Three men have appeared in court charged with assaulting an inciting hatred against an Indian student, early last year.

The Frankston Magistrates Court heard the alleged victim was punched in the head, and subjected to racial taunts after catching a bus from the Frankston railway station.

It is understood the three men are the first to be prosecuted under section 24 of the Racial and Religious Tolerance Act.

Their lawyers have indicated they will contest the charges.

The matter will return to court in July.
