I am looking for some help on a criminal case of retail theft?

One of my dear friends and her husband fell on desperate times recently and went to Walmart. While there getting items such as food diapers personal hygiene stuff along with other misc. items, they realized they did not have enough in their account. They I guess panicked knowing they needed the items and decided to try and walk out with the stuff. They got caught and police came. Arrested my friend and let her husband go back home to get there oldest from school and then he had to come to the station. They got released with a court date but can't afford any legal services. This is their very first time having anything like this happen and they have no idea whats going to happen or what to expect. The police report states misc. items of food and baby items equaling les then 300 dollars. is this felony or misdemeanor? If they should plead guilty or innocent or know of any place to call for free legal advice? What chance do they have avoiding jail? Worry about jail with kids. Thanks :)

    If they were able to somehow talk the store into dropping the charges and promising to pay the money and they explained their situation they might get out of it. If that doesn't work and since the stolen (attempted stolen) merchandise was over 20 dollars they could go to jail. Considering they have kids they may get away with community service and a bad mark on their record but with so many factors you cant be sure. Its up to judge and jury. Good luck to them

    I have a friend who is a retail theft consultant and answers such questions privately for no fee. He says that if they have no prior criminal history the chances of jail are very unlikely. They should talk to an Attorney about their options. Many offer free consultations they should get as many as they can. tell them to asks about ACD or Diversion as plea options to protect their records. He also advises you remove store name from post to further protect them
