The legal status of Republic of China (commonly known as Taiwan) is a controversial issue which stems from the complex post-Second World War history of Taiwan. Various claims have been made by the People's Republic of China (PRC), the Republic of China (ROC), and supporters of Taiwan independence over this question, with a variety of arguments advanced by all sides. The question has significant bearing on the political status of Taiwan and touches upon many aspects of international law. In practice, sovereignty over Taiwan is exercised by the Republic of China.

Taiwan (Formosa) including the Pescadores were permanently ceded by Qing Dynasty China to Imperial Japan via Articles 2b and 2c of the Treaty of Shimonoseki in 8 May 1895 in one of what the Chinese term as an unequal treaty. Kinmen and Matsu Islands on the coast of Fukien, and the islands in the South China Sea currently administered by the Republic of China on Taiwan were not part of the cession.

In 1895, subsequent to the Treaty of Shimonoseki, officials in Taiwan declared independence in the hope of returning the island to Qing rule. The Republic of Taiwan (1895) collapsed after 12 days due to political infighting, but local leaders continued resistance in the hope of achieving self-rule. The incoming Japanese crushed the island's independence bid in a five-month campaign.

The controversy regarding the political status of Taiwan (or "Taiwan Issue" as referred to by the Communist Party of China) hinges on whether Taiwan, Penghu, Kinmen, and Matsu should remain effectively independent as territory of the Republic of China (ROC), become unified with the territories now governed by the People's Republic of China (PRC), or formally declare independence and become the Republic of Taiwan; furthermore, on whether its existence and status as a state ("country") is legitimate and recognized by the international community.

Currently, Taiwan, Penghu, Kinmen, Matsu, and some other minor islands effectively make up the jurisdiction of the state with the official name of Republic of China but widely known as "Taiwan". The ROC, which took control of Taiwan (including Penghu and other nearby islands) in 1945, ruled mainland China and claimed sovereignty over Outer Mongolia (now Mongolia) and Tannu Uriankhai (part of which is present day Tuva, Russia) before losing the Chinese Civil War and relocating its government to Taipei, Taiwan in December 1949.

Taiwan (ⁱ/ˌtaɪˈwɑːn/ TY-WAHN; Chinese: 臺灣 or 台灣; pinyin: Táiwān; see below), officially the Republic of China (ROC; Chinese: 中華民國; pinyin: Zhōnghuá Mínguó), is a state in East Asia. Originally based in mainland China, the Republic of China now governs the island of Taiwan (formerly known as Formosa), which forms over 99% of its current territory, as well as Penghu, Kinmen, Matsu, and other minor islands. Neighboring states include the People's Republic of China to the west, Japan to the east and northeast, and the Philippines to the south. Taipei is the capital city and economic and cultural centre of the country, and New Taipei is the most populous city.

The earliest evidence of inhabitation of Taiwan dates back to the late Paleolithic era. The island of Taiwan was mainly inhabited by Taiwanese aborigines before being colonized in the 17th century by the Dutch and the Spanish Empire. The first Han Chinese polity on Taiwan began when Koxinga's troops defeated Dutch forces and established the Kingdom of Tungning. The island was subsequently ruled by the Qing Dynasty after the kingdom's defeat in the Battle of Penghu in 1683, a period that lasted for over 200 years. Following Japan's victory over the Qing Dynasty in the first Sino-Japanese war, Taiwan was ceded to Japan under the Treaty of Shimonoseki in 1895.

A person's status is a set of social conditions or relationships created and vested in an individual by an act of law rather than by the consensual acts of the parties, and it is in rem, i.e. these conditions must be recognised by the world. It is the qualities of universality and permanence that distinguish status from consensual relationships such as employment and agency. Hence, a person's status and its attributes are set by the law of the domicile if born in a common law state, or by the law of nationality if born in a civil law state and this status and its attendant capacities should be recognised wherever the person may later travel.

In early laws, an outlaw was a person who, by judicial process, was deprived of all normal rights as a human being unless and until a court reversed itself through an affirmative act of inlawry. This was a form of civil death. Similarly, a slave was a chattel or possession, and had no legal personality except that, in the U.S., some of the Free States did allow limited legal personality. Legal personality could be surrendered voluntarily by becoming a monk or by travelling, e.g. the first provisions of the French Civil Code deny civil rights to foreigners. As an aspect of the social contract between a state and the citizens who owe it allegiance, most developed legal systems contain positive provisions defining each individual's legal identity and its attributes. All matters of social rank or caste are examples of personal status, the modern extremes of which would be nobility and the 200 million dalits, the untouchables of India.

Jeremy Shu-How Lin (born August 23, 1988) is an American professional basketball player with the New York Knicks of the National Basketball Association (NBA). After receiving no athletic scholarship offers out of high school and being undrafted out of college, the 2010 Harvard University graduate reached a partially guaranteed contract deal later that year with his hometown Golden State Warriors.

Lin seldom played in his rookie season and was assigned to the NBA Development League (D-League) three times. He was waived by the Warriors and the Houston Rockets the following preseason before joining the Knicks early in the 2011–12 season. He was again assigned to the D-League and continued to play sparingly. In February 2012, he unexpectedly led a winning streak by New York while being promoted to the starting lineup, which generated a global following known as Linsanity. Lin is one of the few Asian Americans in NBA history, and the first American of Chinese or Taiwanese descent to play in the league. He is known for his public expression of the Christian faith.
