Euthanasia Law Extended In Belgium To Children
The Belgian Senate has voted in favour of extending its euthanasia law to terminally-ill children. The Senate voted 50-17 in favour of the legislation, which is opposed by religious leaders in Belgium. The bill seeks to allow children to ask for euthanasia if their illness is terminal, they are in great pain and there is no available treatment. It will now go before the lower house of parliament, where correspondents say it is likely to be approved. Belgium passed a law decriminalising euthanasia for terminally-ill people over the age of 18 in 2002. The latest bill proposes to make Belgium the first country in the world to remove any age limit on the practice. There is no age for suffering and, next to that, it's very important that we have a legal framework for the doctors who are confronted with this demand today" Jean-Jacques de Gucht Belgian Senator But it stipulates a number of caveats on euthanasia: It says the patient must be conscious of their decision and understand the meaning of euthanasia The request must have been approved by the child's parents and medical team Their illness must be terminal They must be in great pain, with no available treatment to alleviate their distress In November, 16 paediatricians urged lawmakers in Belgium to approve the legislation in an open letter. "Experience shows us that in cases of serious illness and imminent death, minors develop very quickly a great maturity, to the point where they are often better able to reflect and express themselves on life than healthy people," said their statement. During the Senate debate, supporters of the bill said it would empower doctors and terminally-ill children to make a difficult decision. "There is no age for suffering and, next to that, it's very important that we have a legal framework for the doctors who are confronted with this demand today and for the minors, for the capable minors, who are suffering today, and who I think should have the freedom to choose how they cope with their suffering," said Senator Jean-Jacques de Gucht, of the Open Flemish Liberals and Democrats. But opponents in the Senate said children were not capable of making such a decision. "We think that children don't understand the character of death, they don't understand the irreversibility of death," said Els Van Hoof of the Christian Democratic and Flemish party. "They are also influenced by authority, by their parents, by the medical team. So, to take a decision which is a huge decision about their death we don't think that they are capable of doing it." In 2012, Belgium recorded 1,432 cases of euthanasia in 2012, up by 25% from 2011.- published: 13 Dec 2013

A debate on changing the law to allow euthanasia for minors has deeply divided the country. Doctor van Berlaer is a pediatric oncologist, one of 16 pediatricians who has written an open letter to the Belgian parliament asking to legalise euthanasia for patients under the age of 18. Only Belgium, the Netherlands and Luxembourg allow euthanasia, or choosing the right to die because of unbearable suffering. But opponents question whether children are capable of deciding to end their own lives. Gerlant van Berlaer a paediatric oncologist, at Ziekenhuis University believes otherwise: "Most of the time they're afraid that we'll just go walking through the hospitals and killing children. Of course this is nonsense. We as doctors and parents will always want to do the maximum we can to care and to cure a child. But in some very rare situations there is really nothing we can do anymore and this might mean that a child will have to suffer until death will come along and there's no legal way of helping these patients in an ultimate act of humanity." The extended euthanasia law currently being debated does not specify a minimum age. But doctors who witness the daily suffering of their young patients argue these children are mature beyond their years. A suffering that affects the whole family and one which has made it difficult to get either parents or patients to talk about euthanasia openly. Ella-Louise Van Rooy was six months old when she was diagnosed with an uncurable genetic disease. She died four months later. Her mother, Linda says watching her daughter suffer in the last days of her life was unbearable. She knows that extending the euthanasia bill for minors does not include situations such as Ella Louise's. But she hopes that one day this will be possible. For her, there is no minimum age when it comes to suffering: "The last four or five days of Ella Louise, that's what we felt, there was no quality, there was no dignity to her, not to her life. The only thing that happened to her was she was getting skinnier because she was like eating all her body reserves. She was getting very skinny, she was in pain again. It made me angry. " However, René Stockman, a senior member of the religious order Brothers of Charity which runs hospices, says that while suffering can be unbearable, for him it's more about finding a sense in life rather than ending it: "We see people coming in with that clear request 'stop my life, I cannot survive anymore in this situation'. They choose nevertheless for palliative care and after a few days we see that the question to die is not posed anymore because they receive again a sense in their life. It's all about sense in their life." For supporters of euthanasia, the purpose is to be able to decide to end one's life in a dignified and humanitarian way. But also in a legal and safe way. Yet while the current debate is about extending this right to minors, it has also ignited