Constitutionality is the condition of acting in accordance with an applicable constitution; the status of a law, a procedure, or an act's accordance with the laws or guidelines set forth in the applicable constitution. When one of these (laws, procedures, or acts) directly violates the constitution it is unconstitutional. All the rest are considered constitutional until challenged and declared otherwise.

An act (or statute) enacted as law either by a national legislature or by the legislature of a subordinate level of government (such as a state or province) may be declared unconstitutional.

However, governments do not just create laws. Governments also enforce the laws set forth in the document defining the government -- in the Constitution. In the United States, the failure to seat duly elected representatives of the people following a proper election, or the failure to provide for such elections would be unconstitutional even in the absence of any legislated laws whatsoever.

When the proper court determines that a legislative act (a law) conflicts with the constitution, it finds that law unconstitutional and declares it void in whole or in part. This is called judicial review. The portion of the law that is declared void is considered to be struck down, or the entire statute is considered to be struck from the statute books.

Ernest Scott Garrett (born July 9, 1959) is the U.S. Representative for New Jersey's 5th congressional district, serving since 2003. He is a member of the Republican Party. The district includes much of the northwestern portion of the state. He previously served in the New Jersey General Assembly from 1990 to 2002.

Garrett earned a Bachelor of Arts (B.A.) degree from Montclair State University in 1981 and a Juris Doctor (J.D.) from Rutgers School of Law - Camden in 1984.

He served in the New Jersey General Assembly from 1990 to 2002 representing the 24th legislative district, which covers all of Sussex County and several municipalities in Morris and Hunterdon counties.

Although Garrett promoted himself as a "mainstream tax-cutter that President Bush needs in Congress," he broke with the Bush Administration several times.

He also serves on the Liberty Caucus (despite opposing the legalization of online poker), a group of libertarian-minded congressmen. Other members include Ron Paul of Texas, Jimmy Duncan of Tennessee, Roscoe Bartlett of Maryland, Walter B. Jones of North Carolina, and Jeff Flake of Arizona.

Marc Lemire is a figure in the Canadian far right "white nationalist" movement. He works closely with leader Paul Fromm, and is the webmaster of the Hamilton, Ontario-based Freedom-Site which he began in 1996. He has been called a "bigot" by Jonathan Kay of the National Post. Formerly of Toronto and now living in Hamilton, Lemire was the last president of the often violent Heritage Front organization from January 1, 2001 until the organization folded around 2005.

In 1997, Lemire ran for school trustee in Toronto Public School Ward P17, but lost after receiving only 2,503 votes (or 12% of the total). In the mid-1990s he was a Canadian Armed Forces reservist. In their 1997 Annual Audit of Antisemitic Incidents, B'nai Brith Canada wrote, "Marc Lemire, webmaster of the Freedom-Site that hosts the websites of several of Canada’s most virulent antisemitic organizations such as the Heritage Front, The Canadian Patriots Network and the Citizens for Foreign Aid Reform". In 1998, the Canadian Broadcasting Corporation called The Canadian Patriots Network a "hate website".

Mark Reed Levin (born September 21, 1957) is a lawyer, author and the host of American syndicated radio show The Mark Levin Show. Levin served in the administration of President Ronald Reagan and was a chief of staff for Attorney General Edwin Meese. He is president of the Landmark Legal Foundation, has authored bestselling books and contributes commentary to various media outlets such as National Review Online.

Mark Reed Levin was born to a Jewish family in Philadelphia, Pennsylvania and grew up in Cheltenham Township, Montgomery County, Pennsylvania. He graduated from Cheltenham High School after three years. After high school, Levin enrolled at Temple University Ambler including summer classes and graduated in 1977 at age 19, magna cum laude and Phi Beta Kappa. He also earned a juris doctorate from Temple University Beasley School of Law in 1980.

Beginning in 1981, Levin served as advisor to several members of President Ronald Reagan's cabinet, eventually becoming Associate Director of Presidential Personnel and ultimately Chief of Staff to Attorney General Edwin Meese; Levin also served as Deputy Assistant Secretary for Elementary and Secondary Education at the U.S. Department of Education, and Deputy Solicitor of the U.S. Department of the Interior.
