Whatever the underlying reason for his animus, it caused him in today's cross-examination to make a rare misstep: Seemingly sensitive to the charge of being part of a political vendetta, Shiller's clear irritation only increased as Levant referenced those other cases on a number of occasions. It became a running joke to the point where the trial judge, Madam Justice Matheson, had to caution the spectators in court to keep quiet because of the laughter... But a pivotal occurrence came when Shiller asked about claims Levant made that the plaintiff, Khurran Awan, was being bankrolled for the current lawsuit. Evidently thinking he had the smoking gun of an example of an outrageous, untrue accusation, Awan's attorney asked what the basis was for Levant making that claim. In a moment of exceptional courtroom drama, Levant replied that he would answer the question, but wanted to make sure that Mr. Shiller understood that he was willing to answer the question, and how he knew the answer. Shiller repeated the question and Levant's response was a shock. Levant replied that Shiller himself had provided that information in a conversation with his lawyer. Shiller became flustered, almost stuttering, and backed away from that line of question immediately, muttering about his unwillingness to be a witness in the case he was conducting as an attorney. But the damage was done.

Neil Young says 'rock stars don't need oil' Neil Young is not backing away from his criticism of the Harper government and the expansion of the oilsands, responding to a statement from the prime minister's spokesperson with a point-by-point refutation. Young blasted the government's approval of a mine expansion plan in northern Alberta during a news conference Sunday, where he said Stephen Harper's government was choosing money over integrity in its ongoing approval of oilsands projects. Harper's spokesperson responded to Young's claims in a statement issued Sunday, saying even "rock stars" use the resources that are being recovered in Alberta. Jason MacDonald also noted the oilsand projects are only approved when they are deemed safe for Canadians and the environment, and added that Canada's resource sector strengthens the economy with high-wage jobs. "Even the lifestyle of a rock star relies, to some degree, on the resources developed by thousands of hard-working Canadians every day," MacDonald said. Young issued a point-by-point refutation of MacDonald's claims on Monday. The 68-year-old rock music legend said he had an issue with the government "breaking treaties with the First Nation and plundering the natural resources the First Nation has rights to under the treaties." Young also noted that "rock stars don't need oil," pointing out that he drove his electric car from California to the oilsands and on to Washington without using any oil at all. "And I'm a rock star. My car's generator runs on biomass, one of several future fuels Canada should be developing for the post-fossil fuel age," he continued. "As to the thousands of hard-working Canadians, we have respect for all working people. The quandary we face is the job they are working on. They are digging a hole that our grandchildren will have great trouble digging their way out of . . . There are better jobs to be developing, with clean energy source industries to help make the world a safer place for our grandchildren." Young is in the middle of a four-date tour benefiting Athabasca Chipewyan First Nation Legal Fund. His goal is to raise $75,000 to help the First Nation in its legal challenge of two Shell Canada mine projects in Alberta's Athabasca tar sands region. Young's statement included allegations of the toxic environmental effects of the oilsands and pointed out that the "oil is not going to Canada, but to China where the air quality has been measured at 30 times the levels of safety established by the World Health Organization." "Is that what Canada is all about?" he asked. "As a Canadian citizen, I am concerned that this government is not acting within the advice of science." Young closed by responding to another of MacDonald's statements, in which he said the government "recognizes the importance of developing resources responsibly and sustainably and we will continue to ensure that Canada's environmental laws and regulations are rigorous." "When people say one thing and do another, it is hypocrisy," Young replied. "Our Canadian environmental laws don't matter if they are broken."