an older debate - how does the medical profession decide when the suffering is too much? "In Their Words" Series - Episode 1 - Tom Mortier, PhD Speaks on his experience after 10 years of Euthanasia In Belgium and His Personal Story Dr. Tom Mortier (PhD) lecturer of chemistry at University College Leuven in Belgium, critiqued the Belgian euthanasia law at a press conference in Montreal, Quebec, where there is currently a law under review similar to the one in Belgium, Blll 52. During his visit, the Coalition interviewed him in the following videos on his personal story and what he has witnessed as a Belgian in a society where euthanasia has been legal for 10 years. In this very personal interview, Dr Mortier candidly discuses his mother's own passing - she was taken by euthanasia - the cause, as he discusses, not due to a terminal illness, but simply by her choice. Tom's mother was suffering from depression. In Belgium, with the current laws, this is possible... Tom goes on to express that this issue is not about the right to die for the terminally ill, but rather about the doors that this opens, like it has in Belgium, where this likely started to protect doctors from being legally prosecuted in cases where people were at end of life and in severe pain, but has ended up creating situations where people for many reasons, other than terminal illness, are turning to euthanasia, and dying as a result. New Law Bans Homeless From Sleeping Outside in Belgium
Homeless people living in the streets of Budapest now fear they would be soon sent off their grounds and face punishment as parliament on Monday night (September 30) passed a law that would enable local councils to ban the homeless from their streets. The new law says it aims to ensure 'public order, health, and cultural values' by empowering councils to ban the homeless but human rights activists claim it in fact criminalises homelessness and sweeps the problem under the carpet. The government says enough shelter places are available for all homeless but many say they fear the shelters because theft is rampant in most places. "They [the government] just wants to divert the attention of the society from the robberies and corruption, and instead go after the homeless," homeless 'Zoltan', who has lived in the streets for more than 10 years, said. "We rather freeze outside or go into the woods but we cannot go into the shelters as it's not safe, it'd be safer to live in a barn," he added. The government argues that the new law is in the best interest of the homeless as they risk freezing to death by sleeping rough in cold temperatures. Still, many homeless refuse going into shelters and would rather see some cheap but safer renting options. "At the shelter, if we want to go for a smoke one of us stands guard because everything gets stolen, it's so dangerous there," homeless Laszlo Szollosy-Toth said. Debate around the homeless issue intensified last year when fines were introduced for sleeping in the street and homeless could even face prison though in practice it did not happen. The move provoked widespread criticism. Critics said the law was unenforceable and hostels lacked sufficient places. Budapest has an estimated 7,500 homeless, and Hungary around 10,000, according to a survey by the Menhely Foundation who deal with homeless care. The Constitutional Court over-ruled the law at the end of last year and the homeless returned to the subways and streets. After the Constitutional Court over-ruled the law last year the ruling Fidesz party looked for new ways to keep people off the streets. In March this year parliament amended the Constitution to include such possibilities. The new law passed last night is built on that Constitutional amendment. Opposition parties criticised the law saying it worsens the homeless situation rather than helps finding a complex solution. "These people on the edge of the road would need helping hands and not being kicked into the ditch. You know very well that this law will not solve the problem of homelessness," opposition LMP party MP Gabor Vago told parliament before the vote. The government says that they are spending more and more on homeless care and have increased shelter places. "We have created 700 shelter places in Budapest, we would like to accommodate every homeless under a roof. While under the previous Socialist government hundreds of homeless froze to death in the streets in the past one year only one person, which is of course more than it should be. We would like if no homeless person froze to death in the streets in Hungary therefore we created more than 700 places in Budapest too," state secretary of the Interior Ministry, Karoly Kontrat told parliament. The government also stressed in a statement on Monday that they have supported various new shelters and new programmes that aim to help the homeless integrate into society. Civil organisations argue that instead of opening more shelters a comprehensive solution should be found. A group of homeless people and activists of 'The City Belongs to Everyone' held a protest outside parliament. They claimed that it was not true that there were enough shelter places and those that existed did not provide safe and dignified accommodation. "Instead of recognising that the homelessness is not a police question but a social one, the government decided to write the possibility of punishing the homeless into the constitution. Therefore, since this March, the Hungarian Constitution is the only one in the world that makes it possible to punish the homeless for not having a home," activist Tessza Udvarhelyi told the protesters.
