A once-in-a-generation supply shock is transforming global energy markets, lowering crude oil and natural gas prices, and quickly making the United States the world's largest producer of oil and gas. But energy politics threatens to short-circuit this American economic boom. Of immediate concern are federal regulations — in particular, discretionary export-licensing systems for natural gas and crude oil — that were implemented during the 1970s, an era of energy scarcity. By restricting exports and subjecting approvals to the whims of politicians, the current licensing systems distort energy prices and deter investment and employment in these promising sectors of the U.S. economy. They also irritate global trading partners, likely violate U.S. trade treaty obligations, and undermine other U.S. policy objectives. Ernest Moniz, President Obama's energy secretary, recently stated that these export restrictions are deserving of "some new analysis and examination in the context of... an energy world that is no longer like the 1970s." The second oldest of six children, Betty grew up speaking no English at home. As with her siblings, when not in school, she worked the counter of her parents' business, interacting with customers and often translating for her parents with vendors as well as assisting in financial transactions for them. Ms. Yee's work ethic was modeled after that of her parents, who never closed the business other than on Sundays and holidays and never took vacations. She especially is proud of the reputation her father earned for the quality of his work in hand-finishing men's shirts and that of her mother for her excellent skills as a seamstress. The hard work and sacrifice of her parents inspired Ms. Yee and her siblings to do well in school. All six children are college graduates: five from the University of California, Berkeley, and one from San Francisco State University; three have advanced degrees. About the California State Board of Equalization: Currently, Ms. Yee serves as one of five members on the California State Board of Equalization, the nation's only elected tax commission. She represents close to 9 million Californians in the First Equalization District, comprised of 21 counties primarily along the northern and central California coast and including the entire San Francisco Bay Area — the home to many of the state's most prominent industries, such as biotechnology, health care, high tech, financial services, wine, and tourism. Ms. Yee was elected to this office first in November 2006, receiving over 1.5 million votes, or 65 percent of the votes cast. She was re-elected in 2010, earning over 1.6 million votes, or 63 percent of the votes cast. The Board hears business tax appeals, acts as the appellate body for franchise and income tax appeals, and serves significant roles in the assessment and administration of property taxes. During her tenure, Ms. Yee has served as the Chairwoman of the Board twice, elected unanimously by her peers to this position that has included her serving as a member of the California Franchise Tax Board. Justice Ellett, in his concurring opinion, again 19 noted his belief that the fourteenth amendment is itself a nullity, being illegally ratified and adopted/ and is therefore not capable of being the vehicle by which any provisions of the Bill of Rights are made applicable to the states. Furthermore, in Justice Ellett's view, the fourteenth amendment due process clause require only that the states provide a procedurally fair system, which he felt the state had satisfied in Phillips: The dissenting opinion asserts that "The Fourteenth Amendment is a part of the Constitution of the United States." While this same assertion has been made by the United States Supreme Court, that court has never held that the amendment was legally adopted. I cannot believe that any court, in full possession of its faculties, could honestly hold that the amendment was properly approved and adopted. But even if it be assumed that Congress, by joint resolution, could compel the then Secretary of State to declare that the amendment had been approved by three fourths of the states of the Union, still there is no question in this case of lack of due process of law. The defendants were tried in a court of competent jurisdiction under rules of state law which applied to all alike. They were given notice of the charge against them and had a fair trial wherein they were afforded the rights to counsel, to be confronted by the witnesses, to testify and to give evidence in their own behalf.20 Whatever the historical merit of the conspiracy theory of the fourteenth amendment,21 the time has long since passed that such a theory can be seriously entertained for purposes of declaring invalid22 a cornerstone of a century's constitutional law, especially by a state court.23 In some circumstances it is proper to thunder from the bench at judicial trends with which one disagrees,24 and this may be done by an inferior court toward an appellate body as well, as long as the forum recognizes that it is still bound by current and unambiguous case law of the appellate court. Arguably, Justice Ellett was within such a parameter of permissible judicial disagreement when in Dyett v. Turner,25 he stated that: We have spoken in the hope that the Supreme Court of the United States may retreat from some of its recent decisions affecting the rights of a sovereign state to determine for itself what is proper procedure in its own courts as it affects its own citizens. However, we realize that because of that Court's superior power, we must pay homage to it even though we disagree with it; and so we now discuss the merits of this case just the same as though the sword of Damocles did not hang over our heads.26 19. Justice Ellett thoroughly explained his theory that the fourteenth amendment is a nullity in Dyett v. Turner, 20 Utah 2d 403, 439 P.2d 266 (1968). In Dyett, the Utah Supreme Court rejected a habeas corpus petition and held that the defendant had "knowingly and intelligently" waived the right to assistance of counsel, which was a right protected under the sixth amendment of the United States Constitution. TASTING NOTES
This ruggedly intense ruby-black wine exhibits a bold and potent bouquet that is redolent of ripe black plum, red cherry syrup and fresh cassis beneath a curtain of sweet pea, cracked white pepper and bay leaf. The palate is abundant and rounded, swelling with the rich flavors of briary blackberry and luscious raspberry, enhanced by structured tannins and touches of rich toffee, vanilla bean, cinnamon stick and subtle spearmint that carry through the lingering finish.
