While the Chinese Communist Party (CCP) firmly opposes the court's order, on February 11the Spanish Parliament began the debate to constrain Spanish judges in prosecuting international human rights cases. Chinese human rights lawyers believe the Spanish parliament was swayed by interest groups to restrain universal jurisdiction, and indicate that it is a step backwards for the global cause of human rights. The Wall Street Journal reported the restraint on exercising the international human rights law won lower house approval Tuesday by a vote of 179 to 163. It will next go to the Senate. The bill specifies that only Spaniards or foreigners who reside in Spain are subject to prosecution; mandating that plaintiffs must be Spanish citizens at the time the torture was alleged to have occurred. The bill constrains the Spanish judiciary's exercise of universal jurisdiction, the principle Spanish judges have used to prosecute international human rights cases outside of Spain. These are genocide, the crimes of torture, war crimes, and crimes against humanity. Human rights groups including Amnesty International consider universal jurisdiction an "essential tool" and issued a joint statement on Monday strongly condemning the proposed changes to Spanish law reported the New York Times. Human rights lawyer Jiang Tianyong says that the Spanish courts exercising the universal jurisdiction for crimes against humanity is in full compliance with the spirit and the universal values of the United Nations. The change of the law is obviously what the Communist regime has pressured the world justice with its taxpayers' money. Jiang Tianyong, human rights lawyer: "There are people in some countries who could not resist the pressure. Regardless of how the CCP has exerted pressure and how some people could not resist the pressure, it is a step backwards. However, trial of justice against these criminals will never be changed." No country has enjoyed more than Spain to use the doctrine of universal jurisdiction with more confidence. Spain adopted the universal jurisdiction in 1985. The most famous example was in 1998, when the Chilean dictator Augusto Pinochet visited London. Spanish judge Baltasar Garzón Real ordered his arrest in London, where he was detained for a year and a half before being returned to Chile, where he faced criminal charges until death. While Spanish judges' international activism has won them praise from rights activists, it has often caused friction with some of Spain's key economic partners. Alfonso Alonso, the spokesman for the Popular Party delegation in Congress, said, Universal justice "promises a lot, but doesn't achieve anything more than diplomatic conflicts," reported the World Street Journal. Jiang Tianyong refutes this argument. He takes Pinochet's case as an example saying the world sees the end of a dictator, who was put on trial wherever he was. Jiang Tianyong: "This rule tells the criminals that, it is a dangerous place for them to be in any country with a treaty with Spain. Those criminals could only stay put and that's a threat to them. It also tells the world that crimes against humanity are subject to justice trials. The change of the law means the world is missing such justice." Human rights lawyer Tang Jitian says that when the Spanish politicians lose their sober minds by restricting the universal jurisdiction under pressure from interest groups, it is a step backward and a huge negative impact to global human rights. The Spain will initiate a bad precedent. In the long run, it is not conducive to the protection of human rights in Spain. Tang Jitian, human rights lawyer: "Facing right or wrong,it is the MPs informed choices to abandon some adverse factors and maintain the ethics, the human rights, and the Spanish image as a country in protecting human rights. Both domestically and internationally." Spanish High Court Judge Ismael Moreno issued an arrest warrant against former Chinese leader Jiang Zemin and four other officials on Monday, for accused of genocide in Tibet. This signaled the end of Mr. Locke's two and a half years as the U.S. ambassador to China. The Chinese Communist Party (CCP) mouthpiece media issued an editorial of racist attack and abuse, rather than praise and regret. The state media report angered mainland netizens. Along with the international coverage, Mr. Locke has once again become the focus of the media. The state-run China News Service editorial on Feb 27, titled "Farewell, Gary Locke" slammed Mr. Locke as "yellow skined and white hearted," "black hair and yellow skin," and "nauseating with a dark core" and "bananas". The evil-spirited editorial even brought Mr. Locke's ancestors into the criticism. The commentary stated, "When Gary Locke arrived, the sky in Beijing became hazy. When he left, the sky suddenly became blue. Mr. Ambassador waved away the smog in our minds." This editorial immediately generated public shock and anger. Internet commentator Yao Bo stated, "This