Judge Matthew Gary was subsequently ordered off the Saunders case by an outside judge for bias and misuse of contempt law against Saunders, yet he still has not been allowed to see his children. Saunders filed a complaint against the judge with the Commission on Judicial Performance, the state agency responsible for oversight and accountability of California judges. The CJP, run by Director and Chief Counsel Victoria Henley, dismissed Sanders' complaint and took no action against Gary. While under a temporary custody order, Berger relocated the children to Hawaii without a final custody determination and without prior court permission as required by law. At the request of divorce attorney Richard Sokol, who also serves as a temporary judge in the same court, Blizzard after-the-fact approved the unlawful out-of-state transfer. Child abduction is prohibited by California Penal Code section 278.5, and under § 278.5(c) a custody order obtained after-the-fact does not constitute a defense to the crime.
