Selective Law Implementation Not Good For Judicial System - Agbaje Prt2

A Nigerian Lawyer, Fred Agbaje, on Monday berated the Federal Government for the “selective implementation” of court judgments, noting that such a trend would impede the development of the judiciary and the rule of law.
Appearing as a guest on Sunrise Daily, Agbaje recalled a situation in June 2013, “when the same Federal High Court gave judgment in respect of Fresh Democratic Party" and nullified the de-registration of the Party.
"For one good year, INEC and Federal Government refused to obey that judgment," he said, disclosing that a Motion For Stay and Notice of Appeal were received about two months ago.
According to him, the party did not sue for contempt because it knew what it would meet. He said that the party had been denied access to contest in the Anambra, Ekiti and Osun governorship elections, despite the court ruling.

Egypt in classism row over prosecutors sacked because parents had no degrees

Fresh concerns have been raised about Egypt’s judicial system, after officials refused to reinstate dozens of young prosecutors who were sacked because their parents lacked a university education.
Just months after they were appointed, 138 new prosecutors were removed from office in September 2013 following a ruling from the judiciary’s governing body that said only those born to parents with undergraduate degrees could join the state prosecution.
The sacked prosecutors – mostly law graduates who left university last summer – accuse the judiciary of classism, and of infringing both Egypt’s constitution, which bans discrimination, as well as international labour laws. A year on, after failing to overturn the decision in the courts, they have asked for the intervention of the president, Abdel Fatah al-Sisi, whose parents did not attend university.
The deadlock is “a disaster to social justice”, Mohamed Kamal-Eddin, one of the excluded prosecutors, told Ahram Online, the English-language version of Egypt’s flagship state newspaper. “This condition is a punishment to the parents for not having received university education. Judges are supposed to be the guards of justice. It is absurd that they decide such a condition. ’’
The justice ministry declined to comment when contacted by the Guardian. So did two spokesmen for the 138 prosecutors, saying the issue was an exclusively Egyptian matter that should not interest foreign media.
Speaking on Egyptian television, a senior judge and former member of the board that banned the prosecutors said the decision was aimed at upholding the quality of the judiciary. “We have nothing against the job of garbage collectors, but their sons belong in other fields than the judiciary, because it’s a sensitive job,” said Justice Ahmed Abdelrahman.
The conflict is the latest in a string of cases to overshadow Egypt’s legal system in recent months, including the politicised trial of three al-Jazeera journalists jailed in June.
Egypt’s judiciary has been criticised for allowing what amounts to the arbitrary detention of tens of thousands of political prisoners, hundreds of whom are held in a secret prison north-east of Cairo. In one notorious case, hundreds were sentenced to death in a single day this April, in two consecutive court cases that lasted just two sessions each.
“The trials themselves are a death sentence to any remaining credibility and independence of Egypt’s criminal justice system,” said Amnesty’s Egypt researcher, Mohamed el-Messiry, at the time.
Egypt’s government insists that its judiciary is independent and impartial, and that the country is governed by the rule of law.

The Huangs are appealing their conviction, which has garnered international attention and raised questions in the media about the prosecution and overall fairness of the Qatari justice system.

"We understand this has a human aspect. We understand their family is waiting for them, and we sympathize with that. But we cannot deny there is a death in this case. There was a death of a little girl, and now, the case is in the court. We have to have respect in the judicial process."