China News article is the most shameless and foul article I've ever seen .... That a major Chinese government news service used a racist slur to describe the departing American ambassador....drew widespread public condemnation in China." Lan Su, commentator: "The slandering against Gary Locke was because of the charisma Gary Locke has with both the Chinese and the western orthodox. The Communist officials have been embarrassed and humiliated." Commentator Lan Su explained that Gary Locke demonstrated the free, democratic and tolerant culture of the West, and the traditionally gentle and Confucian culture of China. Gary Locke has won people's hearts by carrying his own bag flying economy class and not staying in a 5-star luxury hotel. During his office, Gary Locke also handled major incidents: Former vice mayor of Chongqing Public Security Bureau Wang Lijun defecting to the U.S. consulate in Chengdu, and blind activist Chen Guangcheng seeking refuge in the U.S. Embassy in Beijing. In the meeting on Feb. 24, the Chinese propaganda agencies explained that the News Ethics Committee is a timely measure to build strong news teams and solve pressing issues in the media. This year another 10 pilot stations will be added to include Beijing, Heilongjiang, and Fujian. Zhu Xinxin particularly points out that the News Ethics Committee's role to strengthen the government contradicts the media's role in society, to watch the government. Zhao Yan, former news director of Reform Magazine, comments that the Chinese media have lost their purpose under the influence of the entire corrupt regime. The Communist regime tightens the screws of suppression and censorship on the media and on journalists in the name of ethics. Many courageous outspoken Chinese journalists have become the victims of suppression. Last October, Guangdong reporter Chen Yongzhou was arrested by Hunan police for his series of reporting on a Hunan listed company. Last November, three reporters from Zhejiang and a reporter from Henan were put under investigation and punishment. Reporter Pang Jiaoming went hiding for six years because of his exclusive report, "Shaw's Orphans", which revealed the shady infant trafficking by the Family Planning Office in Shaoyang, Hunan. After he resigned his journalist position, he revealed in a forum that to survive as a journalist, he had changed his penname three times. Zhu Xinxin: "The media has become a tool for the regime. No truth, only lies. Reports are allowed only if the official orders are followed. This is extremely unethical. Many reporters had thus been forced to report, just to make a living, and reluctantly abandoned their professional ethics." Commentator on the Beijing constitution, Chen Yongmiao, says that news in China is under strict scrutiny. Any report is the result of the censorship and opaque information. Chen Yongmiao, commentator on the Beijing constitution: "The Communist regime has manipulated ethics as the excuse to conduct news censorship. They deceive the public but claim it's for the benefit of the people. In fact, they choke the media so that no politically sensitive issues, or issues that potentially endanger its ruling stability socially and politically will get published." Some netizens posted on Weibo indicating that it is the Communist Officials' ethics that ought to be under supervision. For instance, they cancel manuscripts on personal interests. Reporters were retaliated on, or are imprisoned. They lie in front of the camera, and they conspire and manipulate public opinion, and so on. Zhu Xinxin warns: With the awakening of the entire civil society, more journalists have come out and voiced their righteous thoughts. In the letter, they demanded the regime abide by the law and correct the mistakes in the verdicts of the New Citizen Movement case. On March 2, a joint open letter to the 12th National People's Congress regarding the New Citizen Movement case entitled, "Please hold on to the bottom line of law," was issued by dozens of Chinese citizens. It stated: We are the defense attorneys of Chinese citizens including Xu Zhiyong, Ding Jiaxi, Zhao Changqing...and people from academia, industry, and the media, who care about the New Citizen Movement case. We strongly urge the entire congress to face the fact that the constitutional rights of Chinese citizens have been brutally suppressed and domestic freedom of expression unlawfully restricted, and to demand the relevant departments to correct mistakes in maintaining the rule of law in China and securing the implementation of constitution and laws. The letter concluded that the New Citizens Movement Case is a typical case in China where people are indicted for words. The verdict of Xu Zhiyong's case is a charge out of nothing. Attorney Cheng Hai indicates that the New Citizen Movement itself in fact does not constitute a crime. The movement was initiated to demand public disclosure of official property and fair education. Attorney Cheng