A treaty is a legally binding agreement, It creates rights and obligations between international legal persons, who are recognized as having treaty-making capacity.
For example, The League of Nations Covenant, the Vienna Convention on Diplomatic Relations, the UN Charter, and the ICJ Statute, are all international law treaties.
It is irrelevant how the agreement is formulated, and what name was given to it by the parties, as long as it is intended to be legally binding, by creating rights and duties.
No formal requirements must be satisfied before a 'treaty' can exist. However, the Vienna Convention applies only to written treaties.

They Push Ahead With Treaty and Division
The result of the Indigenous Voice to Parliament is clear, a resounding No in all states. The only territory to not vote No was the Australian Capital Territory, with a Yes vote of 60.8%. Queensland, where I live, got the lowest Yes vote in the nation at 31.2%. Despite this, Premier Annastacia Palaszczuk is pushing ahead with a treaty with Indigenous people. She said, “The Australian people have spoken. And their voice tells me they’re not ready. Not yet.” Oh, we’re not ready? If we’re just given a bit more time, then we’ll be ready? It’s a fairly arrogant thing to say, don’t you think?

Did you know that November 8th is marked as Indigenous Veterans Day? For over years, Canadians have set aside the 11th Day of November to remember the sacrifices of soldiers who fought for Canada and the British Commonwealth in global conflicts that took place in foreign lands. Most Canadians are not aware of the contributions made by Indigenous Warriors in those military campaigns, nor of the crucial role they played during the War of 1812 -- the only war ever fought on Canadian soil. In defending the lands occupied by themselves and settler newcomers, Indigenous Warriors were honouring Treaty promises they made to be British allies "as long as the sun rises in the east". A treaty is a legally binding agreement, It creates rights and obligations between international legal persons, who are recognized as having treaty-making capacity.
For example, The League of Nations Covenant, the Vienna Convention on Diplomatic Relations, the UN Charter, and the ICJ Statute, are all international law treaties.
It is irrelevant how the agreement is formulated, and what name was given to it by the parties, as long as it is intended to be legally binding, by creating rights and duties.
No formal requirements must be satisfied before a 'treaty' can exist. However, the Vienna Convention applies only to written treaties.
A treaty may arise from the deliberations of an international conference, negotiations, or informal governmental discussions, an 'exchange of notes' , or an 'exchange of letters, or any other means the parties choose.
In the Maritime dispute between Bahrain and Qatar, the ICJ rejected Bahrain's claim, that the minutes of a meeting with Qatar, did not constitute a 'treaty' in international law. The court confirmed the existence of a treaty, and that the Vienna Convention does not define, what constitutes a treaty.
In addition, a treaty can create obligations or rights for one party only, as the doctrine of 'consideration' in the UK law of contract, does not exist in international law.
For example, the Agreement between the UK and China regarding Hong Kong, transferred the territory to China without any monetary rights to Britain.

The Queensland Government actually have a Department of Treaty and Aboriginal Partnerships.
According to the Cambridge Dictionary, a treaty is “a written agreement between two or more countries, formally approved and signed by their leaders”. Exactly which two countries are we signing agreements between? Australia and Australia?
In Queensland, there is also a Minister for Treaty, Leeanne Enoch, Queensland’s first Indigenous female MP. A spokesman from her department stated, “The Queensland Parliament earlier this year passed historic Path to Treaty legislation, with the bipartisan support of the entire opposition and will continue”. According to the Government, nothing is going to stop this from happening. It doesn’t matter how you voted.
Don’t you think it would be fairer to the Queensland people to wait until next election before pushing ahead with this? The next election is only one year away in October 2024. What’s the rush? Why is the Premier so eager to do this now? I think she probably knows she’s on the way out and she wants to build some sort of legacy.
If you think the Opposition is against this, well, you’d be mistaken. Opposition Leader David Crisafulli said he is committed in continuing Queensland’s path to treaty and truth-telling if the LNP is elected next October.
I perhaps naively thought that this overwhelming No result would somehow settle things down a bit, but no, the path of division continues. The national broadcaster, ABC’s Triple J radio station aired a piece by Indigenous rapper Nooky on his Blak Out program, where he essentially called Australians racist and called for Indigenous folk to take up arms, metaphorically or otherwise.
“Walawaani, I’m Nooky. I’m a proud Yuin man, born and raised in Nowra, and this is Blak Out on Triple J. October 14 was a moment in history where a dark cloud forever cast a shadow. I feel like I let down my elders. I feel like I let down the future generations. Last night was the most overt unconcealed manifestation of racism I’ve every experienced in my whole life. Yesterday, they said our pain and our suffering continues. The disadvantage and the inequality continues. And in this moment, I’m broken, but I’m not defeated. And regardless of yesterday’s outcome, there was always work to do. We haven’t lost a thing. We all knew what the outcome was going to be. We all know the reality that we live in. It’s just now more apparent. We ain’t licking our wounds today. We’re sharpening our spears! We’re the oldest culture on Earth, and we have survived the white man’s world. We did not give up this land, and the planting of the Union Jack never changed our lore at all. We’re gonna repeat this message until it rings true. We will not sit in silence. They will hear us as we rejoice as a people, and light out sacred fire in the face of their broken promises. Treaty now!”
Treaty now. He then went on to play Yothu Yindi’s Treaty on a continuous loop for one hour. “We ain’t licking our wounds today. We’re sharpening our spears!”
Another Indigenous ABC employee, Europe correspondent Isabella Higgins, also made some commentary that seemed to indicate that hostility is now potentially on the cards, or at the very least, less cordial interaction between Indigenous and non-Indigenous people.
Leading No campaigner, Indigenous Senator Jacinta Price had her home attacked by vandals who threw red paint in glass bottles at the side of her house after the referendum result. So we thought the Voice was over with this No vote? It looks like they’re just getting started.

