-EPA Regulators FailTo Protect South Asheville, NC: Toxic Disaster Managed Not Mitigated- This is the story of real people tragically and devastatingly abused by EPA Region 4 regulators with the duplicity of NC Department of Environment and Natural Resources. The badges only garner so much faith, because we live in a trust but verify world. This is part one of a multi-part documentary detailing exactly how EPA failed to protect the families living near the CTS of Asheville, Inc. CERCLIS site. This is the story of how a $30,000,000.00 Elephant was built in the proverbial room, where an upscale subdivision was built on a toxic waste site in EPA and NCDENR's Inventory of hazardous sites. This is the story of our allegations backed in documentation that EPA Region 4 tried to withhold, claimed was lost and in some cases altered. This is the story of how EPA Region 4 officials faked a hazardous incident on August 21, 1999, ran it through the US Coast Guard National Response Center on August 23, 1999, to create a "fake" CERCLIS site to place on the victims' property in order to generate $200,000.00 in EMERGENCY CERCLA Funding to "respond" to a preexisting ( July 8, 1999 ) groundwater contamination event emanating from a preexisting CERCLIS site called CTS of Asheville Inc. This is the story of 50 people diagnosed with non-Hodgkin Lymphoma within one mile of the plant and scores of other cancer victims, including pancreatic, liver, brain, thyroid, nasal and throat. This is the story of one family who has been ridden hard and put up wet by the regulators who betrayed the fundamental mission of USEPA and this is the story of the cover-up. The documentaries served to educate and to elicit the proper response to the ongoing disaster that has yet to be cleaned and its 2012. The Rice family had their property, located next door to the CTS of Asheville plant trespassed upon by EPA Region 4 on June 26, 1990. No one asked for permission, no one informed the Rices and no one ever told them that the sediment above their drinking springs was severely contaminated with 1,100 arts per billion of DCE, which is a known degradation product of Trichloroethylene. Nine years later when EPA returns to "re-doscover" this toxic waste still migrating, the Rices were drinking from springs that were 7,000 times the state limit for TCE or 21,000 ppb. In February 2007, those same springs were sampled at a mind-blowing 293,000 ppb of TCE and EPA Region 4 officials ignored it. Terry Rice's crawl space was tested in December 2007 and it was 48 times the cancer screening level. EPA REgion 4 did not return again to sample the air in Terry's living space until August 2008 and it was 16 times the cancer screening level for TCE in vapor.... The heart-breaking devastation has been inflicted on our community as much from EPA Region 4 officials as the actual contaminator.... An who is fighting this disaster? Who is fighting for the proper response from an un-compromised Region at USEPA to get to the primary source of contamination that has yet to be properly addressed? Who is fighting for the proper vapor assessment under a Removal Authority?Who is fighting for real accountability, reform and environmental justice? An eclectic mix of local residents, who bring their strengths and flaws to the table. I am a high school US History Teacher and Soccer Coach. I have a wife and two children under the ages of 6 and I have Cyanide and Chromium in my well. My neighbors, the Murphy's have Cyanide, Chromium, and untold levels of PAH's, and their well went dry. They have a garden hose from a neighbor providing water and they have a twenty month old living there. The county has a moratorium on digging wells near the old CTS site. The Murphy's are in the fight. Others in the fight include Aaron Pendland, who lost his father and eight aunts and uncles to cancer and they all lived within 2 miles of CTS. Barry Durand, a gentle soul with a chemistry background has been the repository for collecting the documents. Barry was the spark in this over 5 years ag, spearheading this almost alone until others joined in.... Dave Ogren was the first one to ever report a problem of groundwater contamination and that was in 1987 and that is documented. Others include homeowners in that $30,000,000 toxic subdivision, like Glen and Gina Horecky, Judy and Bob Selz and Laura Carson. Still others living under the threat of toxic well water like Patricia and Bud Pinner have fought alongside us and the list goes on and on.... Because of our work, the state has made funds available for city water for the tax payers to absorb and EPA has made it possible for CTS Corp to get away with it... We hope you will watch what happens on the micro level to a small town community, when the regulators team up with the contaminators in the most unholy of matrimonies...