Hai: "Our Constitution and the Education Act provide that we have freedom of demonstration, and the right to express views and ideas to the authorities. Their behavior does not constitute a crime." Late last year, in the first instance of the New Citizen Movement case, defendant Xu Zhiyong was sentenced to four years in prison on crimes of gathering crowds to disturb public order. Beijing authorities claimed that Mr. Xu manipulated social issues to organize multiple displays of banners at bustling governmental and commercial areas. Cheng Hai: "It is a taboo to some people, who would elevate it to the level of criminal law. In fact, what they have attacked and damaged is the Constitution, the laws, and the political rights of citizens. The open letter was written to draw the attention of the congress." Cheng Hai says the purpose of the letter is for the People's Congress to supervise Beijing's public prosecutor to correct the verdict and punish those who intentionally made the mistakes. Law Professor, Zhang Zanning, Nanjing Southeast University, indicates that the authorities have trampled its own constitution and law, and violated the citizens' rights to express opinion in public places. Zhang Zanning, Law Professor, Nanjing Southeast University: "Xu Zhiyong's sentence is a great shame to the judiciary system. It expresses the fact that justice is walking backwards and the legal system is just an empty word. The fact that Communist law is obviously deceitful is fully exposed to the world." The open letter also pointed out that the verdict found Xu Zhiyong guilty of gathering crowds to disturb public order, based on the five activities organized. However, two of them were conducted after the Minister of Education Yuan Guiren publicly declared the policy of allowing local education rights to migrant workers' children. During the two activities, the police did not deal with any of the parents, and Xu Zhiyong did not make it to the scene. However, the authorities convicted Xu Zhiyong six months later. The open letter stated that the crackdown on freedom of speech has caused their concern about the rule of law in China. It also addressed that three other activities were organized and conducted to promote the official property declaration previously introduced by National People's Congress for the purpose of anti-corruption. Zhang Qingfang, Xu Zhiyong's defense attorney: "We hope that Congress will perhaps initiate a proposal to correct the case verdict. As the representatives of the people, they should be the guardian of law to ensure respect for the Constitution and the implementation of law and order." However, attorney Zhang Qingfang also expresses that he does not hold much hope towards the Congress. As recently as 10 years ago, Chinese scholars pointed out that the National People's Congress and the Political Consultative Conference are merely rubber stamps of the Chinese Communist Party. A Chinese scholar analyses how former leader Deng Xiaoping's reform and opening policy has in fact disproved Mao Zedong's political movements, the Great Leap Forward and the Cultural Revolution. In order to maintain its ruling legitimacy, the CCP has been entirely deceiving. The People's Daily article is just another sign of the fact that the Third Plenum won't bring change. The People's Daily article was based on the CCP General Secretary Xi Jinping's January speech. On January 5, Xi Jinping talked at a high-level meeting about 'not disproving the history prior to the reform and opening with history after the reform and opening,' and vice versa. Beijing Foreign Studies University associated professor at the School of English and International Studies, Qiao Moo, told the NTD TV that during the 60 years of ruling, the CCP has in fact negated one another. The CCP has also completely disproved the Cultural Revolution. Qiao Moo, Associate professor of Beijing Foreign Studies University: "The first 30 years would definitely have negated the second 30 years. In those 30 years, the so-called people's communes, the Great Leap Forward, the Cultural Revolution, would definitely have negated the reform and opening up of the market economy. The second 30 years also definitely disproved the first 30 years. During the 6th Plenary of the 13th CPC Central Committee, the Cultural Revolution was already disproved. Even Mao was disproved." Qiao Moo analyses a political agenda in Xi Jinping's talk. He wanted to stress the authority of the CCP, the ideology, and the socialist system. Qiao Moo: "Internationalization of the market economy in fact denies or pays no attention to the ideology. To him, not to deny the first 30 years is to restore the system or regain the belief so that the leadership of the CCP can be maintained. Xi Jinping has previously mentioned the importance of the country staying 'red.'" The Chinese liberalism magazine, Yanhuang Chunqiu, deputy director Yang Jisheng explains that the so-called 'no negating each other' means no denying