Mumia Update from the MOVE Organization and ICFFMAJ

As most of you already know, Mumia was transferred to SCI-Mahanoy in upstate PA. more than a month ago, directly after Phila. prosecutor Seth Williams announced that he wasn’t pursuing the death penalty in Mumia’s case.  This meant that Mumia’s sentence went from death to life in prison without parole.

Since arriving at SCI-Mahanoy, Mumia has been in the hole, on AC (administrative custody) status, solitary confinement, even though there is no valid reason for him to be in the hole.  The conditions are torturous
and much worse than the conditions on death row.  These conditions have been condemned by the United Nations as torturous.

Since arriving at Mahanoy, Superintendent John Kerestes and his staff have gone from one thing to the next to vent their fury and racism on Mumia.  First they claimed to be waiting on paperwork that Mumia’s sentence is a life sentence and not death, but Mahanoy has no death chamber, so Mumia would
never be sent there if he still had a death sentence.

Prison officials blame Mumia’s dreadlocks for his solitary confinement

In a statement issued late Thursday, January 12, an attorney for Mumia Abu-Jamal reported that he has been given a new reason for his continued solitary confinement – his long dreadlocks.

Prison authorities at SCI Mahanoy claim Abu-Jamal will be held in the Restricted Housing Unit on disciplinary custody until he cuts his hair. This is an old tactic that was used against Mumia when he was a death row prisoner. He spent 8 years on disciplinary status in death row until he was removed from that status–without getting a haircut–in the early 1990s.

It has taken prison officials five weeks to invent this new pretext for continuing the 30-year-long solitary confinement torture of Abu-Jamal. Mumia and his supporters are calling for his immediate release to general population and the shut down of all of the solitary units in PA.

But he was also given a ten year hit by the New Jersey State Parole Board. Last December, an administrative appeal was denied by the NJ Parole Board and a letter affirming the denial of Sundiata’s parole was received. Court grants new sentencing for Mumia Abu-Jamal

PHILADELPHIA – April 26, 2011 (WPVI) — A federal appeals court on Tuesday ordered a new sentencing hearing for convicted police killer and death-row activist Mumia Abu-Jamal, finding for a second time that the death-penalty instructions given to the jury at his 1982 trial were potentially misleading.

The 3rd U.S. Circuit Court of Appeals told prosecutors to conduct the new sentencing hearing for the former Black Panther within six months or agree to a life sentence. Abu-Jamal’s first-degree murder conviction still stands in the fatal shooting of Officer Daniel Faulkner, who was white.

District Attorney Seth Williams pledged to mount another appeal to the U.S. Supreme Court, at the urging of Faulkner’s widow, Maureen.

“Yes, the criminal justice system in Philadelphia, the criminal justice system in America, have had a history of problems and racism,” said Williams, the city’s first black district attorney. “(But) this is not a whodunit.”

Abu-Jamal’s worldwide followers “don’t know the facts,” Williams said.

Defense lawyers said the ruling addresses “an unfortunate chapter in Pennsylvania history.”

“Pennsylvania long ago abandoned the confusing and misleading instructions and verdict slip that were relied on in Mr. Abu-Jamal’s trial in order to prevent unfair and unjust death sentences,” said Widener University law professor Judith Ritter, who argued the most recent appeal in November. “Mr. Abu-Jamal is entitled to no less constitutional protection.”

Tuesday’s ruling is the latest in Abu-Jamal’s long-running legal saga. (more…)
