The Declaration of Independence from July 4, 1776 states "When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which THE LAWS OF NATURE AND OF NATURE'S GOD ENTITLE THEM, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation. We hold these truths to be self-evident, that all men are created equal, THAT THEY ARE ENDOWED BY THEIR CREATOR WITH CERTAIN UNALIENABLE RIGHTS, that among these are Life, Liberty and the pursuit of Happiness..." As several astute commenters pointed out, not only was I not uncooperative, but I was not obligated to and should not have complied with the cops illegal orders to present my ID, get out of the car, or consent to be patted down. They had no probable cause or reasonable suspicion to do this. Note that I did not, however, ever turn off the camera or stop recording, despite the officer's threats that he would arrest us and seize our camera. The reason he didn't arrest us for filming is because he knew it was not illegal for us to film. Also, we did not consent to a search of our vehicle. That is why he could not search it. It has sound and when compared to the full video which shows him driving at a dangerous speed, why is the audio muted? Still based on some motorcycle owners I have talked to it is possible not to hear the police when driving down the road www.youtube.com However, it does make you wonder why the audio is muted on the longer clip. Anthony Garber who posted the video on YouTube is now facing 16 years in prison for his video. He was not arrested at the time of the stop but was only cited for doing 85 mph. Radley Balko, a civil libertarian best known for his work at Reason, Cato, and the Huffington Post, talks with John Stossel about the need for citizens to be able to film the police. In one clip, they show how an officer intentionally throws himself into a bicyclist while proclaiming the cyclist intentionally rammed him. In another clip, a policeman denies drawing his gun at a snowball fight when the video clearly shows that he did. Should the police feel afraid to act if they are filmed? If they are doing their job correctly, why should they? At the end of the show, Stossel dicusses the corruption of Nixon's vice president Spiro Agnew and the corruption he and many other politicians were found guilty of. Isn't it good that we have a record of their corruption so that justice could be served? Shouldn't the same standard be applied to the police? Stossel's final point: individuals deserve privacy, individuals who get public money (such as ACORN administrators) deserve less privacy, and people who receive government money and who have the ability to forcibly control you - and the authority to hold a gun to your head - deserve to be held fully accountable and absolutely should be video recorded.