the CCP leadership. Yang Jisheng, deputy director of Yanhuang Chunqiu: "Negating the second 30 years is to negate the reform and opening up, and negating the first 30 years is to negate the leadership of the CCP and Mao Zedong. Mao and the CCP are inseparable. They have to maintain the CCP leadership. They can not deny either one." Former Yahoo China general manager Xie Wen analyses Xi Jinping's talk as trying to bridge the rift in the political infightings. Xie Wen, former general manager of Yahoo China: "Facing the conflict between the rightist and the leftist and the strong demand of reform, he put himself in a neutral position. Some people oppose the first 30 years, while others deny the second 30 years of the CCP ruling. He therefore came up with a neutral idea of not denying either one." Qiao Moo expresses his disbelief in the CCP's closed door policy during meetings. He thinks it is significant as that it matters to a country with a population of 1.3 billion people. It suggests there won't be any fundamental change in the CCP. Qiao Moo: "It is just old wine in a new bottle. Nothing will change. It is like wearing the same shoes and taking the same road. The intellectuals are generally unhappy about it. They want freedom of speech, an independent judiciary, and more academic freedom. According to the suppression of the Internet and the media this year, there is no sign of change." Qiao Moo believes that people care more about the livelihood and welfares, such as pension, health care, and housing, but nothing has happened yet. As for the businessmen, they vote with their feet. For example, Hong Kong businessman Li Ka-shing cut his ownership stake in China, and the massive emigration from China has shown people's concern and distrust of the risk and future in China. Wu Wei, a former aide to central party leaders who were involved in planning China's market overhauls in the 1980s told the New York Times, "In one hand, they're holding up the leftist banner. On the other hand, they say there must be reform," Mr. Wu said. One of the worst recorded incidents of heavy haze has been sweeping through the entire northeastern region of China over the last two months. Last week, the haze continued to envelop 25 Provinces and more than 100 cities. This is nearly half of China. The hazardous fog has diffused from north to south, and yet, the regime's ignorance of air pollution has caused wide anger and resentment. The Chinese National Meteorological Center issued an orange alert on December 8. The alert was for both fog and haze, marking the seventh consecutive day of a double orange alert. Chinese official state media reported that last week, haze had shrouded nearly half of China. It had spread from the north of China, to the southeast coast, and into the southwest region. The Epoch Times had reported earlier, that Hiew-king Tiong, had close ties to former Chinese Communist Party (CCP) leader Jiang Zemin's faction, but has recently crossed over to support the new leader Xi Jinping. Freelance writer Shu Gen told The Epoch Times, "Ming Pao's political stance is really erratic, according to its criticism of Hong Kong's Chief Executive Henry Tang, to the blow of Chief Executive Leung Chun-ying, and its pro-Jiang to pro-Xi Jinping. Chip Tsao, senior journalist: "After they thrust Leung Chun-ying into power, they crushed him by focusing on the illegal construction at Leung Chun-ying's property. Hiew-King wants Lui to interfere with editorial decisions of Hong Kong's Ming Pao, in preparation for the political reform, as well as the Occupy Central protest, and the 25 year anniversary of Tiananmen Massacre. Joseph Cheng: "The CCP has huge United Front resources in Hong Kong and has infiltrated every major institution. Many activist organizations were said to have been infiltrated. "We have heard similar rumors about the infiltration of the CCP in Ming Pao." The seemingly neutral Ming Pao, has reported issues fully in reference to CCP's report. For example, the shooting incident during the 2008 crackdown in Tibet, or in the event of CCP's persecution of Falun Gong, Ming Pao has followed the tone of Xinhua or People's Daily. Recently, Ming Pao also blocked news about the European Parliament's call to end live organ harvesting by CCP. A source revealed that Ming Pao had participated three times to the training courses at Central Party School, which were organized by the Central Propaganda Department. The editorial director and ex-chief editor Cheung Kin-bor was one of the trainees. Hong Kong's senior journalist, Chip Tsao, explains Ming Pao has had a big impact on the ideology of primary and secondary students in Hong Kong. The media said actually, it is the CCP that turns Hong Kong to a political struggle city. Who indeed has created political struggle in Hong Kong? Let's take a look at Hong Kong scholars' analysis. Sino-British Joint Declaration and Hong Kong's Basic Law have clearly stated principle of "One Country, Two