These rules govern how an appeal may be commenced, what kind of notice is required, the types of briefs, pleadings or statements of case, motions, and orders allowed in appeals, the timing and manner of the appeal, the conduct of appellate hearings, the process for decisions, various available remedies, and how the courts and clerks must function. The rules which control the nature and conduct of a legal appeal, which may be: door closing e.g., "the notice of appeal shall be filed with the clerk of the lower court within thirty days of the date of the entry of the judgment appealed from" discretionary e.g., "upon a showing of excusable neglect, the lower court may extend the time for filing the notice of appeal for a period not to exceed thirty days" technical e.g., "the composition of the record on appeal shall include the original papers and exhibits on file, the transcript of proceedings, and a certified copy of the docket entries..." process oriented e.g., requirements for giving copies of all papers filed to all other parties economic e.g., filing fees, assessments of legal costs, etc. punitive e.g., penalties for infractions such as frivolous appeals informative e.g., the duties of the clerk's office.

Below is the transcript for the recording: Foreign Sales Corporations was a means formerly provided by United States taxation law for US companies to receive a reduction in US federal income taxes for profits derived from exports, through the use of an offshore subsidiary . The European Union launched proceedings against these provisions in the World Trade Organization in 1999, claiming they were an export subsidy. In March 2000, the Appellate Body of the WTO found that the FSC provisions constituted a prohibited export subsidy under the General Agreement on Tariffs and Trade Uruguay Round code on Subsidies and Countervailing Measures . The US Congress then adopted in November 2000 the Extraterritorial Income Exclusion Act , to repeal the FSC legislation and to introduce new provisions to exclude extraterritorial income from taxation. The European Union challenged ETI in 2001, claiming it did not properly implement the earlier WTO decision - they argued it effectively retained the export subsidy, albeit under a different name. The WTO found the ETI to be a prohibited export subsidy. The US did not meet the deadline to implement this decision, and on 30 August 2002, the WTO approved the European Union request for over USD 4 billion in retaliatory tariffs. However, most observers view it as unlikely that the European Union will implement the sanctions, since the disruption that would cause to transatlantic trade would rebound on European companies; it is likely rather than the EU will seek to use the threat of sanctions as a bargaining chip to obtain concessions from the US in other areas. The origins of the FSC dispute date back to 1971, when the US introduced legislation providing for "Domestic international sales corporations" . These were challenged by the European Community under the GATT. The United States then counterclaimed that European tax regulations concerning extraterritorial income were also GATT-incompatible. In 1976, a GATT panel found that both DISCs and the European tax regulations were GATT-incompatible. However, these cases were settled by the Tokyo Round Code on Subsidies and Countervailing Duties , and the GATT Council decided in 1981 to adopt the panel reports subject to the understanding that the terms of the settlement would apply. However, the WTO Panel in the 1999 case would later rule that the 1981 decision did not constitute a legal instrument within the meaning of GATT-1994, and hence was not binding on the panel.

A Fourth Court of Appeals opinion, released Friday, found the improper photography statute to be unconstitutional. It's the law that protects you and your children from video recordings or pictures that are taken without your permission to sexually arouse or gratify another person. It covers up the skirt pictures or pictures taken of children's body parts at pools or water parks.The appellate court ruled the law is too broad and infringes upon your freedom of expression rights, guaranteed by the First Amendment.I was surprised. I was very surprised, said First Assistant District Attorney Cliff Herberg. I think the public has a right to be concerned because this is one of the things we've seen in the digital age.The opinion could jeopardize pending cases in Bexar and 31 other counties that fall under the appellate court's jurisdiction.This is an important case in maintaining people's privacy and for lack of better term, their dignity, he said.50-year-old Ronald Thompson's attorney challenged the law. Thompson was indicted on 26 felony counts of improper photography, for allegedly taking pictures of children's private areas at SeaWorld.These are pictures that are not child pornography, but child erotica. These are pictures designed to sexually gratify someone, Herberg explained.It's in dispute what did. We haven't had a trial, Thompson's attorney Don Flanary explained. He says the improper photography statute is too broad.If a paparazzi takes a picture of Britney Spears and they publish it to make money selling magazines, that violates the statute, he said.The court agreed, and the court also found the statute violates the First Amendment.When it says any person that takes a photograph of any other person without their consent with their thoughts to gratify their desires, that implicates their free expression. The First Amendment protects your free expression, Flanary said.The ruling applies to photography in public places. Your privacy in a bathroom or dressing room is still protected.I absolutely want our legislature to write a good statute that protects our children. The problem is, they didn't do that, Flanary said.The statute went into effect in 2003. Three other courts of appeal in the state have upheld it and Susan Reed will appeal Friday's opinion. She will also ask the court to put all pending cases on hold, Herberg said.To read the opinion, click here.