Most Canadians are not aware of the contributions made by Indigenous Warriors in those military campaigns, nor of the crucial role they played during the War of 1812 -- the only war ever fought on Canadian soil. In defending the lands occupied by themselves and settler newcomers, Indigenous Warriors were honouring Treaty promises they made to be British allies "as long as the sun rises in the east". Come and learn about some of the greatest heroes of all time! There will be time at the end for a Q & A.

GERMAN REUNIFICATION. 03 October 1990
The German reunification (German: Deutsche Wiedervereinigung) was the process in 1990 in which the German Democratic Republic (GDR/DDR/East Germany) joined the Federal Republic of Germany (FRG/West Germany) to form the reunited nation of Germany, and when Berlin reunited into a single city, as provided by its then Grundgesetz constitution Article 23. The end of the unification process is officially referred to as German unity (German: Deutsche Einheit), celebrated on 3 October (German Unity Day) (German: Tag der deutschen Einheit).[1] Following German reunification, Berlin was once again designated as the capital of united Germany.

World War I officially came to an end with the signing of the Treaty of Versailles on June 28, 1919.
32 countries had come together in Paris in January 1919 to hold a conference which would make peace after the First World War. It would be dominated by the ‘big three’: - David Lloyd George, representing Britain, Georges Clemençeau representing France and Woodrow Wilson representing the USA.

It's one of the most important treaties in German history: the Two-Plus-Four Treaty was the foundation for German reunifcation in 1990. The Treaty of Versailles was the first of the big peace treaties after the armistice of 1918. In just six months the allied powers had – without talking to the defeated powers – negotiated a new world order while trying to make sure Germany would pay reparations to rebuild. The German delegation was only informed about the peace terms a few weeks before signing the Treaty and they were shocked about the terms. In May 1919 they even considered not signing the contract at all.

The Peaceful Revolution, a series of protests by East Germans, led to the GDR's first free elections on 18 March 1990, and to the negotiations between the GDR and FRG that culminated in a Unification Treaty. Other negotiations between the GDR and FRG and the four occupying powers produced the so-called "Two Plus Four Treaty" (Treaty on the Final Settlement with Respect to Germany) granting full sovereignty to a unified German state, whose two parts were previously bound by a number of limitations stemming from their post-World War II status as occupied regions.
The 1945 Potsdam Agreement had specified that a full peace treaty concluding World War II, including the exact delimitation of Germany's postwar boundaries, required to be "accepted by the Government of Germany when a government adequate for the purpose is established." The Federal Republic had always maintained that no such government could be said to have been established until East and West Germany had been united within a free democratic state; but in 1990 a range of opinions continued to be maintained over whether a unified West Germany, East Germany and Berlin could be said to represent 'Germany as a whole' for this purpose. The key question was whether a Germany that remained bounded to the east by the Oder-Neisse Line could act as a 'united Germany' in signing the peace treaty without qualification. Under the "Two Plus Four Treaty" both the Federal Republic and the GDR committed themselves and their unified continuation to the principle that their joint pre-1990 boundaries constituted the entire territory that could be claimed by a Government of Germany, and hence that there were no further lands outside those boundaries that were parts of Germany as a whole.
The united Germany is the enlarged continuation of the Federal Republic and not a successor state. As such, the Federal Republic of Germany retained all its memberships in international organizations including the European Community (later the European Union) and NATO, while relinquishing membership in the Warsaw Pact and other international organizations to which only East Germany belonged.

The Governments of the French Republic, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland and the United States of America,
REPRESENTED by their Ministers for Foreign Affairs meeting at New York on 1 October 1990,
HAVING REGARD to the Treaty on the Final Settlement with respect to Germany signed at Moscow on 12 September 1990, which provides for the termination of their rights and responsibilities relating to Berlin and to Germany as a whole,
DECLARE that the operation of their rights and responsibilities relating to Berlin and to Germany as a whole shall be suspended upon the unification of Germany, pending the entry into force of the Treaty on the Final Settlement with respect to Germany. As a result, the operation of the corresponding, related quadripartite agreements, decisions and practices and all related Four Power institutions shall likewise be suspended upon the unification of Germany.
The Government of the Federal Republic of Germany, represented by its Minister for Foreign Affairs, and the Government of the German Democratic Republic, represented by its Minister for Education and Science, take note of this declaration.

The Treaty of Versailles was the first of the big peace treaties after the armistice of 1918. In just six months the allied powers had – without talking to the defeated powers – negotiated a new world order while trying to make sure Germany would pay reparations to rebuild. The German delegation was only informed about the peace terms a few weeks before signing the Treaty and they were shocked about the terms. In May 1919 they even considered not signing the contract at all.