Systems". The policy of democratic election in Hong Kong should remain unchanged. Jin Zhong: "Hong Kong people do have some political aspirations. It reflects in protest, parade and street events. These are the facts; there is nothing wrong with it. These political demands didn't conceal the nature of Hong Kong society, which has always been a commercial center." Over the past 20 years, the CCP's commitment to Hong Kong people has dragged on. It has never been fulfilled. However, now the CCP has run to a dead end. Jin Zhong: "Hong Kong people have political aspirations that are legitimate and reasonable. It is abide by Hong Kong Basic Law. So this is not political struggle, This is Hong Kong Basic Law that has provided legitimate rights to its people." On Sept. 19, Hong Kong's Apple Daily published an article titled "The CCP Turns Hong Kong Into A Political City". The article condemned the CCP as "absurd". The article said that Hong Kong citizens and pro-democracy Groups are using a peaceful protest for getting a fair, just and open election system. It is not aiming at any single group or individual person, It can't be regarded as political struggle. It can't be the same as the CCP's violent struggle. Jin Zhong: "The current signs showed that the CCP regime, its representatives in Hong Kong, pro-communist groups and Special Administrative govt. are dragging on 2017 election. Hong Kong people had no choice when they faced this obstacle. They have to stand up to maintain their rights, So political demands take place." The article said it is the CCP and its representative in Hong Kong Leung Chun-ying creating political struggle. Jin Zhong points out that to entirely infiltrate Hong Kong society, the CCP sent many spies to Hong Kong. They manipulated behind the scenes so as to influence the Hong Kong government. They established "Voice of Loving Hong Kong", "Youth Care Association" and other pro-communist groups to attack pro- democracy groups. Since the recent termination of the industrial annual registration and examination system, Chinese lawyers have also demanded the regime abolish the annual assessment on lawyers and law firms. This suggestion was once again brought up recently. Lawyers call on journalists to pose the question during the Communist annual parliamentary meetings: When will the annual review be abolished? Guangdong lawyer Pang Kun indicates that the assessment has no legal basis. It should not have existed. Pang Kun, Guangdong lawyer: "Lawyers have passed the administration process for licenses. There is no need for an annual review. If annual review is required of the lawyers, shouldn't it be also applied to public servants, and other businesses? The annual industrial examination has been terminated. What is it about lawyers that you are afraid of?" Lawyer Pang Kun indicates that, in reality, the annual assessment is a system to control lawyers and force the lawyers to self-censor. A large numbers of lawyers have not been able to continue their practice because of this administrative sanction. He says, to build the rule of law, the regime must abolish the annual review. Accordingly, local judicial bureaus will publish results of annual assessment on lawyers and law firms, conducted in April and May. Many Chinese human rights lawyers failed to pass the review and lost their licenses to practice for handling the so-called "sensitive cases." Beijing human rights lawyer Jiang Tianyong lost his practicing license in July of 2007 for his defending activities for AIDS victims and Falun Gong practitioners' cases. Jiang Tianyong Beijing human rights lawyer: "This annual review or assessment has in fact become a means to collect wealth for the judicial administrative departments, such as the Ministry of Justice, Bureau of Justice, and the government-run All China Lawyers Association. The so-called annual assessment does not really conduct any evaluation of the lawyers and law firm according their year round practice." Jiang Tianyong indicates that there are so many lawyers and law firms in China. There is no way for the authorities to conduct assessment on every one of them. Usually, lawyers and law firms will pass the annual review as long as the local judicial bureau has been notified that the annual fee is paid. Under the review, lawyers and law firms have to pay a compulsory annual membership fee, which has long been criticized as serious corruption. According to reports, there were 424 law firms and 7,398 lawyers in Shenzhen in 2011. Shenzhen Lawyers Association receives an annual fee of as much as 19.28 million yuan ($3.14 million). In addition, the annual fee varies from place to place. A lawyer is subject to 2,320 yuan in Shenzhen, 2,000 in Qingdao, 3,200 in Zhuhai, and 1,300 yuan in Shanghai. Shenzhen charges law firms 5,000 yuan, and Shanghai charges 20,000 the minimum. Some lawyer has estimated that the annual assessment fee would cost several hundred million yuan. Jiang Tianyong explains that since