America's worldwide leadership depends on our ability to maintain an open and free internet. The Electronic Communications Privacy Act (ECPA) was enacted in 1986 and despite significant technology advances since that time, the law is largely unchanged.

It is critical to establish consistent privacy protections and ensure constitutional guarantees of due process. ECPA must be reformed to include a warrant requirement for government searches of email and other electronic communications.