Fresh concerns have been raised about Egypt’s judicial system, after officials refused to reinstate dozens of young prosecutors who were sacked because their parents lacked a university education. Just months after they were appointed, 138 new prosecutors were removed from office in September 2013 following a ruling from the judiciary’s governing body that said only those born to parents with undergraduate degrees could join the state prosecution. The sacked prosecutors – mostly law graduates who left university last summer – accuse the judiciary of classism, and of infringing both Egypt’s constitution, which bans discrimination, as well as international labour laws. A year on, after failing to overturn the decision in the courts, they have asked for the intervention of the president, Abdel Fatah al-Sisi, whose parents did not attend university. The deadlock is “a disaster to social justice”, Mohamed Kamal-Eddin, one of the excluded prosecutors, told Ahram Online, the English-language version of Egypt’s flagship state newspaper. “This condition is a punishment to the parents for not having received university education. Judges are supposed to be the guards of justice. It is absurd that they decide such a condition. ’’ The justice ministry declined to comment when contacted by the Guardian. So did two spokesmen for the 138 prosecutors, saying the issue was an exclusively Egyptian matter that should not interest foreign media. Speaking on Egyptian television, a senior judge and former member of the board that banned the prosecutors said the decision was aimed at upholding the quality of the judiciary. “We have nothing against the job of garbage collectors, but their sons belong in other fields than the judiciary, because it’s a sensitive job,” said Justice Ahmed Abdelrahman. The conflict is the latest in a string of cases to overshadow Egypt’s legal system in recent months, including the politicised trial of three al-Jazeera journalists jailed in June. Egypt’s judiciary has been criticised for allowing what amounts to the arbitrary detention of tens of thousands of political prisoners, hundreds of whom are held in a secret prison north-east of Cairo. In one notorious case, hundreds were sentenced to death in a single day this April, in two consecutive court cases that lasted just two sessions each. “The trials themselves are a death sentence to any remaining credibility and independence of Egypt’s criminal justice system,” said Amnesty’s Egypt researcher, Mohamed el-Messiry, at the time. Preview of an upcoming story on Sacramento Family Court News:In an interview recorded Dec. 16, 2012, a self-represented, disabled family court litigant describes the trauma of separation from her 15-year old daughter because of a court order issued by Sacramento County Family Court Judge Matthew J. Gary. The order prohibited the mother from having any contact with her daughter. Although under state law such a drastic order requires the judge to make specific findings and record the law used by the judge in making the order, the order issued by Judge Gary is barren of the justification and legal rationale. The judge has issued similarly harsh and legally defective orders in other cases and court reporter transcripts show that the judge issues child custody orders as a means of punishment. Under California law, the use of child custody orders as a means to punish a parent is prohibited. The opposing attorney is Timothy Zeff. The mother is unrepresented because she cannot afford an attorney. The "Judiciary" (also known as the judicial system) is the system of courts that interprets and applies the law in the name of the state. The judiciary also provides a mechanism for the resolution of disputes. Under the doctrine of the separation of powers, the judiciary generally does not make law (that is, in a plenary fashion, which is the responsibility of the legislature) or enforce law (which is the responsibility of the executive), but rather interprets law and applies it to the facts of each case. This branch of the state is often tasked with ensuring equal justice under law. It usually consists of a court of final appeal (called the "Supreme court" or "Constitutional court"), together with lower courts.
In many jurisdictions the judicial branch has the power to change laws through the process of judicial review. Courts with judicial review power may annul the laws and rules of the state when it finds them incompatible with a higher norm, such as primary legislation, the provisions of the constitution or international law. Judges constitute a critical force for interpretation and implementation of a constitution, thus de facto in common law countries creating the body of constitutional law.

Syed Zaiduzzaman Hamid, better known as Zaid Hamid, is a Pakistani security consultant and political commentator. His byline in newspaper articles has been Zaid Zaman.
Zaid was born in Karachi, in 1964. His father, Col. Zaman Hamid (Retd), served in the Pakistan Army. Zaid spent his early life in Karachi. He received a Bachelor of Engineering (BE) degree in Computer Systems Engineering from NED University, Karachi in 1980's.
Through his TV programmes, Hamid has claimed that a nexus between India's RAW, the CIA and is responsible for the destabilization of Pakistan. He also claims that the November 2008 Mumbai attacks, were part of a plan hatched by "Hindu Zionists"", and that it was an attempt by the Indians to stage an attack just like the Americans executed the September 11 attacks.
A number of noted Pakistani journalists, writers and Islamic scholars have criticized Hamid and have described his views on politics and security as conspiracy theories.

Arindam Chaudhuri (Bengali: অরিন্দম চুধুরি; born 8 December 1971) is an Indian economist[citation needed], author and the director of IIPM Think Tank at Indian Institute of Planning and Management[citation needed]. Arindam is the son of Malayendra Kisor Chaudhuri, who founded the Indian Institute of Planning and Management (IIPM) in 1973[citation needed]. He received his post graduate diploma in Planning and Entrepreneurship from IIPM in 1992 He later became the Honorary Dean for the IIPM Centre for Economic Research and Advanced Studies.