VINEYARDS
Our nine-acre Las Posadas vineyard features an elevation of 2,000 feet above sea level and south-east facing plantings. The rocky, well-drained volcanic soils force the vines to dig deep for water and nutrients, producing smaller, intensely-flavored berries as a result. Despite strong afternoon sun, the climate tends to be cooler because of altitude and maintains acidity throughout ripening.
HARVEST & WINEMAKING
The 2010 vintage was cooler than usual during the growing season, but ended with a heat wave. As a result, the fruit for this wine was harvested at an optimal level of ripeness late October. Fermentation took place at a high temperature to ensure that maximum extraction was achieved before the wine was racked to 50% new French oak barrels. The wine was aged in barrel for a total of 18 months before bottling.
Hearty and bold, this voluptuous Cabernet Sauvignon would make an apt partner for a hearty yet uncomplicated dish, such as filet mignon with parmesean potato gratin. Additionally, this wine coupled with Tomme de Fedou, a nutty, aged ewe’s milk cheese from France would make a fine cheese course.

Who: Everybody
The piece consists out of an open call to participate in an event for equality. In this event the participators where asked to sacrifice their shame. The objective of the gathering is to re-think our approach towards equality in an active way. Its intention was to eliminate the passive gaze with which we approach art in to a participatory act in need for a physical entrance. The body is the intermediate between the idea and the environment, the public and the private.Because, changing perception is not merely a question of turning the tables or changing the language. We live in a society mesmerized by its genitals and over saturated by sex. In this piece, instead of the gun, colors are used to paint the genitals. By doing so an aim is made to free the genitals from its socially and sexually loaded meaning as an object back in to a symbol. The color represents a playful redefinition of innocence and the freedom of prejudgement. The idea of the action-pants is used as a metaphor for focus. Where does our gaze rest ? Within this field of thought it also encapsulates the theme of the exhibition, Topsy Turvy; The World Upside Down, in which the masked always reveals the hidden, suppressed or potential alternative.

STOWELL/BEAUMONT - by Lauren Huet The 2002 and 2008 Farm Bills amended the Agricultural Marketing Act of 1946 in order to establish mandatory labeling of products with their country of origin. The U.S. Department of Agriculture implemented Country of Origin Labeling (COOL) on March 16, 2009. It requires the labeling of fresh fruits, vegetables, shellfish, fish, various nuts, beef, pork, lamb, goat and chicken. In 2008, Canada, later joined by Mexico and other countries, filed a complaint with the World Trade Organization. They argued that the COOL provisions were inconsistent with the United States' obligations under the WTO agreement. In 2012, the U.S. appealed the WTO dispute settlement panel's first ruling. The WTO's Appellate Body agreed with the dispute panel's finding that COOL regulations treat domestic livestock more favorably than imported livestock. However, they reversed the dispute panel's ruling that COOL does not fulfill its legitimate objective. The WTO ruled that the U.S. does have the right to label its products but needs to address issues with the legislation. The U.S. had until May 23, 2013, to comply with the WTO's recommendations. As a result, the USDA issued a final COOL rule with more strict labeling requirements. The WTO required labels showing where the animal was born, raised, and slaughtered. On July 8, opponents of COOL (the National Cattlemen's Beef Association, American Meat Institute, Canadian Pork Council, Canadian Cattlemen's Association, North American Meat Association, American Association of Meat Processors, Southwest Meat Association, National Pork Producers Council, and Mexico's National Confederation of Livestock Organizations) filed a preliminary injunction request to stop the implementation of the revised COOL rules. Their request was denied by U.S. District Judge Ketanji B. Jackson on September 11, 2013. The plaintiffs appealed the ruling. The proponents of the COOL regulations include the U.S. Cattlemen's Association, the National Farmers Union, the American Sheep Industry Association, the Consumer Federation of America, and the Independent Cattlemen's Association of Texas.- published: 26 Nov 2013