Toronto — Under cross-examination at the libel trial he launched against Sun News host Ezra Levant, Khurrum Awan, a Saskatchewan lawyer, denied a key plank of Mr. Levant's harsh public criticism — that he engaged in a "shakedown" or "blackmail" of Maclean's magazine. "Extracting something with threats could be a shakedown or a form of blackmail," said Mr. Levant's lawyer, Iain MacKinnon. At issue was a meeting in 2007 of Mr. Awan, three other Muslim law students and senior Maclean's editors to discuss an article the students felt was Islamophobic. Evidence heard so far in the Toronto courtroom has described their request for a rebuttal article, their suggestion of a donation by Maclean's to a race relations charity, and their threat to file hate-speech complaints with Human Rights Commissions if their requests were denied, which they were. Mr. Awan who brought this defamation lawsuit over blogposts in 2009 in which Mr. Levant called him a liar and anti-Semite, agreed with the general definition of a shakedown, but said: "I do not think that legal action over a recognized wrong is blackmail or a shakedown." "As a general proposition," Mr. MacKinnon went on, "asking somebody for money as part of one or more demands could be considered by an observer as a shakedown." "As a demand, certainly, it could be, just in a general, standalone context," answered Mr. Awan, a litigation specialist who has recently acted in pharmaceutical class actions. He said he wanted to ask Maclean's to make a donation to the Canadian Race Relations Foundation to indicate it does not support racism, but the meeting quickly became confrontational, and the request was never made. Nor did they get to discuss details of who would be the "mutually agreeable author" of a rebuttal, nor how such a rebuttal would be published. In fact, it never was, though Maclean's ran many letters to the editor. "There was never an author demanded at that meeting, because we had not canvassed anyone who would publish a response," Mr. Awan said. "I think the principles of free speech and democracy required a reasonable response." Mr. Awan was also asked to testify about the striking similarities between the complaint he filed against Maclean's in Ontario, and the one filed by the Canadian Islamic Congress in British Columbia, for which he acted as a key witness at a human rights tribunal. Another case was filed federally. None succeeded. Mr. Awan agreed the B.C. complaint was "substantially the same" as the Ontario one he prepared, with chunks of text verbatim, despite his denial he had anything to do with preparing the B.C. one. Mr. Levant disagrees with that, and this is the basis for a conflict of interest allegation, one of several libels Mr. Awan alleges Mr. Levant committed. Mr. MacKinnon said evidence will show that a news report described Mr. Awan sitting at the counsel table in B.C. alongside lead lawyer Faisal Joseph, as a "young protege [who] is one-third of a student research team." "It's simply inaccurate," Mr. Awan said. "I know I was not seated at counsel table. ... I was not at the frontline of the prosecution of the B.C. complaint." A notorious protester convicted of wilfully promoting hatred against Muslims and criminally harassing a Muslim man and his family was sentenced Tuesday to nine months in jail. Eric Brazau handed out a flyer that "vilified Muslims and disparages their religion," Ontario court Judge S. Ford Clements said in February, when he found Brazau guilty. The case was far from being on the borderline between "rough and tumble debate" and hate speech, as Brazau had argued, Clements said in a College Park courtroom. Brazau handed out the flyer, which contained many offensive references to Islam and Muslims, in August and September 2012. While distributing it, Brazau sometimes yelled obscenities about Islam "in a tone of voice that suggested he was very angry and had little interest in debate," Clements said. Brazau had argued that he did not intend to promote hate speech; instead he wanted to stimulate debate about censorship, "blasphemy laws" and Sharia law, Clements said. Clements disagreed. "He knew the material would deeply wound and anger Muslims," said Clements. The content was not humorous, ironic or satirical, he said. "Mr. Brazau is far too intelligent to believe this to be so." The flyer also contained a somewhat blurred photograph of a Muslim family on a downtown Toronto street. The man in the photo testified that Brazau called him a "terrorist" on the day Brazau took the photo. In a second interaction a few weeks later on a sidewalk, the man, whose name is protected by a publication ban, said that Brazau approached him aggressively while photographing the family, making him "concerned and fearful." Clements found this to be criminal harassment. During sentencing submissions, Crown prosecutor Derek Ishak described Brazau as an "unrepentant hatemonger ... who abused his right to freedom of speech in a planned, deliberate manner," Clements said Tuesday in his sentencing decision. However, Clements said that while Brazau's conduct was "despicable" and his beliefs "repugnant," the maximum sentence of six months for a summary conviction on willfully promoting hatred was unwarranted. He also noted the defence submission that Brazau committed his offences in public, where he was easily identifiable, rather than by stealth. Instead, he gave Brazau a four-month sentence, plus two months for criminal harassment and mischief and three months for breach of probation by not keeping the peace. Brazau, who had spent nine months in pre-trial custody, was sentenced to time served. Clements declined to ban Brazau from distributing flyers, since that could impede his right to freedom of expression. Outside the court, Brazau said he will appeal his sentence. He says he is aware the flyer was "problematic" and "would offend." But his voice won't be silenced, Brazau added, though he will keep in mind the hate speech laws, which he says he has learned to navigate over the past few months. "Hatred is the harvest he wanted to gather," Clements said in his conviction decision, quoting William Butler Yeats. "I find this is true of Mr. Brazau." Last month, a small claims court found that Brazau had been wrongfully arrested and detained while protesting near Sgt. Ryan Russell's funeral procession in 2011. However, the deputy judge also found his conduct "reprehensible" and awarded him only $1,000 in damages.

The grizzly bear (Ursus arctos horribilis), also known as the silvertip bear, is a subspecies of brown bear (Ursus arctos) that generally lives in the uplands of western North America. This subspecies is thought to descend from Ussuri brown bears which crossed to Alaska from Eastern Russia 100,000 years ago, though they did not move south until 13,000 years ago.[1] Grizzlies are normally solitary active animals, but in coastal areas the grizzly congregates alongside streams, lakes, rivers, and ponds during the salmon spawn. Every other year, females (sows) produce one to four young (commonly two) which are small and weigh only about 500 grams (one pound). A sow is protective of her offspring and will attack if she thinks she or her cubs are threatened.
