Coste a créée une équipe pluridisciplinaire, qu’il l’aide dans la politique éditoriale, l’élaboration du contenu et l’adaptation du contenue à différents pays et publiques. Le livre est conçu dès l’origine pour une adaptation en différentes langues étrangères et la traduction s’élabore en parallèle de l’élaboration du livre en français. Cette équipe, et les différents rôles joués par les un les autres sera souligné et mis en valeur dans le livre.
Publique :
Le public intéressé par ce livre devrait être en premier lieu les « créatifs culturels » évalués par Paul Ray à environ 25% de la population des pays développés. Cette frange de population, en forte croissance, est préoccupé par les grandes questions soulevés dans ce livre : comment créer une nouvelle civilisation dans le contexte actuel et se libérer d’un passé qui connaît aujourd’hui les limites de son potentiel.
Plus généralement ce livre intéressera toutes les personnes qui aujourd’hui se posent la question des enjeux lié au développement durable et qui ont compris la nécessité d’un changement de fond, notamment les jeunes générations.

Contexte du livre
Ce livre s’inscrit dans un contexte planétaire en pleine transformation. Cette transformation globale est marquée par de nombreux aspects négatifs : dissolution du lien social traditionnel, réchauffement de la planète, crise écologique, fracture grandissante entre les riches et les pauvres, raréfaction des ressources essentielles (eau, pétrole etc.), multiplication des pandémies et risques sanitaires, régression vers des fondamentalismes sectaires, développement d’un cynisme opportuniste et choc des cultures et des représentations.
Mais cette transformation est aussi travaillée par une multitude de forces positives qui bien que puissantes, sont souvent bien moins bruyantes que les précédentes. China refutes Japanese purports over the Diaoyu Islands Thursday night after the general debate of the 67th Session of the UN General Assembly. Li Baodong China s Permanent Representative to the UN strongly criticized Japan s stealing of China s Diaoyu Islands. The Japanese representatives speeches over the Diaoyu Islands publicly distorts history and resorts to deceptive rhetoric to infringe on China s territory which are all nonsense refuted Li the permanent representative. According to Li Chinese Foreign Minister Yang Jiechi earlier had stated China s constant and clear stand over the Diaoyu Islands at the general debate and had urged Japan to immediately stop all activities that violate China s territorial sovereignty take concrete actions to correct its mistakes and return to the track of resolving the dispute through negotiation. The so-called island-purchase of the Japanese government recently is money-laundering in nature which attempts to legitimize through illegal means Japan s stealing and encroachment upon China s territory said Li. Any illegal actions no matter how they whitewash cannot change its illegal nature and it cannot give rise to rights that s a basic principle of law and common sense explained Li. Japan seized Diaoyu islands in 1895 at the end of the Sino-Japanese War and forced the then-Chinese government to sign an unequal treaty to cede these islands and other Chinese territories. After the Second World War the Diaoyu Islands and other Chinese territories occupied by Japan were returned to China in accordance with the Cairo Declaration the Potsdam Proclamation and other international documents. China strongly opposes the speeches made by the Japanese representatives. Japan shows no guilt over its colonial invasion history instead they resort to deception China strongly opposes this. The so-called nationalization of the Diaoyu Island by Japan is purely robber s logic refuted Li. Now the world has entered the 21st century however Japan still holds its old colonial mindset attempting to infringe on China s territory encroaching upon the Diaoyu Islands and other islands.