none of the expenditure of the annual fee was ever published, it has become the administrative resort to power and corruption. It has also become an administrative sanction upon law-abiding attorneys. Jiang Tianyong: "Lawyers with irregularities in practicing can often pass the review. However, those lawyers who abide by the law but refuse to be subordinate to the judicial bureau will often meet difficulties during the review." In China, lawyers involved in rights defending or politically sensitive cases are required to "file" reports to the Bureau of Justice and handle cases under the "instruction" of the Bureau. Otherwise, there will be retribution during the annual assessment. Typically, the lawyers are required to submit a self-criticism or letter of guarantees, otherwise, the practice license will be revoked. Traditionally, Christmas Day is an annual commemoration of the birth of Jesus Christ. However, there are two countries' fates which changed on Christmas Day. December 25 becomes a significant meaning for the people in the two countries. On December 25, 1989, Romania's communist regime collapsed. The former president Nicolae Ceausescu and his wife were executed. On Dec. 25, 1991, the former president of Soviet Union Mikhail Gorbachev resigned; the biggest communist regime collapsed. Both dictatorship regimes collapsed on Christmas Day. Since then, Christmas Day became the most significant day for the people of the two countries. People commemorate the birth of Jesus Christ, meanwhile, celebrating the rebirth of their countries and the end of authoritarian rule. The two countries' common factor is that the communist dictatorships were overthrown by their own people. It happens like the old Chinese saying: "Lose the common aspirations of the people, lose the world." Sources say that the former Romania had established a more detailed system than the Soviet Union. It includes national police system, surveillance system and ruthless rule, which outraged people. Once in a clash between civilians and police, the police fired their guns on the people. It triggered a mass protest and parade against the regime On Dec. 21, 1989, Ceausescu gave speeches at a gathering of 100,000 people in a square. Suddenly, one person in the crowd shouted: "Down Ceausescu!" All the people in the square responded positively. The revolution broke out under Ceausescu's nose. In the end, the army joined the civilians, Ceausescu and his wife were shot to death by many guns. The former Soviet Union has also lost peoples' hearts. On Aug. 19, 1991, the Soviet Union communist party tried to come back and plotted a coup. However, the coup was jointly resisted by the people, military and majority of communist party members, three days later the coup was defeated. Zhong Weiguang, Germany-based expert on totalitarianism: "Before the Soviet Union's collapse, among the people, it formed a strong denouncing communist movement. People have abandoned the communist party already." Some people summarized 10 phenomenons before the Soviet Union's collapse. In Mainland China, these phenomena were more displayed. There are many similarities in current China compared with the former Soviet Union before it collapsed. For example, before the Soviet Union's collapse, there were more than 200,000 bloodshed protests happening each year. The GDP increasingly raised, the people's living standard constantly dropped; inflation was severe. The communist officials commonly became corrupted. High-level officials have special supplements. The amount of maintaining stability funds was similar to the national defense fees. Large-scale water conservation projects were built, causing unprecedented natural ecological disasters. Zhong Weiguang: "The Chinese Communist Party (CCP) currently is similar to the Soviet Union in 1989. All the damage caused by the CCP that Chinese people have been through means that Chinese people now have seen even more of their humanity, society, traditions and environment completed destroyed by the CCP. Actually in China, there are more conditions of the CCP collapsing than the Soviet Union in 1989." Compared to the former Soviet Union and Romania, the CCP is facing more complaints from its people. Zhong Weiguang: "Peoples' determination to abolish the communism in the Soviet Union, has existed in China. Also in China, people openly express: "Down the CCP", their resistance of the CCP, protests and curses, happened everywhere. The current CCP has faced more atmosphere of collapse than the Soviet Union and former Germany." On Christmas Day, petitioners from many provinces including Shanghai, Henan, Jiangsu and Guizhou gathered in Beijing. They protested against the miscarriages of justice. On the same day, more than one thousand petitioners held a protest in front of Shanghai town hall. Some people wore petition clothes with words written on: "Down, Overthrow, Eliminate CCP Bandit". Comparing with the former Soviet Union, the CCP is even worse.
