The tensions, shaped by China's growing assertiveness, have fueled concerns over armed conflict and raised questions about Washington's security commitments in its strategic rebalance toward the Asia-Pacific region. "Maritime disputes in the East and South China Seas are a pressing issue for the United States, China, and much of the rest of the world," says Elizabeth Economy, CFR's Director for Asia Studies. The region is rich in natural resources, home to many of the world's most dynamic economies, and an important global trade route for energy supplies and other goods. It is also a region in which power politics are at play and defense budgets are rising rapidly. As China's economic ascent facilitates growing military capabilities and assertiveness in both the East and South China Seas, other regional players are also experiencing their own rise in nationalism and military capability, and have exhibited greater willingness to stake territorial claims. Meanwhile, the U.S. "pivot" to Asia, involving renewed diplomatic activity and military redeployment, could signal Washington's heightened role in the disputes. If not managed wisely, these disputes could turn part of Asia's maritime regions from thriving trade channels into arenas of conflict. "If there is a use of force between Japan and China, this could be a full-on, all -out conflict between these two Asian giants, and as a treaty ally of Japan, will automatically trigger or automatically involve the United States," cautions Sheila A. Smith, CFR's Senior Fellow for Japan Studies. These dynamics pose an "exquisite" dilemma for U.S. foreign policy, says CFR President Richard N. Haass. As its military and economy have grown, so too have China's dreams of dominating an island chain centered on Taiwan and including Japan's Senkakus. China's increased belligerence in the region is part of its plan to control the Yellow Sea, the South China Sea and the larger East China Sea. Its military doctrine refers to dominance over the "first island chain," which encompasses the East China Sea. The next step is dominance over what Beijing calls the second island chain extending from Japan to Indonesia. Some analysts have even speculated about plans for a third island chain strategy extending as far as Hawaii. China military will take "defensive emergency measures" if aircraft enter the area without reporting flight plans or identifying themselves. China's defense ministry warned in a statement that all aircraft that fail to comply with its new rules for transit through the zone could be shot down. Media reports say that the ministry issued a map showing the new East China Sea Air Defense Identification Zone, including what the Chinese call the Diaoyu Islands. The map of the new defense zone, pulled off a Chinese website, shows that it overlaps Japan's defense zone over the Senkakus, a group of uninhabited islands located south of Okinawa and north of Taiwan that sit atop significant oil deposits. Tensions escalated in February when Japanese Prime Minister Shinzo Abe denounced what he said was China's use of fire-control radar in January twice on Japanese targets in the East China Sea. Japan's Defense Ministry said that it sent jets up 306 times in the 12 months ended in March 2013 and 149 times in the April-September period in response to Chinese incursions. According to Vietnam's coast guard, the boat was encircled by 40 Chinese vessels before it was attacked. All 10 fishermen on board were rescued. There was no immediate comment from China on the incident. The two are locked in an intensifying dispute over South China Sea territory. Vietnam has protested against China moving its Haiyang Shiyou 981 rig to waters also claimed by Hanoi, at a spot near the disputed Paracel Islands. Both sides have ships engaged in a stand-off in the area and there have been several reported collisions. China may struggle to enforce new fishing regulations in disputed South China Sea
Originally published on January 16, 2014 China may struggle to enforce new fishing rules issued to restrict fishing by foreign vessels in disputed areas of the South China Sea due to difficulties in establishing a centralised coastguard, according to a Chinese official quoted by the South China Morning Post. Beijing claims almost the entire oil- and gas-rich South China Sea as its own. Since January 1st it issued new regulations requiring foreign fishermen to seek Beijing's approval to operate in the disputed waters. It is the first time China has made a clear legal claim to the disputed waters claimed by Vietnam, Philippines, Malaysia, Brunei, and other states in the region. According to the new regulations, any foreign fishing vessel entering the disputed area without permission will have its catch confiscated by Chinese marine surveillance and will be expelled along with a 500,000 yuan (USD 82,700) fine. To enforce the new rules China integrated four sprawling maritime law enforcement entities into a unified coastguard in an effort to make the coastguard more efficient and responsive. But, according to Lin Yun, director of legal affairs for the Hainan Department of Ocean and Fisheries, preparations to reform the coastguard are only half complete. "The merger [of the four law enforcement agencies] has not been smooth as this involves too many personnel and the restructuring of bureaucracies and their responsibilities," Lin told the Post. Despite the continuing build-up of maritime enforcement capabilities, China allegedly still lacks sufficient maritime patrol aircraft and naval vessels to consistently cover this vast area. According to the South China Morning Post, "A report by the International Crisis Group in 2012 said Chinese law enforcement vessels risked causing international incidents in the absence of legal clarity on which waters should be considered under Beijing's jurisdiction." Among the most critical countries of China's claims are The Philippines and Vietnam, who say the rules infringe on their own exclusive economic zones. Japan and the US have also criticised the regulations as "provocative and potentially dangerous", Reuters reported. China has announced it is moving a second oil rig in the South China sea closer to Vietnam's coast. A semi-submersible drilling rig, the Nan Hai Jiu Hao is currently being towed southeast of its original position south of China's Hainan Island at four nautical miles per hour, Vietnam's Thanh Nien News reported. Online magazine The Diplomat says that by late Friday, the rig will be in its final location at 17°14.1′ North latitude and 109°31′ East longitude off the coast of Vietnam. There is however some ambiguity about precisely where this second rig will end up; whether it will stop within or outside Vietnam's exclusive economic zone. As Reuters reported, this second oil rig announcement comes at a time when many countries in Asia are nervous at China's increasing assertiveness in the South China Sea. According to the Diplomat, the Nan Hai Jiu Hao will not concern Vietnam to the same extent as the first oil rig — which was moved to a position 120 miles off Vietnam's coast and near one of the disputed Paracel Island — did in early May. Still, the Diplomat continues, "the timing of China's statement on this second oil rig is curious given that Chinese State Councilor Yang Jiechi was just in Hanoi to nominally discuss the issue with Vietnamese officials and attempt to salvage some normalcy in bilateral ties." The relationship between China and Vietnam remains tense. On Wednesday, after the announcement, China's Foreign Ministry quoted State Councilor Yang Jiechi told Vietnam to stop disturbing Chinese operations at sea or creating new disputes over challenged territory in the South China Sea. Vietnamese Prime Minister Nguyen Tan Dung, on the other hand, said his government will consider taking legal action against China to resolve the dispute. China's territorial claims in the South China Sea not only overlap with those of Vietnam, but also with those of the Philippines, Malaysia and Brunei for the sovereignty over countless of islands and reefs.- published: 19 Jul 2014
